Chair Dunnigan called the meeting to order at 8:09 a.m.

1st Sub. S.B. 124    Financial Institution and Services Amendments (Sen. C. Bramble)

Sen. Bramble distributed a handout titled "Financial Institutions and Service Amendments 1st Sub. SB 124" and explained the bill to the committee.

Spoke for the bill:    Edward Leary, Commissioner, Department of Financial Institutions

MOTION:    Rep. Peterson moved to pass out favorably 1st Sub. S.B. 124. The motion passed unanimously with Rep. Anderson, Rep. Bird, Rep. Froerer, and Rep. Roberts absent for the vote.

MOTION:    Rep. Peterson moved to place 1st Sub. S.B. 124 on the Consent Calendar. The motion passed unanimously with Rep. Anderson and Rep. Froerer absent for the vote.

H.B. 117    Patent Infringement Amendments (Rep. M. McKell)

MOTION:    Rep. Layton moved to replace H.B. 117 with 1st Substitute H.B. 117. The motion passed with Rep. Anderegg voting in opposition.


Rep. McKell explained the bill to the committee assisted by Stan Lockhart, Micron Technology, and Ryan Kirkham, Utah Association of Realtors.

SUBSTITUTE MOTION:    Rep. Wilson moved to pass out favorably 1st. Sub. H.B. 117. The motion was withdrawn.

The motion to hold passed with Rep. Bird voting in opposition and Rep. Anderson absent for the vote.

H.B. 207    Massage Therapy Practice Act Amendments (Rep. B. Greene)

MOTION:    Rep. Roberts moved to replace H.B. 207 with 1st Substitute H.B. 207. The motion passed unanimously with Rep. Anderegg, Rep. Anderson, Rep. McKell, and Rep. Wilson absent for the vote.

MOTION:    Rep. Roberts moved to amend 1st Sub. H.B. 207 as follows:

1.    Page 3, Lines 62 through 65 :    

             62          (m) an individual certified by or through, and in good standing with,
{   a nationally   }        an industry      

             63      recognized organization that represents a profession with established standards and ethics:
             64          (i) who engages in the manipulation of the soft tissues of the body to the hands, feet,
             65      and ears only, including the practice of reflexology and foot zone therapy;

The motion passed unanimously with Rep. Anderegg and Rep. Wilson absent for the vote.

Rep. Greene explained the bill to the committee assisted by Christine Issel, reflexology, and Julie Cheney, Academy of Foot Zone Therapy.

MOTION:    Rep. Layton moved to pass out favorably 1st Sub. H.B. 207.

SUBSTITUTE MOTION:    Rep. Roberts moved to amend the bill as follows:

1.    Page 3, Lines 64 through 67 :    

             64          (i) who engages in the manipulation of the soft tissues of the body to the hands, feet,
             65      and
  outer       ears only, including the practice of reflexology and foot zone therapy;

             66          (ii) whose clients remain fully clothed from the shoulders to the knees; and
             67          (iii) whose clients do not receive gratuitous massage from the individual.

The motion passed unanimously with Rep. Wheatley and Rep. Wilson absent for the vote.

MOTION:    Rep. Layton moved to pass out favorably 1st Sub H.B. 207. The motion passed unanimously with Rep. Wheatley and Rep. Wilson absent for the vote.    

H.B. 108    Mobile Home Park Task Force (Rep. T. Cosgrove)

Rep. Cosgrove distributed a handout titled "HB 108 Manufactured Homes Taskforce" and explained the bill to the committee assisted by Tara Rollins and Barbara Stallone of the Utah housing Coalition.

Spoke against the bill:    Robert Poulsen, attorney

MOTION:    Rep. Duckworth moved to pass out favorably H.B. 108. The motion passed with Rep. Anderegg, Rep. Bird, Rep. Cox, Rep. Froerer, Rep. Roberts, and Rep. Stanard voting in opposition and Rep. Wheatley and Rep. Wilson absent for the vote.

S.B. 130    Trust Deed Foreclosure Amendments (Sen. W. Harper)

This bill was not heard.

MOTION:    Rep. Layton moved to adjourn. The motion passed unanimously with Rep. Wheatley and Rep. Wilson absent for the vote.

Chair Dunnigan adjourned the meeting at 10:03 a.m.
