8 LONG TITLE
9 General Description:
10 This bill modifies provisions relating to Capitol Preservation Board donations and
11 funds.
12 Highlighted Provisions:
13 This bill:
14 . provides that the Capitol Preservation Board may return funds or donations to the
15 donor under certain circumstances;
16 . permits the Capitol Preservation Board to elect to transfer funds originally donated
17 for an Olympic memorial on capitol hill to another entity, with certain restrictions;
18 and
19 . repeals the provision relating to transfer of the Olympic memorial funds after one
20 year.

24 This bill provides an immediate effective date.

33 Be it enacted by the Legislature of the state of Utah:
34 Section 1. Section 63C-9-501 is amended to read:
35 63C-9-501. Soliciting donations.
36 (1) The executive director, under the direction of the board, shall:
37 (a) develop plans and programs to solicit gifts, money, and items of value from private
38 persons, foundations, or organizations; and
39 (b) actively solicit donations from those persons and entities.
40 (2) (a) Property provided by those entities is the property of the state and is under the
41 control of the board.
42 (b) Subsection (2)(a) does not apply to temporary exhibits or to the personal property
43 of persons having an office in a building on capitol hill.
44 (3) The board [
45 (a) shall deposit money donated to the board into the State Capitol Fund established by
46 this part; [
47 (b) shall use gifts of money made to the board for the purpose specified by the grantor,
48 if any[
49 (c) may return to the donor any gift or money donated to the board if a majority of the
50 board determines that use of the gift or money is unfeasible, or will otherwise not be placed or
51 used on capitol hill.
52 Section 2. Section 63C-9-501.1 is enacted to read:
53 63C-9-501.1. Donations from 2002 Olympic Funds.
54 Upon a majority vote of the board, the funds donated to the board from the 2002 Salt
55 Lake Olympics Organizing Committee for the purpose of constructing an Olympic monument
56 on capitol hill may be transferred to the Utah Olympic Legacy Foundation, provided that the
57 funds are to be used for the purpose of supporting the 2002 Salt Lake Olympics legacy projects
58 at a location within the state.
59 Section 3. Section 63I-2-263 is amended to read:
60 63I-2-263. Repeal dates, Title 63A to Title 63M.
61 (1) Section 63A-1-115 is repealed on July 1, 2014.
62 (2) Section 63C-9-501.1 is repealed on July 1, 2015.

66 Section 4. Effective date.
67 If approved by two-thirds of all the members elected to each house, this bill takes effect
68 upon approval by the governor, or the day following the constitutional time limit of Utah
69 Constitution, Article VII, Section 8, without the governor's signature, or in the case of a veto,
70 the date of veto override.
