7 LONG TITLE
8 General Description:
9 This bill provides for child sexual abuse prevention training and instruction in
10 elementary schools.
11 Highlighted Provisions:
12 This bill:
13 . adopts certain recommendations of Illinois's Erin's Law Task Force;
14 . H. [

15 child sexual abuse prevention and awareness to:
16 . H. [
17 . the parents or guardians of elementary school students; and
18 . elementary students; and
19 . requires the State Board of Education, in partnership with the Department of Human
20 Services and nonprofit organizations specializing in child sexual abuse prevention,
21 to approve instructional materials for the training and instruction of child sexual
22 abuse prevention and awareness.

31 Be it enacted by the Legislature of the state of Utah:
32 Section 1. Section 53A-13-112 is enacted to read:
33 53A-13-112. Child sexual abuse prevention.
34 (1) As used in this section, "school personnel" is as defined in Section 53A-11-605 .

36 provide child sexual abuse prevention training and instruction to:
37 (a) H. [
38 (i) responding to a disclosure of child sexual abuse in a supportive, appropriate
39 manner; and
40 (ii) the mandatory reporting requirements described in Sections 53A-6-502 and
41 62A-4a-403 ;
42 (b) parents or guardians of elementary school students on:
43 (i) recognizing warning signs of a child who is being sexually abused; and
44 (ii) effective, age-appropriate methods for discussing the topic of child sexual abuse
45 with a child; and
46 (c) elementary school students using age-appropriate curriculum.
47 (3) On or before July 1, 2015, the State Board of Education shall approve, in
48 partnership with the Department of Human Services and nonprofit organizations specializing in
49 child sexual abuse prevention, age-appropriate instructional materials for the training and
50 instruction described in Subsection (2).
51 (4) A school district or charter school H. that provides the training and instruction
51a described in Subsection (2) .H shall use the instructional materials approved by
52 the State Board of Education under Subsection (3).
53 (5) A school district or charter school may:
54 (a) determine the mode of delivery for the training and instruction described in
55 Subsection (2); and
56 (b) partner with a nonprofit organization to provide the training and instruction.
56a H. (6)(a) A student may not be given the instruction under Subsection (2) unless
56b the student's parent or guardian is notified in advance of the instruction and its content, given
56c a prior opportunity to review the materials to be used, and notified in advance of the parent or
56d guardian's right to have the student excused from the instruction.
56e (b) Upon the written request of a student's parent or guardian, the student shall be
56f excused from the instruction described in Subsection (2). .H

58 Committee on the progress of the provisions of this section by the committee's November 2017
59 meeting.
60 (b) A school district or charter school shall provide to the State Board of Education
61 information that is necessary for the board's report to the Legislature's Education Interim
62 Committee as required in Subsection H. [
