         WORKERS' COMPENSATION AND OCCUPATIONAL SAFETY RELATED AMENDMENTS

Senator Jerry W. Stevenson proposes the following amendments:

1.    Page 11, Line 335 through Page 12, Line 341 :    

             335          (1) The commission may by rule, made in accordance with Title 63G, Chapter 3, Utah
             336      Administrative Rulemaking Act, establish for purposes of health care goods and services
             337      compensable under this chapter and Chapter 3, Utah Occupational Disease Act, health care
             338      treatment protocols and determinations of medical necessity of goods and services.
  (2) Notwithstanding Subsection (1), an insurer or employer may use all or part of the Washington State Department of Labor and Industries "Guideline for Prescribing Opioids to Treat Pain in Injured Workers" which takes effect July 1, 2013, or a later edition of these guidelines if the later edition is approved by the commission by rule, made in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act.

(3) The commission shall reasonably enforce the healthcare treatment protocols and determinations of medical necessity of goods and services adopted under Subsection (1) or used under Subsection (2).
