             10      General Description:
             11          This bill requires the Utah Department of Health to amend the state Medicaid plan to
             12      create a qualified long-term care insurance partnership.
             13      Highlighted Provisions:
             14          This bill:
             15          .    requires the Utah Department of Health to amend the state Medicaid plan to create a
             16      qualified long-term care insurance partnership as defined in federal law; and
             17          .    gives the Utah Department of Health authority to make rules in order to comply
             18      with federal laws and regulations relating to qualified long-term care insurance
             19      partnerships and qualified long-term care insurance contracts.

             28      Be it enacted by the Legislature of the state of Utah:
             29          Section 1. Section 26-18-409 is enacted to read:
             30          26-18-409. Long-term care insurance partnership.
             31          (1) As used in this section:
             32          (a) "Qualified long-term care insurance contract" is as defined in 26 U.S.C. Sec.
             33      7702B(b).
             34          (b) "Qualified long-term care insurance partnership" is as defined in 42 U.S.C. Sec.
             35      1396p(b)(iii).
             36          (c) "State plan amendment" means an amendment to the state Medicaid plan drafted by
             37      the department in compliance with this section.
             38          (2) No later than July 1, 2014, the department shall seek federal approval of a state plan
             39      amendment that creates a qualified long-term care insurance partnership.
             40          (3) The department may make rules to comply with federal laws and regulations
             41      relating to qualified long-term care insurance partnerships and qualified long-term care
             42      insurance contracts.
