             7      LONG TITLE
             8      General Description:
             9          This bill provides for funding for Advanced Placement test fees of low-income
             10      students.
             11      Highlighted Provisions:
             12          This bill:
             13          .    allows the State Board of Education to allocate money appropriated for the
             14      Enhancement for Accelerated Students Program for advanced placement test fees of
             15      eligible low-income students;
             16          .    appropriates money for the Enhancement for Accelerated Students Program; and
             17          .    provides intent language directing that money appropriated for the Enhancement for
             18      Accelerated Students Program be used for advanced placement test fees of eligible
             19      low-income students.
             20      Money Appropriated in this Bill:
             21          This bill appropriates in fiscal year 2015:
             22          .    to Related to Basic Programs - Related to Basic School Programs as a one-time
             23      appropriation:
             24              .    from the Education Fund, $100,000.
             25      Other Special Clauses:
             26          This bill takes effect on July 1, 2014.

             31      Be it enacted by the Legislature of the state of Utah:
             32          Section 1. Section 53A-17a-165 is amended to read:
             33           53A-17a-165. Enhancement for Accelerated Students Program.
             34          (1) As used in this section, "eligible low-income student" means a student who:
             35          (a) takes an Advanced Placement test;
             36          (b) has applied for an Advanced Placement test fee reduction; and
             37          (c) qualifies for a free or a lunch provided at reduced cost.
             38          [(1)] (2) The State Board of Education shall distribute money appropriated for the
             39      Enhancement for Accelerated Students Program to school districts and charter schools
             40      according to a formula adopted by the State Board of Education, after consultation with school
             41      districts and charter schools.
             42          [(2)] (3) A distribution formula adopted under Subsection [(1)] (2) may include an
             43      allocation of money for:
             44          (a) Advanced Placement courses;
             45          (b) Advanced Placement test fees of eligible low-income students;
             46          [(b)] (c) gifted and talented programs, including professional development for teachers
             47      of high ability students; and
             48          [(c)] (d) International Baccalaureate programs.
             49          [(3)] (4) The greater of 1.5% or $100,000 of the appropriation for the Enhancement for
             50      Accelerated Students Program may be allowed for International Baccalaureate programs.
             51          [(4)] (5) A school district or charter school shall use money distributed under this
             52      section to enhance the academic growth of students whose academic achievement is
             53      accelerated.
             54          [(5)] (6) (a) The State Board of Education shall develop performance criteria to
             55      measure the effectiveness of the Enhancement for Accelerated Students Program and make an
             56      annual report to the Public Education Appropriations Subcommittee on the effectiveness of the
             57      program.


             58          (b) In the report required by Subsection (6)(a), the State Board of Education shall
             59      include data showing the use and impact of money allocated for Advanced Placement test fees
             60      of eligible low-income students.
             61          Section 2. Appropriation.
             62          Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, for
             63      the fiscal year beginning July 1, 2014, and ending June 30, 2015, the following sums of money
             64      are appropriated from resources not otherwise appropriated, or reduced from amounts
             65      previously appropriated, out of the funds or accounts indicated. These sums of money are in
             66      addition to any amounts previously appropriated for fiscal year 2015.
             67          To Related to Basic Programs - Related to Basic School Programs
             68          From Education Fund, One-time

             71          The Legislature intends that the appropriation for the Enhancement for Accelerated
             72      Students Program be used for Advanced Placement test fees of eligible low-income students as
             73      defined in Section 53A-17a-165 .
             74          Section 3. Effective date.
             75          This bill takes effect on July 1, 2014.
