7 LONG TITLE
8 General Description:
9 This bill modifies provisions related to the Student Leadership Skills Development
10 Pilot Program.
11 Highlighted Provisions:
12 This bill:
13 . allows a school to use School LAND Trust Program money to implement a student
14 leadership skills development program;
15 . requires a school that receives a grant under the pilot program to:
16 . set school-wide goals for the school's student leadership skills development
17 program; and
18 . require each student to set personal goals;
19 . specifies the data a school shall use to measure the effectiveness and impact of a
20 school's student leadership skills development program on student behavior and
21 academic achievement;
22 . prohibits the State Board of Education from awarding additional grant money to a
23 school that fails to demonstrate an improvement in student behavior and academic
24 achievement; and
25 . revises the date for a report on the pilot program to the Legislature.

38 Be it enacted by the Legislature of the state of Utah:
39 Section 1. Section 53A-16-101.5 is amended to read:
40 53A-16-101.5. School LAND Trust Program -- Purpose -- Distribution of funds --
41 School plans for use of funds.
42 (1) There is established the School LAND (Learning And Nurturing Development)
43 Trust Program to:
44 (a) provide financial resources to public schools to enhance or improve student
45 academic achievement and implement a component of the school improvement plan; and
46 (b) involve parents and guardians of a school's students in decision making regarding
47 the expenditure of School LAND Trust Program money allocated to the school.
48 (2) (a) The program shall be funded each fiscal year:
49 (i) from the Interest and Dividends Account created in Section 53A-16-101 ; and
50 (ii) in the amount of the sum of the following:
51 (A) the interest and dividends from the investment of money in the permanent State
52 School Fund deposited to the Interest and Dividends Account in the immediately preceding
53 year; and
54 (B) interest accrued on money in the Interest and Dividends Account in the
55 immediately preceding fiscal year.
56 (b) On and after July 1, 2003, the program shall be funded as provided in Subsection
57 (2)(a) up to an amount equal to 2% of the funds provided for the Minimum School Program,
58 pursuant to Title 53A, Chapter 17a, Minimum School Program Act, each fiscal year.
59 (c) (i) The Legislature shall annually allocate, through an appropriation to the State
60 Board of Education, a portion of the Interest and Dividends Account created in Section
61 53A-16-101 to be used for:
62 (A) the administration of the School LAND Trust Program; and
63 (B) the performance of duties described in Section 53A-16-101.6 .
64 (ii) Any unused balance remaining from an amount appropriated under Subsection
65 (2)(c)(i) shall be deposited in the Interest and Dividends Account for distribution to schools in
66 the School LAND Trust Program.
67 (3) (a) The State Board of Education shall allocate the money referred to in Subsection
68 (2) annually for the fiscal year beginning July 1, 2013, and for each fiscal year thereafter as
69 follows:
70 (i) the Utah Schools for the Deaf and the Blind and the charter schools combined shall
71 receive funding equal to the product of:
72 (A) enrollment on October 1 in the prior year at the Utah Schools for the Deaf and the
73 Blind, or in the charter schools combined, divided by enrollment on October 1 in the prior year
74 in public schools statewide; and
75 (B) the total amount available for distribution under Subsection (2);
76 (ii) the amount allocated to the charter schools combined under Subsection (3)(a)(i)
77 shall be distributed among charter schools in accordance with a formula specified in rules
78 adopted by the State Board of Education in consultation with the State Charter School Board;
79 and
80 (iii) of the funds available for distribution under Subsection (2) after the allocation of
81 funds for the Utah Schools for the Deaf and the Blind and charter schools:
82 (A) school districts shall receive 10% of the funds on an equal basis; and
83 (B) the remaining 90% of the funds shall be distributed on a per student basis.
84 (b) A school district shall distribute its allocation under Subsection (3)(a)(iii) to each
85 school within the district on an equal per student basis.
86 (c) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
87 State Board of Education may make rules regarding the time and manner in which the student
88 count shall be made for allocation of the money under Subsection (3)(a)(iii).
89 (4) To receive its allocation under Subsection (3):
90 (a) a school shall have established a school community council in accordance with
91 Section 53A-1a-108 ; and
92 (b) the school's principal shall provide a signed, written assurance in accordance with
93 rules of the State Board of Education that the membership of the school community council is
94 consistent with the membership requirements specified in Section 53A-1a-108 .
95 (5) (a) The school community council or its subcommittee shall create a [
96 plan to use its allocation under Subsection (3) to implement a component of the school's
97 improvement plan[
98 (b) A plan created under Subsection (5)(a) shall include:
99 (i) the school's identified most critical academic needs;
100 (ii) a recommended course of action to meet the identified academic needs;
101 (iii) a specific listing of any programs, practices, materials, or equipment which the
102 school will need to implement a component of its school improvement plan to have a direct
103 impact on the instruction of students and result in measurable increased student performance;
104 and
105 (iv) how the school intends to spend its allocation of funds under this section to
106 enhance or improve academic excellence at the school.
107 (c) A school may use School LAND Trust Program money to implement a student
108 leadership skills development program to enhance a school's learning environment and
109 improve academic achievement.

