7     LONG TITLE
8     General Description:
9          This bill modifies provisions related to suicide prevention training for behavioral health
10     professionals.
11     Highlighted Provisions:
12          This bill:
13          ▸     requires an individual to complete a course in suicide prevention in order to obtain
14     or renew a license in a behavioral health profession.

29     Be it enacted by the Legislature of the state of Utah:
30          Section 1. Section 58-40-302 is amended to read:
31          58-40-302. Qualifications for licensure.
32          (1) An applicant for licensure under this chapter shall:
33          (a) submit an application in a form prescribed by the division;
34          (b) pay a fee determined by the department under Section 63J-1-504; and
35          (c) be of good moral character.
36          (2) In addition to the requirements of Subsection (1), an applicant for licensure as a
37     master therapeutic recreation specialist under this chapter shall as defined by division rule:
38          (a) complete an approved graduate degree;
39          (b) complete 4,000 qualifying hours of paid experience as:
40          (i) a licensed therapeutic recreation specialist if completed in the state; or
41          (ii) a certified therapeutic recreation specialist certified by the National Council for
42     Therapeutic Recreation Certification if completed outside of the state; and
43          (c) pass an approved examination.
44          (3) In addition to the requirements of Subsection (1), an applicant for licensure as a
45     therapeutic recreation specialist under this chapter shall, as defined by division rule:
46          (a) complete an approved:
47          (i) bachelor's degree in therapeutic recreation or recreational therapy;
48          (ii) bachelor's degree with an approved emphasis, option, or concentration in
49     therapeutic recreation or recreational therapy; or
50          (iii) graduate degree;
51          (b) complete an approved practicum; and
52          (c) pass an approved examination.
53          (4) In addition to the requirements of Subsection (1), an applicant for licensure as a
54     therapeutic recreation technician under this chapter shall, as defined by division rule:
55          (a) have a high school diploma or GED equivalent;
56          (b) complete an approved:
57          (i) educational course in therapeutic recreation taught by a licensed master therapeutic
58     recreation specialist; or

59          (ii) six semester hours or nine quarter hours in therapeutic recreation or recreational
60     therapy from an accredited college or university;
61          (c) complete an approved practicum under the supervision of:
62          (i) a licensed master therapeutic recreation specialist; or
63          (ii) an on-site, full-time, employed therapeutic recreation specialist; [and]
64          (d) pass an approved examination[.]; and
65          (e) complete a minimum of two hours of training in suicide prevention via a course that
66     the division designates as approved.
67          Section 2. Section 58-40-304 is amended to read:
68          58-40-304. Continuing education.
69          (1) In collaboration with the board, the division shall make rules to provide that as a
70     condition precedent for license renewal, a licensee shall complete continuing education
71     requirements during each license period.
72          (2) In addition to a continuing education requirement provided by the division under
73     Subsection (1), the division shall require a licensee, as a condition of renewal of the licensee's
74     license, to complete a minimum of two hours of training in suicide prevention via a course that
75     the division designates as approved.
76          Section 3. Section 58-60-105 is amended to read:
77          58-60-105. Continuing education.
78          (1) By rule made under Section 58-1-203, the division may establish a continuing
79     education requirement as a condition for renewal of any license classification under this
80     chapter upon finding continuing education for that profession is necessary to reasonably protect
81     the public health, safety, or welfare.
82          (2) If a renewal cycle is extended or shortened under Section 58-60-104, the continuing
83     education hours required for license renewal under this section shall be increased or decreased
84     proportionally.
85          (3) The division shall, in addition to a continuing education requirement the division
86     establishes under Subsection (1), require an individual licensed under this chapter, as a
87     condition of renewing the individual's license, to complete a minimum of two hours of training
88     in suicide prevention via a course that the division designates as approved.
89          Section 4. Section 58-60-205 is amended to read:

