         SCHOOL PERFORMANCE REPORT AMENDMENTS

Senator Aaron Osmond proposes the following amendments:

1.    Page 1, Line 15 :    

             15          .    provides for public online access to a school performance report;

             18      scores if fewer than 10 test scores are in the group of aggregated test scores

    . requires a school principal, or the principal's designee, to provide certain U-PASS test scores aggregated at the class level to a parent or guardian of a student enrolled in the school upon the request of the student's parent or guardian.

             27      Be it enacted by the Legislature of the state of Utah:
      Section 1. Section 53A-1-607 is amended to read:      

     53A-1-607 .   Scoring -- Reports of results
  -- Parent or guardian access to class level data       .

     (1) Each local school board and charter school shall submit all answer sheets for the achievement tests administered under U-PASS on a per-school and per-class basis to the state superintendent of public instruction for scoring unless the test requires scoring by a national testing service.
     (2) The district, school, and class results of the U-PASS testing program, but not the score or relative position of individual students, shall be reported to each local school board or charter school governing board annually at a regularly scheduled meeting.
     (3)
  (a)       Each local board and charter school governing board shall make copies of the report        , excluding test results aggregated at the class level,       available to the general public upon request.

      (b) A student's parent or guardian may access U-PASS test results aggregated at the class level as provided in Subsection (6).      

     (4) The board may charge a fee for the copying costs.
     (5) The State Board of Education shall annually provide to school districts and charter schools a comprehensive report for each of their students showing the student's U-PASS test results for each year the

student took a U-PASS test. School districts and charter schools shall give a copy of the comprehensive report to the student's parents and make the report available to school staff, as appropriate.

      (6) (a) Upon the request of a student's parent or guardian, a principal, or the principal's designee, shall provide to the parent or guardian U-PASS test data aggregated at the class level for a class at the student's school, if:

    (i) (A) the student is enrolled in the class;
    (B) the class is within the student's grade level; or
    (C) the class is another section of a course the student takes; and
    (ii) at least ten test scores are in the group of aggregated test scores.
    (b) When a principal, or the principal's designee, provides to a parent or guardian U-PASS test data aggregated at the class level pursuant to Subsection (6)(a), the principal, or the principal's designee, shall:
    (i) discuss with the parent or guardian factors to consider when interpreting the significance of class level test data, including that:
    (A) multiple teachers may be responsible for the instruction of students in a class; and
    (B) student demographics and other characteristics of students vary greatly from class to class and may have a significant influence on class level test data;
    (ii) provide other information that may be helpful in addressing the purpose of the request for U-PASS test score data;
    (iii) advise the parent or guardian that due to the limitations in interpreting test score data without receiving the additional information provided by the principal, or the principal's designee, the parent or guardian is requested to use the test score data for the parent's or guardian's personal use; and
    (iv) request the parent or guardian to sign an acknowledgment that the principal, or the principal's designee, provided the information in Subsections (6)(b)(i) through (iii).
