If the department obtains the waivers in accordance with Subsection (3), the department and
the governor are considered to have met the requirements for Subsection(2)(d). If the department does
not obtain waivers in accordance with Subsection (3), the department and the governor shall comply
with Subsection (2)(d) before expanding Medicaid to the optional population.
