Vice Chair Peterson called the meeting to order at 4:06 p.m.

MOTION:    Rep. Knotwell moved to approve the minutes of the February 19, 2014 meeting. The motion passed unanimously with Rep. McCay and Rep. Pitcher absent for the vote.

H.B. 130    Mobility and Pedestrian Vehicles (Rep. J. Mathis)

Rep. Mathis explained the bill to the committee.

MOTION:    Rep. Anderson moved to amend the bill as follows:


1.    Page 3, Lines 83 through 84 :    

             83          (e) "Physical disability" means a
{   bodily   }        substantial       impairment        in one or more major life activities       that prevents an individual from

             84      qualifying to obtain a license certificate.


2.    Page 7, Lines 199 through 201 :    

             199          (c) is incompetent to drive a motor vehicle or mobility vehicle or
{   is afflicted with   }        has a      

             200      mental or physical
{   infirmities or disabilities   }        disability       rendering it unsafe for the person to drive a motor

             201      vehicle or mobility vehicle upon the highways;

3.    Page 13, Line 398 :

4.    Page 14, Lines 400 through 401 :    

             400          (1) (a) If the division has reason to believe that an applicant for a license or a mobility

MOTION:    
Rep. Fisher moved to pass H.B. 130 out favorably as amended. The motion passed unanimously with Rep. Pitcher absent for the vote.

H.B. 135    Transportation Funding Amendments (Rep. Johnny Anderson)

Rep. Anderson explained the bill to the committee and provided handouts: "Utah's Transportation Plan 2011 - 2040" and "Executive Summary Cumulative Economic Value of Implementing Utah's Unified Transportation Plan."



Rep. Anderson moved to amend the bill as follows:

1.    Page 13, Lines 389 through 395 :    

             389          (i) a portion of the taxes listed under Subsection (3)(a) in an amount equal to 8.3% of
             390      the revenues collected from the following taxes, which represents a portion of the
             391      approximately 17% of sales and use tax revenues generated annually by the sales and use tax
             392      on vehicles and vehicle-related products:
             393          (A)
{   the tax imposed by Subsection (2)(a)(i)(A)   }        a tax rate of 4.70% imposed on a transaction described in Subsection (1)       ;

             394          (B) the tax imposed by Subsection (2)(b)(i);
             395          (C)
{   the tax imposed by Subsection (2)(c)(i)   }        except as provided in Subsection (2)(d) or (e), a tax rate of 1.75% on amounts paid or charged for food or food ingredients       ; and


2.    Page 28, Lines 836 through 837 :    

             836      following manner: The total revenue deposited into the Transportation Fund during the fiscal
             837      year from state highway-user taxes and fees
  and from the amount of sales and use tax revenues deposited in accordance with Section 59-12-103       , minus:


The motion passed unanimously.

MOTION:    Rep. Tanner moved to pass H.B. 135 out favorably as amended. The motion failed with Rep. Pitcher, Rep. Tanner, and Rep. Anderson voting in favor of the bill. Rep. McCay was absent for the vote.


H.B. 360    Prohibition of License Plate Covers (Rep. M. Wheatley)

Rep. Wheatley explained the bill to the committee.

MOTION:    Rep. Fisher moved to pass H.B. 360 out favorably.

SUBSTITUTE
MOTION:    Rep. Lifferth moved to hold the bill. The substitute motion passed unanimously.

H.B. 195    Motor Carrier Amendments (Rep. S. Eliason)


This bill was not considered.

MOTION:    Rep. Knotwell moved to adjourn. The motion passed unanimously.

Vice Chair Peterson adjourned the meeting at 3:37 p.m.
