Chair Anderson called the meeting to order at 2:04 p.m.

 

MOTION:       Rep. Liffereth moved to approve the minutes of the February 3, 2015 meeting. The motion passed unanimously with Rep. Dee and Rep. King absent for the vote.

 

H.B. 110           Motor Vehicle Emissions Amendments (Rep. P. Arent)

 

Rep. Arent explained the bill to the committee and provided a handout pertaining to H.B. 110.

 

Spoke for the bill:          Jim Ferrin, citizen, provided a handout pertaining to H.B. 110

 

Spoke to the bill:            Samuel Johnston, Office of Legislative Research and General Counsel

 

MOTION:       Rep. Moss moved to replace H.B. 110 with 1st Substitute H.B. 110. The motion passed unanimously.

 

MOTION:       Rep. Dee moved to pass 1st Substitute H.B. 110 out favorably. The motion passed unanimously.

 

 

H.B. 188           Transportation Corridor Preservation Amendments (Rep. K. Christofferson)

 

Rep. Christofferson explained the bill to the committee.

 

MOTION:       Rep. Anderegg moved to amend the bill as follows:

 

1.    Page 3, Lines 67 through 71:        

 

67   (ii) is allocated to each county, city, or town as provided in this section with the

68condition that the state will not be charged for any asset purchased with the money allocated

69under Subsections (4)(c) and (d), unless there is a written agreement in place with the

70department prior to the purchase of the asset stipulating a reimbursement by the state to the

71county, city, or town  of no more than the original purchase price paid by the county, city, or town  ; and

 

The motion passed unanimously with Rep. Dee and Rep. King absent for the vote.

 

MOTION:       Rep. Westwood moved to pass H.B. 188 out favorably as amended. The motion passed unanimously with Rep. Dee and Rep. King absent for the vote.

 

H.B. 238           License Plate Obstruction Amendments (Rep. E. Redd)

MOTION:       Rep. Cunningham moved to pass H.B. 238 out favorably. The motion passed unanimously with Rep. Dee and Rep. King absent for the vote.

 

1st Sub. H.B. 63            Distracted Driver Amendments (Rep. J. Anderegg)

 

Rep. Anderegg explained the bill to the committee.

MOTION:       Rep. Lifferth moved to amend the bill as follows:

 

 

1.    Page 2, Line 35:    

 

         (1) As used in this section, "hands-free talking and listening features":

       (a) means technology that enables the use of a wireless telephone or other electronic device without use of either hand by employing an internal feature of, or an attachment to, the device; and

       (b) includes technology that requires the use of either hand to activate, deactivate, or initiate a function of the wireless telephone or other electronic device.  

35    {  (1)  }  (2)  A person operating a motor vehicle is guilty of careless driving if the person:

39violation under Part 6, Speed Restrictions, while being {  purposefully  } distracted by one or more

The motion passed unanimously with Rep. Dee absent for the vote.

 

MOTION:       Rep. Lifferth moved to pass 1st Substitute H.B. 63 out favorably as amended.

 

SUBSTITUTE

MOTION:       Rep. Cunningham moved to hold 1st Substitute H.B. 63. The motion failed with Rep. Cox, Rep. Cunningham, Rep. King, Rep. Moss, and Rep. Westwood voting in favor of the motion. Rep. Dee was absent for the vote.

The original motion passed with Rep. Cox, Rep. Cunningham, Rep. King, Rep. Moss, and Rep. Westwood voting in opposition. Rep. Dee was absent for the vote.

 

MOTION:       Rep. Lifferth moved to adjourn. The motion passed unanimously.