90          58-60-205. Qualifications for licensure or certification as a clinical social worker,
91     certified social worker, and social service worker.
92          (1) An applicant for licensure as a clinical social worker shall:
93          (a) submit an application on a form provided by the division;
94          (b) pay a fee determined by the department under Section 63J-1-504;
95          (c) be of good moral character;
96          (d) produce certified transcripts from an accredited institution of higher education
97     recognized by the division in collaboration with the board verifying satisfactory completion of
98     an education and earned degree as follows:
99          (i) an earned master's degree in social work resulting from completion of an education
100     program accredited by the Council on Social Work Education; or
101          (ii) an earned doctoral degree in social work that results from successful completion of
102     a clinical concentration and practicum approved by the division and defined by rule under
103     Section 58-1-203;
104          (e) have completed a minimum of 4,000 hours of clinical social work training as
105     defined by division rule under Section 58-1-203:
106          (i) in not less than two years [and];
107          (ii) under the supervision of a clinical social worker supervisor approved by the
108     division in collaboration with the board; and
109          (iii) including a minimum of two hours of training in suicide prevention via a course
110     that the division designates as approved;
111          (f) document successful completion of not less than 1,000 hours of supervised training
112     in mental health therapy obtained after completion of the education requirement in Subsection
113     (1)(d), which training may be included as part of the 4,000 hours of training in Subsection
114     (1)(e), and of which documented evidence demonstrates not less than 100 of the hours were
115     obtained under the direct supervision of a clinical social worker, as defined by rule;
116          (g) have completed a case work, group work, or family treatment course sequence with
117     a clinical practicum in content as defined by rule under Section 58-1-203; and
118          (h) pass the examination requirement established by rule under Section 58-1-203.
119          (2) An applicant for licensure as a certified social worker shall:
120          (a) submit an application on a form provided by the division;

121          (b) pay a fee determined by the department under Section 63J-1-504;
122          (c) be of good moral character;
123          (d) produce certified transcripts from an accredited institution of higher education
124     recognized by the division in collaboration with the Social Worker Licensing Board verifying
125     satisfactory completion of an education and an earned degree as follows:
126          (i) a social work education program accredited by the Council on Social Work
127     Education and an earned master's degree resulting from completion of that program; or
128          (ii) an education program that contains approved clinical social work concentration and
129     practicum in content as defined by rule under Section 58-1-203 and an earned doctorate
130     resulting from completion of that program; and
131          (e) pass the examination requirement established by rule under Section 58-1-203.
132          (3) (a) An applicant for certification as a certified social worker intern shall meet the
133     requirements of Subsections (2)(a), (b), (c), and (d).
134          (b) Certification under Subsection (3)(a) is limited to the time necessary to pass the
135     examination required under Subsection (2)(e) or six months, whichever occurs first.
136          (c) A certified social worker intern may provide mental health therapy under the
137     general supervision of a clinical social worker.
138          (4) An applicant for licensure as a social service worker shall:
139          (a) submit an application on a form provided by the division;
140          (b) pay a fee determined by the department under Section 63J-1-504;
141          (c) be of good moral character;
142          (d) produce certified transcripts from an accredited institution of higher education
143     recognized by the division in collaboration with the Social Worker Licensing Board verifying
144     satisfactory completion of an earned degree resulting from education as follows:
145          (i) a bachelor's degree in a social work program accredited by the Council on Social
146     Work Education;
147          (ii) a master's degree in a field approved by the division in collaboration with the social
148     worker board;
149          (iii) a bachelor's degree in any field if the applicant:
150          (A) has completed at least three semester hours, or the equivalent, in each of the
151     following areas:

152          (I) social welfare policy;
153          (II) human growth and development; and
154          (III) social work practice methods, as defined by rule; and
155          (B) provides documentation that the applicant has completed at least 2,000 hours of
156     qualifying experience under the supervision of a mental health therapist, which experience is
157     approved by the division in collaboration with the Social Worker Licensing Board, and which
158     is performed after completion of the requirements to obtain the bachelor's degree required
159     under this Subsection (4); or
160          (iv) successful completion of the first academic year of a Council on Social Work
161     Education approved master's of social work curriculum and practicum; and
162          (e) pass the examination requirement established by rule under Section 58-1-203.
163          (5) The division shall ensure that the rules for an examination described under
164     Subsections (1)(h), (2)(e), and (4)(e) allow additional time to complete the examination if
165     requested by an applicant who is:
166          (a) a foreign born legal resident of the United States for whom English is a second
167     language; or
168          (b) an enrolled member of a federally recognized Native American tribe.
169          Section 5. Section 58-60-305 is amended to read:
170          58-60-305. Qualifications for licensure.
171          (1) All applicants for licensure as marriage and family therapists shall:
172          (a) submit an application on a form provided by the division;
173          (b) pay a fee determined by the department under Section 63J-1-504;
174          (c) be of good moral character;
175          (d) produce certified transcripts evidencing completion of a masters or doctorate degree
176     in marriage and family therapy from:
177          (i) a program accredited by the Commission on Accreditation for Marriage and Family
178     Therapy Education; or
179          (ii) an accredited institution meeting criteria for approval established by rule under
180     Section 58-1-203;
181          (e) have completed a minimum of 4,000 hours of marriage and family therapy training
182     as defined by division rule under Section 58-1-203[,]:

