Vice Chair Nielson called the meeting to order at 8:32 a.m.

S.B. 238    Repeal of Substance Abuse Donation Fund (Sen. L. Hillyard)

Sen. Hillyard explained the bill to the committee.

MOTION:    Rep. Briscoe moved to pass the bill out favorably. The motion passed unanimously with Rep. Froerer and Rep. Tanner absent for the vote.

MOTION:    Rep. Briscoe moved to place S.B. 238 on the Consent Calendar. The motion passed unanimously with Rep. Froerer and Rep. Tanner absent for the vote.

1st Sub. S.B. 188    Local Option Sales Tax Amendments (Sen. D. Henderson)

Sen. Henderson explained the bill to the committee with the assistance of Andrew Jackson, Mountainland Association of Governments.


MOTION:    Rep. Stanard moved to pass the bill out favorably. The motion passed unanimously with Rep. Froerer, Rep. McIff, and Rep. Tanner absent for the vote.

H.B. 170    Local School Board Bond Amendments (Rep. D. McCay)

Rep. McCay explained the bill to the committee and distributed a handout, "The Jordan School District Bond."

MOTION:    Rep. King moved to amend the bill as follows:

1.    Page 4, Lines 104 through 105 :    

             104          (5) (a)
{   With   }        After distribution to the public of the voter information pamphlet, with       unanimous approval of the local school board, a local school board may

             105      adjust the plan of finance described in Subsection (3) by:


The motion to amend passed unanimously with Rep. Froerer absent for the vote.

MOTION:    Rep. Sagers moved to amend the bill as follows:

1.    Page 4, Lines 104 through 108 :    

             104          (5) (a) With
{   unanimous   }        two-thirds majority       approval of the local school board, a local school board may

             105      adjust the plan of finance described in Subsection (3) by:
             106          (i) changing the priority designation of a project;
             107          (ii) adding a project that was not listed in the voter information pamphlet; or
             108          (iii) removing a project that was listed in the voter information pamphlet.


SUBSTITUTE MOTION:    Rep. McIff moved to amend the bill as follows:

1.    Page 4, Lines 104 through 108 :    

             104          (5) (a) With
{   unanimous   }        two-thirds majority       approval of the local school board, a local school board may        upon a determination of compelling circumstances      

             105      adjust the plan of finance described in Subsection (3) by:
             106          (i) changing the priority designation of a project;


             107          (ii) adding a project that was not listed in the voter information pamphlet; or
             108          (iii) removing a project that was listed in the voter information pamphlet.
The motion to amend passed with Rep. Anderegg voting in opposition and Rep. Knotwell absent for the vote.

MOTION:    Rep. King moved to pass the bill out favorably as amended. The motion passed with Rep. Nielson voting in opposition and Rep. Knotwell absent for the vote.

H.B. 403    Amendments Related to Education Funding (Rep. J. Briscoe)

Rep. Briscoe explained the bill to the committee and distributed a handout, "State Social Security and Retirement Funding."

Spoke for the bill:        Jay Blaine, Utah Education Association

Spoke against the bill:    Royce Van Tassell, Utah Taxpayers Association

MOTION:    Rep. King moved to pass the bill out favorably. The motion failed with Rep. Briscoe, Rep. Hutchings, Rep. King, and Rep. Sagers voting in favor and Rep. Froerer absent for the vote.

H.B. 435    Taxation of Property Amendments (Rep. D. Sagers)

Rep. Sagers explained the bill to the committee.

MOTION:    Rep. Anderegg moved to pass the bill out favorably. The motion passed unanimously with Rep. Briscoe absent for the vote.

MOTION:    Rep. Knotwell moved to adjourn the meeting. The motion passed unanimously with Rep. Briscoe absent for the vote.

Vice Chair Nielson adjourned the meeting at 10:05 a.m.
