Chair McIff called the meeting to order at 7:45 a.m.

Chair McIff turned the chair over to Rep. Perry.

H.B. 338    Alimony Revisions (Rep. K. McIff)

Rep. McIff presented the bill to the committee.

MOTION:    Rep. Christensen moved to proceed to the next item on the agenda. The motion passed unanimously.

H.B. 196    Judgment by Confession Amendments (Rep. E. Tanner)

Rep. Tanner presented the bill to the committee and distributed a handout.

Rep. Hutchings moved to replace H.B. 196 with 1st Substitute H.B. 196, "Judgement By Confession Amendments." The motion passed unanimously, with Rep. Christensen and Rep. McIff absent for the vote.

MOTION:    Rep. Arent moved to proceed to the next item on the agenda. The motion passed

unanimously, with Rep. Christensen and Rep. McIff absent for the vote.

H.B. 314    Parent-time Amendments (Rep. V. Peterson)

Rep. V. Peterson presented the bill to the committee, with the assistance of Mr. Stewart Raphs, Legal Aid Society of Salt Lake.

MOTION:    Rep. Hall moved to pass the bill out favorably. The motion passed, with Rep. Christensen, Rep. Hutchings, and Rep. Perry voting in opposition and Rep. McIff absent for the vote.

H.B. 327    Probate Amendments (Rep. V. L. Snow)

Rep. Snow presented the bill to the committee with the assistance of Mr. Michael Jensen.

MOTION:    Rep. King moved to pass the bill out favorably. The motion passed with Rep. Arent and Rep. Christensen absent for the vote.

H.B. 331    Property Damage Claims (Rep. V. L. Snow)

Rep. Snow presented the bill to the committee.

MOTION:    Rep. Arent moved to amend the bill as follows:


1.    Page 2, Lines 54 through 57 :    

             54          (a) any liability decision in

{   the   }        an       original small claims      {   court   }        action       is nonbinding in any

             55     
{   subsequent   }        separate       legal action for bodily injury; and

             56          (b) no additional property damage claims can be brought in any
{   subsequent   }        separate       legal action

             57      for bodily injury.

MOTION:    Rep. Snow moved to pass the bill out favorably. The motion passed, with Rep. Arent and Rep. King voting in opposition.

H.B. 143    Mobile Home Property Rights Amendments (Rep. L. Christensen)

The bill was not considered in the meeting.

MOTION:    Rep. Arent moved to adjourn the meeting. The motion passed unanimously.

Vice Chair Perry adjourned the meeting at 9:58 a.m.