183          (i) in not less than two years[,];
184          (ii) under the supervision of a marriage and family therapist supervisor who meets the
185     requirements of Section 58-60-307[, and];
186          (iii) obtained after completion of the education requirement in Subsection (1)(d); and
187          (iv) including a minimum of two hours of training in suicide prevention via a course
188     that the division designates as approved;
189          (f) document successful completion of not less than 1,000 hours of supervised training
190     in mental health therapy obtained after completion of the education requirement described in
191     Subsection (1)(d)(i) or (1)(d)(ii), which training may be included as part of the 4,000 hours of
192     training described in Subsection (1)(e), and of which documented evidence demonstrates not
193     less than 100 of the supervised hours were obtained during direct, personal supervision by a
194     marriage and family therapist supervisor qualified under Section 58-60-307, as defined by rule;
195     and
196          (g) pass the examination requirement established by division rule under Section
197     58-1-203.
198          (2) (a) All applicants for licensure as an associate marriage and family therapist shall
199     comply with the provisions of Subsections (1)(a), (b), (c), and (d).
200          (b) An individual's license as an associate marriage and family therapist is limited to
201     the period of time necessary to complete clinical training as described in Subsections (1)(e) and
202     (f) and extends not more than one year from the date the minimum requirement for training is
203     completed, unless the individual presents satisfactory evidence to the division and the
204     appropriate board that the individual is making reasonable progress toward passing of the
205     qualifying examination for that profession or is otherwise on a course reasonably expected to
206     lead to licensure, but the period of time under this Subsection (2)(b) may not exceed two years
207     past the date the minimum supervised clinical training requirement has been completed.
208          Section 6. Section 58-60-405 is amended to read:
209          58-60-405. Qualifications for licensure.
210          (1) An applicant for licensure as a clinical mental health counselor shall:
211          (a) submit an application on a form provided by the division;
212          (b) pay a fee determined by the department under Section 63J-1-504;
213          (c) be of good moral character;

214          (d) produce certified transcripts from an accredited institution of higher education
215     recognized by the division in collaboration with the board verifying satisfactory completion of:
216          (i) an education and degree in an education program in counseling with a core
217     curriculum defined by division rule under Section 58-1-203 preparing one to competently
218     engage in mental health therapy; and
219          (ii) an earned doctoral or master's degree resulting from that education program;
220          (e) have completed a minimum of 4,000 hours of clinical mental health counselor
221     training as defined by division rule under Section 58-1-203[,]:
222          (i) in not less than two years[,];
223          (ii) under the supervision of a clinical mental health counselor, psychiatrist,
224     psychologist, clinical social worker, registered psychiatric mental health nurse specialist, or
225     marriage and family therapist supervisor approved by the division in collaboration with the
226     board[, and];
227          (iii) obtained after completion of the education requirement in Subsection (1)(d); and
228          (iv) including a minimum of two hours of training in suicide prevention via a course
229     that the division designates as approved;
230          (f) document successful completion of not less than 1,000 hours of supervised training
231     in mental health therapy obtained after completion of the education requirement in Subsection
232     (1)(d), which training may be included as part of the 4,000 hours of training in Subsection
233     (1)(e), and of which documented evidence demonstrates not less than 100 of the hours were
234     obtained under the direct supervision of a mental health therapist, as defined by rule; and
235          (g) pass the examination requirement established by division rule under Section
236     58-1-203.
237          (2) (a) An applicant for licensure as an associate clinical mental health counselor shall
238     comply with the provisions of Subsections (1)(a), (b), (c), and (d).
239          (b) Except as provided under Subsection (2)(c), an individual's licensure as an
240     associate clinical mental health counselor is limited to the period of time necessary to complete
241     clinical training as described in Subsections (1)(e) and (f) and extends not more than one year
242     from the date the minimum requirement for training is completed.
243          (c) The time period under Subsection (2)(b) may be extended to a maximum of two
244     years past the date the minimum supervised clinical training requirement has been completed,

