         ELECTRONIC FILING OF TRAFFIC CITATIONS AND ACCIDENT REPORTS AMENDMENTS

Representative Jon Cox proposes the following amendments:

1.    Page 1, Lines 13 through 15 :    

             13          This bill:
    
  . exempts an officer who is not reasonably able to file a citation electronically from the efiling requirements in a justice court.      

             14          
{   .    exempts a county of the fourth, fifth, or sixth class from electronic filing

             15      requirements for a misdemeanor or infraction citation.  
}


2.    Page 2, Lines 28 through 30 :    

             28          (1) A peace officer or public official who issues a citation pursuant to Section 77-7-18
             29      shall give the citation to the person cited and shall within five
  business       days electronically file the data

             30      from Subsections (2)(a) through (2)(g) with the court specified in the citation. The data

3.    Page 2, Line 56 through Page 3, Line 59 :    

             56          (c) the court to which the defendant was directed to appear is the proper court pursuant
             57      to Section 77-7-21 .
    
  (4) Notwithstanding Subsection (1), if a citing law enforcement officer is not reasonably able to access the efiling system, the citation need not be filed electronically if being filed with a justice court.

{   (4) The provisions of this section requiring electronic filing do not apply to counties of

             59      the fourth, fifth, or sixth class.
