7     LONG TITLE
8     General Description:
9          This bill modifies the Utah resource management plan for federal lands.
10     Highlighted Provisions:
11          This bill:
12          ▸     creates the San Juan County Energy Zone;
13          ▸     adopts energy exploration, access, and development policy for the San Juan County
14     Energy Zone; and
15          ▸     makes technical changes.
16     Money Appropriated in this Bill:
17          None
18     Other Special Clauses:
19          This bill provides a special effective date.

28     Be it enacted by the Legislature of the state of Utah:
29          Section 1. Section 63J-8-102 is amended to read:

30          63J-8-102. Definitions.
31          As used in this chapter:
32          (1) "ACEC" means an area of critical environmental concern as defined in 43 U.S.C.
33     Sec. 1702.
34          (2) "AUM" means animal unit months, a unit of grazing forage.
35          (3) "BLM" means the United States Bureau of Land Management.
36          (4) "BLM recommended wilderness" means a wilderness study area recommended for
37     wilderness designation in the final report of the president of the United States to the United
38     States Congress in 1993.
39          (5) "Federal land use designation" means one or a combination of the following
40     congressional or federal actions included in proposed congressional land use legislation:
41          (a) designation of wilderness within the National Wilderness Preservation System;
42          (b) designation of a national conservation area;
43          (c) designation of a watercourse within the National Wild and Scenic River System;
44          (d) designation of an ACEC;
45          (e) designation of a national monument in accordance with the Antiquities Act of 1906,
46     16 U.S.C. Sec. 431 et seq. or by Congress;
47          (f) designation of a national park within the National Park System;
48          (g) designation of a national recreational area; or
49          (h) any other designation, classification, categorization, reservation, withdrawal, or
50     similar action that has the purpose or effect of eliminating, restricting, or reducing energy and
51     mineral development, motorized travel, grazing, active vegetation management, or any other
52     traditional multiple use on public land.
53          (6) "FLPMA" means the Federal Land Policy and Management Act of 1976, 43 U.S.C.
54     Sec. 1701 et seq.
55          (7) "Forest Service" means the United States Forest Service within the United States
56     Department of Agriculture.
57          (8) "Green River Energy Zone" means the lands described as follows in Subsections

58     (8)(a) and (b), as more fully illustrated in the maps prepared by the Carbon County and Emery
59     County GIS Departments in February 2013, each entitled "2013 Green River Energy Zone":
60          (a) BLM and Forest Service lands in Carbon County that are situated in the following
61     townships: Township 12S Range 6E, Township 12S Range 7E, Township 12S Range 8E,
62     Township 12S Range 9E, Township 12S Range 10E, Township 12S Range 11E, Township 12S
63     Range 12E, Township 12S Range 13E, Township 12S Range 14E, Township 12S Range 15E,
64     Township 12S Range 16E, Township 12S Range 17E, Township 12S Range 18E, Township
65     13S Range 6E, Township 13S Range 8E, Township 13S Range 9E, Township 13S Range 10E,
66     Township 13S Range 11E, Township 13S Range 12E, Township 13S Range 13E, Township

111          (9) "Multiple use" means proper stewardship of the subject lands pursuant to Section
112     103(c) of FLPMA, 43 U.S.C. Sec. 1702(c).
113          (10) "National conservation area" means an area designated by Congress and managed

114     by the BLM.
115          (11) "National wild and scenic river" means a watercourse:
116          (a) identified in a BLM or Forest Service planning process; or
117          (b) designated as part of the National Wild and Scenic River System.
118          (12) "National Wild and Scenic River System" means the National Wild and Scenic
119     River System established in 16 U.S.C. Sec. 1271 et seq.
120          (13) "Office" means the Public Lands Policy Coordinating Office created in Section
121     63J-4-602.
122          (14) "OHV" means off-highway vehicle as defined in Section 41-22-2.
123          (15) "Proposed congressional land use legislation" means a draft or a working
124     document of congressional legislation prepared by a person that includes a federal land use
125     designation.
126          (16) "RARE II" means the second United States Forest Service Roadless Area Review
127     and Evaluation report of 1984.
128          (17) "R.S. 2477 right-of-way" means a right-of-way established in accordance with 43
129     U.S.C. Sec. 932 repealed by FLPMA 1976.
130          (18) "San Juan County Energy Zone" means BLM and Forest Service lands situated in
131     the following townships in San Juan County, as more fully illustrated in the map prepared by
132     the San Juan County GIS department in December 2014 entitled "San Juan County Energy
133     Zone": Township 26S Range 21E, Township 26S Range 22E, Township 26S Range 23E,
134     Township 26S Range 24E, Township 26S Range 25E, Township 26S Range 26E, Township
135     27S Range 21E, Township 27S Range 22E, Township 27S Range 23E, Township 27S Range

185          [(19)] (20) "SITLA" means the School and Institutional Trust Lands Administration as
186     created in Section 53C-1-201.
187          [(20)] (21) (a) "Subject lands" means the following non-WSA BLM lands:

456          [(23)] (24) "Wilderness area" means those BLM and Forest Service lands added to the
457     National Wilderness Preservation System by an act of Congress.
458          [(24)] (25) "Wilderness Preservation System" means the Wilderness Preservation
459     System established in 16 U.S.C. Sec. 1131 et seq.
460          [(25)] (26) "WSA" and "Wilderness Study Area" mean the BLM lands in Utah that
461     were identified as having the necessary wilderness character and were classified as wilderness
462     study areas during the BLM wilderness review conducted between 1976 and 1993 by authority
463     of 43 U.S.C. Sec. 1782 and labeled as Wilderness Study Areas within the final report of the
464     President of the United States to the United States Congress in 1993.
465          Section 2. Section 63J-8-105 is amended to read:
466          63J-8-105. Maps available for public review.
467          A printed copy of the maps referenced in Subsections 63J-8-102(8), [(20)] (18), [and]
468     (21), and (22) shall be available for inspection by the public at the offices of the Utah
469     Association of Counties.
470          Section 3. Section 63J-8-105.2 is enacted to read:
471          63J-8-105.2. San Juan County Energy Zone established -- Finding -- Management
472     and land use priorities.
473          (1) There is established the San Juan County Energy Zone in San Juan County for the
474     purpose of maximizing efficient and responsible development of energy and mineral resources.
475          (2) The land area and boundaries of the San Juan County Energy Zone are described in
476     Subsection 63J-8-102(18) and illustrated on the map described in Section 63J-8-105.
477          (3) The state finds that:

478          (a) the lands comprising the San Juan County Energy Zone contain abundant
479     world-class deposits of energy and mineral resources, including oil, natural gas, potash,
480     uranium, vanadium, limestone, copper, sand, gravel, wind, and solar; and
481          (b) the highest management priority is the responsible management, development, and
482     extraction of existing energy and mineral resources in order to provide long-term domestic
483     energy and supplies for the state and the United States.
484          (4) The state supports:
485          (a) efficient and responsible full development of all existing energy and mineral
486     resources located within the San Juan County Energy Zone, including oil, natural gas, potash,
487     uranium, vanadium, limestone, copper, sand, gravel, wind, and solar; and
488          (b) a cooperative management approach by federal agencies, the state, and local
489     governments to achieve broadly supported management plans for the full development of all
490     energy and mineral resources within the San Juan County Energy Zone.
491          (5) The state requests that the federal agencies that administer lands within the San
492     Juan County Energy Zone:
493          (a) fully cooperate and coordinate with the state and with San Juan County to develop,
494     amend, and implement land and resource management plans and to implement management
495     decisions that are consistent with the purposes, goals, and policies described in this section to
496     the maximum extent allowed under federal law;
497          (b) expedite the processing, granting, and streamlining of mineral and energy leases
498     and applications to drill, extract, and otherwise develop all existing energy and mineral
499     resources located within the San Juan County Energy Zone, including oil, natural gas, potash,
500     uranium, vanadium, copper, sand, gravel, wind, and solar resources;
501          (c) allow continued maintenance and increased development of roads, power lines,
502     pipeline infrastructure, and other utilities necessary to achieve the goals, purposes, and policies
503     described in this section;
504          (d) refrain from any planning decisions and management actions that will undermine,
505     restrict, or diminish the goals, purposes, and policies for the San Juan County Energy Zone as

506     stated in this section; and
507          (e) refrain from implementing a policy that is contrary to the goals and purposes within
508     this section.
509          (6) The state calls upon Congress to establish an intergovernmental standing
510     commission, with membership consisting of representatives from the United States
511     government, the state, and local governments, to guide and control planning and management
512     actions in the San Juan County Energy Zone in order to achieve and maintain the goals,
513     purposes, and policies described in this section.
514          (7) Notwithstanding the provisions of this section, the state's grazing and livestock
515     policies and plans on land within the San Juan County Energy Zone shall continue to be
516     governed by Sections 63J-4-401 and 63J-8-104.
517          Section 4. Section 63J-8-105.5 is amended to read:
518          63J-8-105.5. Uintah Basin Energy Zone established -- Findings -- Management
519     and land use priorities.
520          (1) There is established the Uintah Basin Energy Zone in Daggett, Uintah, and
521     Duchesne Counties for the purpose of maximizing efficient and responsible development of
522     energy and mineral resources.
523          (2) The land area and boundaries of the Uintah Basin Energy Zone are described in
524     Subsection 63J-8-102[(21)](22) and illustrated on the map described in Section 63J-8-105.
525          (3) The state finds that:
526          (a) the lands comprising the Uintah Basin Energy Zone contain abundant, world-class
527     deposits of energy and mineral resources, including oil, natural gas, oil shale, oil sands,
528     gilsonite, coal, phosphate, gold, uranium, and copper, as well as areas with high wind and solar
529     energy potential; and
530          (b) the highest management priority for all lands within the Uintah Basin Energy Zone
531     is responsible management and development of existing energy and mineral resources in order
532     to provide long-term domestic energy and supplies for Utah and the United States.
533          (4) The state supports:

534          (a) efficient and responsible full development of all existing energy and mineral
535     resources located within the Uintah Basin Energy Zone, including oil, oil shale, natural gas, oil
536     sands, gilsonite, phosphate, gold, uranium, copper, solar, and wind resources; and
537          (b) a cooperative management approach among federal agencies, state, and local
538     governments to achieve broadly supported management plans for the full development of all
539     energy and mineral resources within the Uintah Basin Energy Zone.
540          (5) The state calls upon the federal agencies who administer lands within the Uintah
541     Basin Energy Zone to:
542          (a) fully cooperate and coordinate with the state and with Daggett, Uintah, and
543     Duchesne Counties to develop, amend, and implement land and resource management plans

564     by Sections 63J-4-401 and 63J-8-104.
565          Section 5. Effective date.
566          If approved by two-thirds of all the members elected to each house, this bill takes effect
567     upon approval by the governor, or the day following the constitutional time limit of Utah
568     Constitution, Article VII, Section 8, without the governor's signature, or in the case of a veto,
569     the date of veto override.
