Chair Osmond called the meeting to order at 2:04 p.m.
        
Approval of Minutes    

MOTION: Sen. Reid moved to adopt the minutes of the January 31, 2013 meeting. The motion              passed unanimously with Sen. Jones, Sen. Knudson and Sen. Okerlund absent for             the vote.

S.B. 147    Worker's Compensation and Occupational Safety Related Amendments (K. Mayne)

Sen. Mayne introduced and explained the bill.

MOTION: Sen. Stevenson moved to adopt amendments 1 and 2 as follow:

Amendment 1:

1.    Page 3, Lines 68 through 74 :    

             68          (c) "Physician extender" means:
             69          (i) an individual licensed under Title 58, Chapter 31b, Nurse Practice Act, as an
             70      advanced practice registered nurse, who is practicing as a nurse practitioner;
             71          (ii) an individual licensed under Title 58, Chapter 70a, Physician Assistant Act; or
             72          (iii)
{   a licensed   }        an       individual        licensed under Title 58, Occupations and Professions,       who is not a physician, but who      {   performs   }        is authorized by the individual's licensing act to perform some       medical activities

             73      typically performed by a physician, as defined by rule by the commission made in accordance


             74      with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.

Amendment 2:

1.    Page 11, Line 335 through Page 12, Line 341 :    

             335          (1) The commission may by rule, made in accordance with Title 63G, Chapter 3, Utah
             336      Administrative Rulemaking Act, establish for purposes of health care goods and services
             337      compensable under this chapter and Chapter 3, Utah Occupational Disease Act, health care
             338      treatment protocols and determinations of medical necessity of goods and services.
  (2) Notwithstanding Subsection (1), an insurer or employer may use all or part of the Washington State Department of Labor and Industries "Guideline for Prescribing Opioids to Treat Pain in Injured Workers" which takes effect July 1, 2013, or a later edition of these guidelines if the later edition is approved by the commission by rule, made in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.

(3) The commission shall reasonably enforce the healthcare treatment protocols and determinations of medical necessity of goods and services adopted under Subsection (1) or used under Subsection (2).

{   (2)   }        (4)       This section does not prohibit an insurer or employer from contracting with a

             340      provider of health services related to health care treatment protocols and determinations of
             341      medical necessity of goods and services.

The motion passed unanimously with Sens. Knudson, Sen. Jones and Sen. Okerlund absent for the vote.

MOTION: Sen. Knudson moved to go to the next item on the agenda. The motion passed              unanimously with Sen. Okerlund absent for the vote.

S.B. 53 Intergenerational Welfare Reform (S. Reid)


Sen. Reid introduced and explained the bill.

Sen. Mayne moved to send S.B. 53 out of committee with a favorable      recommendation. The motion passed unanimously with Sen. Okerlund absent for          the vote.

H.B. 22 Utah Commission on Service and Volunteerism (J. Bird)

Rep. Bird introduced the bill assisted by Julie Fisher, Director, Utah Department of Community and Culture.

MOTION: Sen. Reid moved to pass H.B. 22 out favorably. The motion passed              unanimously with Sen. Okerlund absent for the vote.

MOTION: Sen. Reid moved to place H.B. 22 on the Consent Calendar. The motion              passed unanimously with Sen. Okerland absent for the vote.

H.B. 25 Agency Reporting Provisions (J. Bird)

Rep. Bird introduced and explained the bill assisted by Geoff Landward, Department of Workforce Services.

MOTION: Sen. Jones moved to pass H.B. 25 out favorably. The motion passed unanimously.

MOTION: Sen. Jones moved to place H.B. 25 on the Consent Calendar. The motion      passed unanimously.

M OTION:     Sen. Stevenson moved to adjourn. The motion passed unanimously at 2:50 p.m.
