Vice Chair Sagers called the meeting to order at 8:10 a.m.

 

H.B. 265         Tire Fee Amendments (Rep. R. Chavez-Houck)


Rep. Chavez-Houck explained the bill to the committee with the assistance of Jacqueline Rohrer, Utah Physicians for Healthy Environment. Bryce Bird, Director, Division of Air Quality, answered questions from the committee. A packet of information was distributed to the committee.

MOTION:     Rep. Duckworth moved to amend the bill as follows:

 

1.    Page 2, Lines 48 through 50:   

 

48   (3) {  The  }  Upon appropriation, the  division may expend money in the restricted account on programs described in

49Title 19, Chapter 2, Part 2, Clean Air Retrofit, Replacement, and Off-Road Technology

 

50Program.

 

2.    Page 4, Line 115 through Page 5, Line 121: 

 

115 "(3) (a) {  The  }  Upon appropriation, the  division may expend up to 1/3 of the money, per fiscal quarter, in the

116restricted account on programs described in Title 19, Chapter 2, Part 2, Clean Air Retrofit,

MOTION:     Rep. Duckworth moved to pass the bill out favorably as amended. The motion failed with Rep. Briscoe, Rep. Duckworth, Rep. Handy, and Rep. Perry voting in favor.

 

S.B. 15            Water Law - Forfeiture Exemptions (Sen. M. Dayton)

 

Sen. Dayton explained the bill to the committee.

MOTION:     Rep. Perry moved to pass the bill out favorably. The motion passed unanimously with Rep. Briscoe absent for the vote.

 

MOTION:     Rep. Noel moved to place S.B. 15 on the Consent Calendar. The motion passed unanimously with Rep. Briscoe absent for the vote.

 

H.C.R. 8         Concurrent Resolution on Carbon Sequestration on Rangelands (Rep. M. Noel)

 

Rep. Noel explained the resolution to the committee with the assistance of Sheldon Kinsel, Rangeland Restoration Academy.

 

 

MOTION:     Rep. Hawkes moved to pass the resolution out favorably. The motion passed unanimously with Rep. McKell absent for the vote.

 

MOTION:     Rep. Noel moved to place H.C.R. 8 on the Consent Calendar. The motion passed unanimously.

 

H.B. 303         Legislative Approval of Land Transfers (Rep. K. Stratton)

 

Rep. Stratton explained the bill to the committee.

 

Spoke to the bill:         Kevin Carter, Director, School and Institutional Trust Lands                                            Administration

 

Spoke against the bill: Lynn Pace, Salt Lake City and Utah League of Cities and Towns

 

MOTION:     Rep. Brown moved to adopt 1st Sub. H.B. 303. The motion passed unanimously with Rep. Briscoe and Rep. Noel absent for the vote.

 

MOTION:     Rep. Brown moved to pass the bill out favorably.

 

SUBSTITUTE MOTION:   Rep. Powell moved to amend the bill as follows:

 

1.    Page 2, Lines 43 through 54:   

 

43   (ii) the School and Institutional Trust Lands Administration created in Section

4453C-1-201;  or 

45   (iii) the School and Institutional Trust Lands Board of Trustees created in Section

MOTION:     Rep. Powell moved to pass the bill out favorably as amended.

 

SUBSTITUTE MOTION:   Rep. Hawkes moved to hold the bill. After committee discussion the motion was withdrawn.

 

The underlying motion passed unanimously with Rep. Briscoe, Rep. McKell, and Rep. Noel absent for the vote.

 

H.J.R. 23       Joint Resolution Regarding Agritourism (Rep. L. Perry)

 

Rep. Perry explained the resolution to the committee.

 

MOTION:     Rep. Powell moved to pass the resolution out favorably. The motion passed unanimously with Rep. Briscoe, Rep. McKell, and Rep. Noel absent for the vote.

 

MOTION:     Rep. Perry moved to place H.J.R. 23 on the Consent Calendar. The motion passed unanimously with Rep. Briscoe, Rep. McKell, and Rep. Noel absent for the vote.

 

S.C.R. 2         Concurrent Resolution Regarding Navajo Water Rights Settlement (Sen. D. Hinkins)

 

Sen. Hinkins explained the resolution to the committee with the assistance of Kent Jones, State Engineer, who spoke in support of the bill. "Resolving Conflict/Securing a Future" was distributed to the committee.

 

MOTION:     Rep. Draxler moved to pass the resolution out favorably. The motion passed unanimously with Rep. Briscoe, Rep. McKell, Rep. Noel, Rep. Schultz, and Rep. Perry absent for the vote.

 

MOTION:     Rep. Draxler moved to place S.C.R. 2 on the Consent Calendar. The motion passed unanimously with Rep. Briscoe, Rep. McKell, Rep. Noel, Rep. Schultz, and Rep. Perry absent for the vote.

 

MOTION:     Rep. Duckworth moved to adjourn the meeting. The motion passed unanimously with Rep. Briscoe, Rep. McKell, Rep. Noel, Rep. Schultz, and Rep. Perry absent for the vote.