245     if the applicant presents satisfactory evidence to the division and the appropriate board that the
246     individual is:
247          (i) making reasonable progress toward passing of the qualifying examination for that
248     profession; or
249          (ii) otherwise on a course reasonably expected to lead to licensure.
250          Section 7. Section 58-60-506 is amended to read:
251          58-60-506. Qualifications for licensure.
252          (1) An applicant for licensure under this part on and after July 1, 2012, must meet the
253     following qualifications:
254          (a) submit an application in a form prescribed by the division;
255          (b) pay a fee determined by the department under Section 63J-1-504;
256          (c) be of good moral character;
257          (d) satisfy the requirements of Subsection (2), (3), (4), (5), (6), or (7) respectively; and
258          (e) except for licensure as a certified substance use disorder counselor intern and a
259     certified advanced substance use disorder counselor intern, satisfy the examination requirement
260     established by division rule under Section 58-1-203.
261          (2) In accordance with division rules, an applicant for licensure as an advanced
262     substance use disorder counselor shall produce:
263          (a) certified transcripts from an accredited institution of higher education that:
264          (i) meet division standards;
265          (ii) verify the satisfactory completion of a baccalaureate or graduate degree; and
266          (iii) verify the completion of prerequisite courses established by division rules;
267          (b) documentation of the applicant's completion of a substance use disorder education
268     program that includes:
269          (i) at least 300 hours of substance use disorder related education, of which 200 hours
270     may have been obtained while qualifying for a substance use disorder counselor license; and
271          (ii) a supervised practicum of at least 350 hours, of which 200 hours may have been
272     obtained while qualifying for a substance use disorder counselor license; and
273          (c) documentation of the applicant's completion of at least 4,000 hours of supervised
274     experience in substance use disorder treatment, of which 2,000 hours may have been obtained
275     while qualifying for a substance use disorder counselor license, that:

276          (i) meets division standards; and
277          (ii) is performed within a four-year period after the applicant's completion of the
278     substance use disorder education program described in Subsection (2)(b), unless, as determined
279     by the division after consultation with the board, the time for performance is extended due to
280     an extenuating circumstance.
281          (3) An applicant for licensure as a certified advanced substance use disorder counselor
282     shall meet the requirements in Subsections (2)(a) and (b).
283          (4) (a) An applicant for licensure as a certified advanced substance use disorder
284     counselor intern shall meet the requirements in Subsections (2)(a) and (b).
285          (b) A certified advanced substance use disorder counselor intern license expires at the
286     earlier of:
287          (i) the licensee passing the examination required for licensure as a certified advanced
288     substance use disorder counselor; or
289          (ii) six months after the certified advanced substance use disorder counselor intern
290     license is issued.
291          (5) In accordance with division rules, an applicant for licensure as a substance use
292     disorder counselor shall produce:
293          (a) certified transcripts from an accredited institution that:
294          (i) meet division standards;
295          (ii) verify satisfactory completion of an associate's degree or equivalent as defined by
296     the division in rule; and
297          (iii) verify the completion of prerequisite courses established by division rules;
298          (b) documentation of the applicant's completion of a substance use disorder education
299     program that includes:
300          (i) completion of at least 200 hours of substance use disorder related education; [and]
301          (ii) included in the 200 hours described in Subsection (5)(b)(i), a minimum of two
302     hours of training in suicide prevention via a course that the division designates as approved;
303     and
304          [(ii)] (iii) completion of a supervised practicum of at least 200 hours; and
305          (c) documentation of the applicant's completion of at least 2,000 hours of supervised
306     experience in substance use disorder treatment that:

307          (i) meets division standards; and
308          (ii) is performed within a two-year period after the applicant's completion of the
309     substance use disorder education program described in Subsection (5)(b), unless, as determined
310     by the division after consultation with the board, the time for performance is extended due to
311     an extenuating circumstance.
312          (6) An applicant for licensure as a certified substance use disorder counselor shall meet
313     the requirements of Subsections (5)(a) and (b).
314          (7) (a) An applicant for licensure as a certified substance use disorder counselor intern
315     shall meet the requirements of Subsections (5)(a) and (b).
316          (b) A certified substance use disorder counselor intern license expires at the earlier of:
317          (i) the licensee passing the examination required for licensure as a certified substance
318     use disorder counselor; or
319          (ii) six months after the certified substance use disorder counselor intern license is
320     issued.