112 which a quorum is present.
113 (ii) If a majority of the quorum votes to adopt a plan for the use of School LAND Trust
114 Program money, the plan is adopted.

116 (i) post a plan for the use of School LAND Trust Program money that is adopted in
117 accordance with Subsection (5)(b) on the School LAND Trust Program website; and
118 (ii) include with the plan a report noting the number of school community council
119 members who voted for or against the approval of the plan and the number of members who
120 were absent for the vote.

123 (ii) If a local school board disapproves a plan for the use of School LAND Trust
124 Program money, the local school board shall provide a written explanation of why the plan was
125 disapproved and request the school community council who submitted the plan to revise the
126 plan.
127 (iii) The school community council shall submit a revised plan to the local school
128 board for approval.
129 (6) (a) Each school shall:
130 (i) implement the program as approved;
131 (ii) provide ongoing support for the council's program; and
132 (iii) meet State Board of Education reporting requirements regarding financial and
133 performance accountability of the program.
134 (b) (i) Each school, through its school community council, shall prepare and post an
135 annual report of the program on the School LAND Trust Program website each fall.
136 (ii) The report shall detail the use of program funds received by the school under this
137 section and an assessment of the results obtained from the use of the funds.
138 (iii) A summary of the report shall be provided to parents or guardians of students
139 attending the school.
140 (7) (a) The governing board of a charter school shall establish a council, which shall
141 prepare a plan for the use of School LAND Trust Program money that includes the elements
142 listed in Subsection (5).
143 (b) (i) The membership of the council shall include parents or guardians of students
144 enrolled at the school and may include other members.
145 (ii) The number of council members who are parents or guardians of students enrolled
146 at the school shall exceed all other members combined by at least two.
147 (c) A charter school governing board may serve as the council that prepares a plan for
148 the use of School LAND Trust Program money if the membership of the charter school
149 governing board meets the requirements of Subsection (7)(b)(ii).
150 (d) (i) Except as provided in Subsection (7)(d)(ii), council members who are parents or
151 guardians of students enrolled at the school shall be elected in accordance with procedures
152 established by the charter school governing board.
153 (ii) Subsection (7)(d)(i) does not apply to a charter school governing board that serves
154 as the council that prepares a plan for the use of School LAND Trust Program money.
155 (e) A parent or guardian of a student enrolled at the school shall serve as chair or
156 cochair of a council that prepares a plan for the use of School LAND Trust Program money.
157 (f) A plan for the use of School LAND Trust Program money shall be subject to
158 approval by the charter school governing board and the entity that authorized the establishment
159 of the charter school.
160 Section 2. Section 53A-17a-169 is amended to read:
161 53A-17a-169. Student Leadership Skills Development Pilot Program.
162 (1) For purposes of this section:
163 (a) "Board" means the State Board of Education.
164 (b) "Matching funds" does not include in-kind contributions of goods or services.

166 Program created in Subsection (2).
167 (2) There is created the Student Leadership Skills Development Pilot Program to
168 develop student behaviors and skills that enhance a school's learning environment and are vital
169 for success in a career, including:
170 (a) communication skills;
171 (b) teamwork skills;
172 (c) interpersonal skills;
173 (d) initiative and self-motivation;
174 (e) goal setting skills;
175 (f) problem solving skills; and
176 (g) creativity.
177 (3) (a) The board shall administer the program and award grants to elementary schools
178 that apply for a grant on a competitive basis.
179 (b) [
180 award a grant of up to $10,000 per school.
181 (4) An elementary school may participate in the pilot program established under this
182 section in accordance with rules of the State Board of Education.
183 (5) In selecting elementary schools to participate in the pilot program, the board shall:
184 (a) require a school to provide matching funds in an amount equal to the grant the
185 school receives from the board;
186 (b) require a school to participate in the pilot program for two years; and
187 (c) give preference to Title I schools or schools in need of academic improvement.
188 (6) A school that receives a grant described in Subsection (3) shall [

190 (a) (i) set school-wide goals for the school's student leadership skills development
191 program; and
192 (ii) require each student to set personal goals; and
193 (b) provide the following to the board after the first school year of implementation of
194 the program:

196 developing the school's own student leadership skills development program; and
197 [
198 skills development program on student behavior and academic results[
199 (A) attendance;
200 (B) statewide assessments of academic achievement;
201 (C) incidents of student misconduct or disciplinary actions; and
202 (D) the achievement of school-wide goals and students' personal goals.
203 (7) The board may not award additional grant money to a school if the school fails to
204 demonstrate an improvement in student behavior and academic achievement as measured by
205 the data reported under Subsection (6).

208 (b) The report shall include an evaluation of the pilot program's success in enhancing a
209 school's learning environment and improving academic achievement.
210 Section 3. Appropriation.
211 Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, for
212 the fiscal year beginning July 1, 2014, and ending June 30, 2015, the following sums of money
213 are appropriated from resources not otherwise appropriated, or reduced from amounts
214 previously appropriated, out of the funds or accounts indicated. These sums of money are in
215 addition to any amounts previously appropriated for fiscal year 2015.

219 The Legislature intends that the State Board of Education use the appropriation under
220 this section to implement the Student Leadership Skills Development Pilot Program created in
221 Section 53A-17a-169 .
