7     LONG TITLE
8     General Description:
9          This bill enacts provisions related to longitudinal data.
10     Highlighted Provisions:
11          This bill:
12          ▸     establishes the State Longitudinal Data Center within the Division of Enterprise
13     Technology in the Department of Technology Services;
14          ▸     describes the duties of the Division of Enterprise Technology regarding the State
15     Longitudinal Data Center;
16          ▸     establishes the position of state longitudinal data coordinator within the Governor's
17     Office of Management and Budget;
18          ▸     describes the authority and the duties of the Longitudinal Data Coordinator; and
19          ▸     provides standards and procedures for the collection, maintenance, and utilization of
20     longitudinal data.

34     Be it enacted by the Legislature of the state of Utah:
35          Section 1. Section 63F-1-405 is enacted to read:
36          63F-1-405. State Longitudinal Data Center -- Management -- Data standards and
37     procedures.
38          (1) As used in this section:
39          (a) "Coordinator" means the state longitudinal data coordinator appointed under
40     Section 63J-4-703.
41          (b) "Data" means any information about a person stored in a physical or electronic
42     record.
43          (c) "De-identified data" means data that is not capable of personally identifying a
44     person.
45          (d) "Government entity" means:
46          (i) an executive branch agency;
47          (ii) an independent entity, as defined in Section 63E-1-102;
48          (iii) the State Office of Education; or
49          (iv) the State Board of Regents.
50          (e) "Legislative office" means:
51          (i) the Office of Legislative Research and General Counsel;
52          (ii) the Office of Legislative Fiscal Analyst; or
53          (iii) the Office of Legislative Auditor General.
54          (f) "Longitudinal data" means data that is connected, integrated, and de-identified.
55          (g) "Participating entity" means:
56          (i) the State Board of Education;
57          (ii) the State Board of Regents;
58          (iii) the Utah Education and Telehealth Network; and

59          (iv) the Department of Workforce Services.
60          (h) "State Longitudinal Data Center" means the data storage facility created in
61     Subsection (2).
62          (2) There is a created a collection of data stored within the division's existing state data
63     centers, known as the State Longitudinal Data Center, that contains longitudinal data derived
64     from data contributed by the participating entities.
65          (3) The division shall:
66          (a) manage, supervise, and maintain the State Longitudinal Data Center; and
67          (b) adhere to the division's standards and procedures for data collection, security, and
68     storage for the data stored in the State Longitudinal Data Center.
69          (4) Except as otherwise provided by law, the division may only release data from the
70     State Longitudinal Data Center in accordance with the procedures described in Section
71     63J-4-703.
72          (5) The State Longitudinal Data Center is not subject to Title 63G, Chapter 2,
73     Government Records Access and Management Act.
74          (6) The division may charge a participating entity an amount up to the division's cost to
75     maintain the State Longitudinal Data Center, divided equally among the participating entities.
76          Section 2. Section 63F-1-406 is enacted to read:
77          63F-1-406. Division audits of participating entity data practices.
78          (1) The division may audit, at the discretion of the division, a participating entity to
79     determine:
80          (a) the data collected by the participating entity;
81          (b) whether the data the participating entity collects is relevant to the participating
82     entity's core function; and
83          (c) the sufficiency of the participating entity's data security measures.
84          (2) The division shall annually report, before November 30, the results of an audit
85     conducted under Subsection (1), to the Public Utilities and Technology Interim Committee.
86          Section 3. Section 63J-4-701 is enacted to read:

Part 7. Longitudinal Data Coordination

88          63J-4-701. Title.
89          This part is known as "Longitudinal Data Coordination."

90          Section 4. Section 63J-4-702 is enacted to read:
91          63J-4-702. Definitions.
92          As used in this part:
93          (1) "Coordinator" means the state longitudinal data coordinator appointed under
94     Section 63J-4-703.
95          (2) "Data" means any information about a person stored in a physical or electronic
96     record.
97          (3) "De-identified data" means data that is not capable of personally identifying a
98     person.
99          (4) "Government entity" means:
100          (a) an executive branch agency;
101          (b) an independent entity, as defined in Section 63E-1-102;
102          (c) the State Office of Education; or
103          (d) the State Board of Regents.
104          (5) "Legislative office" means:
105          (a) the Office of Legislative Research and General Counsel;
106          (b) the Office of Legislative Fiscal Analyst; or
107          (c) the Office of Legislative Auditor General.
108          (6) "Longitudinal data" means data that is:
109          (a) collected from multiple sources; and
110          (b) connected, integrated, and de-identified.
111          (7) "Participating entity" means:
112          (a) the State Board of Education;
113          (b) the State Board of Regents;
114          (c) the Utah Education and Telehealth Network; and
115          (d) the Department of Workforce Services.
116          (8) "State Longitudinal Data Center" means the data storage facility created in Section
117     63F-1-405.
118          Section 5. Section 63J-4-703 is enacted to read:
119          63J-4-703. State longitudinal data coordinator.
120          (1) The executive director shall appoint a state longitudinal data coordinator to serve

121     within the office.
122          (2) The coordinator shall:
123          (a) review, in collaboration with the Department of Technology Services, the
124     management of the State Longitudinal Data Center;
125          (b) develop methods to improve the quality of the longitudinal data in the State
126     Longitudinal Data Center;
127          (c) conduct research and prepare studies and data reports utilizing the longitudinal data
128     in the State Longitudinal Data Center; and
129          (d) accept and fulfill requests from government entities and legislative offices for
130     longitudinal data stored in the State Longitudinal Data Center.
131          (3) The coordinator may employ, within appropriations made to the office by the
132     Legislature, data scientists to help accomplish the duties described in Subsection (2).
133          (4) Except as provided in Subsection (5), the coordinator shall, at a government entity's
134     or legislative office's request, provide access to information in the State Longitudinal Data
135     Center.
136          (5) Except as otherwise provided by law, a government entity or legislative office may
137     not request from the coordinator, and the coordinator may not provide to a government entity
138     or legislative office, a person's personally identifiable information.
139          Section 6. Section 63J-4-704 is enacted to read:
140          63J-4-704. Request for data by a government entity or legislative office.
141          (1) A participating entity shall, at the coordinator's request, transmit data to the State
142     Longitudinal Data Center.
143          (2) A government entity or legislative office may submit to the coordinator a request
144     for longitudinal data stored in the State Longitudinal Data Center or available from a
145     participating entity.
146          (3) Upon receiving the request described in Subsection (1), the coordinator shall:
147          (a) assign the request a unique identifying number;
148          (b) prepare or facilitate the preparation of a de-identified data report or study; and
149          (c) after the report or study described in Subsection (3)(b) is prepared:
150          (i) release the report or study to the government entity or legislative office; and
151          (ii) post the report or study on the Internet for public access.
