8     LONG TITLE
9     General Description:
10          This bill modifies a provision related to contractor continuing education.
11     Highlighted Provisions:
12          This bill:
13          ▸     provides that an approved contractor continuing education program may include a
14     course approved by certain entities;
15          ▸     provides that an approved contractor continuing education program may include a
16     course offered by:
17               •     a state executive branch agency;
18               •     the Workers' Compensation Fund; or
19               •     a state or nationally accredited college or university with a campus in the state;
20          ▸     provides that certain entities may offer and market, to a contractor in the electrical
21     trade, a continuing education course offered by certain electrical trade
22     organizations; and
23          ▸     provides that certain entities may market, to a contractor in the plumbing trade, a
24     continuing education course offered by certain plumbing trade organizations.

33     Be it enacted by the Legislature of the state of Utah:
34          Section 1. Section 58-55-302.5 is amended to read:
35          58-55-302.5. Continuing education requirements for contractor licensees --
36     Continuing education courses.
37          (1) Each contractor licensee under a license issued under this chapter shall complete
38     six hours of approved continuing education during each two-year renewal cycle established by
39     rule under Subsection 58-55-303(1).
40          (2) (a) The commission shall, with the concurrence of the division, establish by rule a
41     program of approved continuing education for contractor licensees.
42          (b) [Beginning] Except as provided in Subsection (2)(e), beginning on or after June 1,
43     2015, only courses offered by any of the following may be included in the program of approved
44     continuing education for contractor licensees:
45          (i) the Associated General Contractors of Utah;
46          (ii) Associated Builders and Contractors, Utah Chapter;
47          (iii) the Home Builders Association of Utah;
48          (iv) the National Electrical Contractors Association Intermountain Chapter;
49          (v) the Utah Plumbing & Heating Contractors Association;
50          (vi) the Independent Electrical Contractors of Utah;
51          (vii) the Rocky Mountain Gas Association;
52          (viii) the Utah Mechanical Contractors Association;
53          (ix) the Sheet Metal Contractors Association;
54          (x) the Intermountain Electrical Association;
55          (xi) the Builders Bid Service of Utah; or
56          (xii) Utah Roofing Contractors Association[;].

57          [(xiii) a nationally or regionally accredited college or university that has a physical
58     campus in the state; or]
59          [(xiv) an agency of the state.]
60          (c) An approved continuing education program for a contractor licensee may include a
61     course approved by an entity described in Subsections (2)(b)(i) through (2)(b)(iii).
62          [(c) Each entity listed] (d) (i) Except as provided in Subsections (2)(d)(ii) and (iii), an
63     entity listed in Subsections (2)(b)(iv) through (2)(b)(xii) may only offer and market continuing
64     education courses to a licensee who is a member of the entity.
65          (ii) An entity described in Subsection (2)(b)(iv), (vi), or (x) may offer and market a
66     continuing education course that the entity offers to satisfy the continuing education
67     requirement described in Subsection 58-55-302.7(2)(a) to a contractor in the electrical trade.
68          (iii) An entity described in Subsection (2)(b)(v), or (viii) may offer and market a
69     continuing education course that the entity offers to satisfy the continuing education
70     requirement described in Subsection 58-55-302.7(2)(b) to a contractor in the plumbing trade.
71          (e) On or after June 1, 2015, an approved continuing education program for a
72     contractor licensee may include a course offered and taught by:
73          (i) a state executive branch agency;
74          (ii) the Workers' Compensation Fund created in Section 31A-33-102; or
75          (iii) a nationally or regionally accredited college or university that has a physical
76     campus in the state.
77          (3) The division may contract with a person to establish and maintain a continuing
78     education registry to include:
79          (a) a list of courses that the division has approved for inclusion in the program of
80     approved continuing education; and
81          (b) a list of courses that:
82          (i) a contractor licensee has completed under the program of approved continuing
83     education; and
84          (ii) the licensee may access to monitor the licensee's compliance with the continuing
85     education requirement established under Subsection (1).
86          (4) The division may charge a fee, as established by the division under Section
87     63J-1-504, to administer the requirements of this section.
