8 General Description:
9 This bill deals with the incineration of medical waste.
10 Highlighted Provisions:
11 This bill:
12 . defines terms;
13 . prohibits the Division of Solid and Hazardous Waste from approving an operation
14 plan or issuing a permit to a facility that:
15 . incinerates medical waste within a two-mile radius of a residential area; and
16 . is not in operation on May 13, 2014; and
17 . makes technical changes.

26 Be it enacted by the Legislature of the state of Utah:
27 Section 1. Section 19-6-124 is enacted to read:
28 19-6-124. Incineration of medical waste.
29 (1) As used in this section, "medical waste" means:
30 (a) solid waste generated in the:
31 (i) diagnosis, treatment, or immunization of a human or animal; or
32 (ii) production or testing of a drug or vaccine;
33 (b) a culture or stock of an infectious agent; or
34 (c) a specimen from a medical, pathological, pharmaceutical, research, commercial, or
35 industrial laboratory.
36 (2) Except as provided in Subsection (3), the division may not approve an operation
37 plan or issue a permit for a facility that:
38 (a) incinerates medical waste; and
39 (b) is located within a two-mile radius of a residential area.
40 (3) The division may renew an operation plan or renew a permit for a facility that does
41 not qualify under Subsection (2) if the facility is in operation on May 13, 2014.
