             7      LONG TITLE
             8      General Description:
             9          This bill amends the Pharmacy Practice Act related to prescription eye drops.
             10      Highlighted Provisions:
             11          This bill:
             12          .    allows a pharmacist or pharmacy intern to dispense a refill of a prescription for a
             13      liquid legend drug administered to the eye once an amount of time has passed after
             14      which a patient should have used 50% of the dosage units of the drug according to a
             15      practitioner's instructions; and
             16          .    makes technical and conforming amendments.

             25      Be it enacted by the Legislature of the state of Utah:
             26          Section 1. Section 58-17b-608.1 is amended to read:
             27           58-17b-608.1. Refills of legend drug prescriptions.


             28          (1) If a prescription for a legend drug includes authorization for one or more refills, a
             29      pharmacist or pharmacy intern may dispense one or more of the refills at the time the drug is
             30      dispensed, if:
             31          [(1)] (a) the drug is not a controlled substance;
             32          [(2)] (b) the prescription does not include "Dispense quantity written," or some other
             33      notation having similar meaning;
             34          [(3)] (c) the total dosage units dispensed, including the units for both the prescription
             35      and any refills, do not exceed a 100-day supply; and
             36          [(4)] (d) in the professional judgment of the pharmacist or pharmacy intern, the refill[,]
             37      or refills[,] should be dispensed at the time the prescription is dispensed.
             38          (2) A pharmacist or pharmacy intern may dispense a refill of a prescription for a liquid
             39      legend drug administered to the eye once an amount of time has passed after which a patient
             40      should have used 50% of the dosage units of the drug according to a practitioner's instructions.
