Chair Ray called the meeting to order at 4:10 p.m.

MOTION:    Rep. Barlow moved to approve the minutes of February 4, 2014. The motion passed unanimously with Rep. Menlove, Rep. Redd, and Rep. Christensen absent for the vote.

H.B. 98    Utah Optometry Practice Act Amendments (Rep. P. Ray)

Chair Ray explained the bill to the committee with the assistance of Dr. Russ Purdy, optometrist.

MOTION:    Chair Ray moved to amend the bill as follows:

1.    Page 3, Lines 77 through 79 :    

             77          (i) [the] an optometrist may prescribe oral antibiotics [may only be prescribed for: (A)
             78      eyelid-related] for only
{   eye   }        eyelid       related ocular conditions or diseases[;], and [(B) any] other ocular

             79      [disease or condition as] conditions or diseases specified by division rule; and

The motion passed unanimously with Rep. Menlove and Rep. Redd absent for the vote.



MOTION:    Rep. Kennedy moved to pass H.B. 98 out favorably as amended. The motion passed unanimously with Rep. Menlove and Rep. Redd absent for the vote.

H.B. 92    Utah Telehealth and Education Network Amendments (Rep. R. Menlove)

At the request of the sponsor, Mr. Barry Walker, Superintendent, South Summit Schools, and Mr. Ray Timothy, Utah Education Network, spoke to the bill, and distributed a UEN folder.

MOTION:    Rep. Cosgrove moved to replace H.B. 92 with 1st Substitute H.B. 92, "Utah Education and Telehealth Network Amendments." The motion passed unanimously with Rep. Kennedy, Rep. Menlove and Rep. Redd absent for the vote.

Rep. Menlove explained the bill to the committee.

MOTION:    Rep. Menlove moved to pass 1st Substitute H.B. 92 out favorably. The motion passed unanimously with Rep. Kennedy absent for the vote.

H.B. 88    Autism Program Amendments (Rep. R. Menlove)

Rep. Menlove explained the bill to the committee and provided the following handouts:

MOTION:    Rep. Barlow moved to amend the bill as follows:

1.    Page 2, Lines 37 through 41 :    

             37          (1) [For purposes of] As used in this section ["autism]:
             38          (a) "Autism spectrum disorder" [means a pervasive developmental disorder] is as
             39      defined by the most recent edition of the Diagnostic and Statistical Manual on Mental
             40      Disorders
  or a recent edition of a professionally accepted diagnostic manual       [, including:].

             41          [(a) autistic disorder;]







2.    Page 3, Line 88 through Page 4, Line 98 :    

             88          (a) necessary to develop, maintain, or restore, to the maximum extent practicable, the
             89      functioning of an individual; and
             90          (b) provided or supervised by
  , for the purposes of the program,       a:

             91          (i) board certified behavior analyst; or
             92          (ii) a licensed psychologist with equivalent university training and supervised
             93      experience who is working toward board certification in applied behavior analysis.
             94          (3) "Autism spectrum disorder" [means a pervasive developmental disorder] is as
             95      defined by the most recent edition of the Diagnostic and Statistical Manual on Mental
             96      Disorders
  or a recent edition of a professionally accepted diagnostic manual       [, including:].

             97          [(a) autistic disorder;]
             98          [(b) asperger's disorder; and]

3.    Page 9, Lines 264 through 271 :    

             264          (ii) provided or supervised by a board certified behavior analyst or a licensed
             265      psychologist with equivalent university training and supervised experience.
             266          (b) "Autism spectrum disorder" [means a pervasive developmental disorder,] is as
             267      defined by the most recent edition of the Diagnostic and Statistical Manual on Mental

The motion passed unanimously with Rep. Kennedy absent for the vote.

    Rep. Cosgrove moved to pass the bill out favorably as amended. The motion passed unanimously with Rep. Kennedy absent for the vote.

    Rep. Cosgrove moved to adjourn the meeting. The motion passed unanimously with Rep. Kennedy absent for the vote.

Chair Ray adjourned the meeting at 5:45 p.m.
