7     LONG TITLE
8     General Description:
9          This bill amends provisions related to the office of county assessor.
10     Highlighted Provisions:
11          This bill:
12          ▸     authorizes a county to contract with a state-licensed or state-certified appraiser from
13     outside the county if no qualified individual files a declaration of candidacy for the
14     office of county assessor; and
15          ▸     makes technical and conforming changes.

24     Be it enacted by the Legislature of the state of Utah:
25          Section 1. Section 17-17-2 is repealed and reenacted to read:
26          17-17-2. Assessor to be state qualified -- Vacancy -- Filling vacancy.
27          (1) As used in this section:

28          (a) "State-certified appraiser" means a state-certified general appraiser or state-certified
29     residential appraiser as those terms are defined in Section 61-2g-102.
30          (b) "State-licensed appraiser" means the same as that term is defined in Section
31     61-2g-102.
32          (2) An individual elected to the office of county assessor shall:
33          (a) meet the requirements described in Section 17-16-1; and
34          (b) (i) except as provided in Subsection (2)(b)(ii), if elected on or after November 1,
35     1993, become a state-licensed or state-certified appraiser no later than 36 months after the day
36     on which the individual's term of office begins; or
37          (ii) if elected on or after January 1, 2010, in a county of the first, second, or third class,
38     be a state-licensed or state-certified appraiser before filing a declaration of candidacy for the
39     office of county assessor.
40          (3) The county assessor's office is vacant if:
41          (a) an assessor fails to meet the requirements described in Subsection (2); or
42          (b) no individual who meets the requirements described in Subsection (2) timely files a
43     declaration of candidacy for the office of county assessor.
44          (4) (a) If a vacancy described in Subsection (3) occurs, the county legislative body shall
45     fill the vacancy in accordance with Sections 17-53-104 and 20A-1-508.
46          (b) The individual who the county legislative body selects to fill the vacancy shall be a
47     state-licensed or state-certified appraiser before the individual assumes the office of county
48     assessor.
49          (5) If the county legislative body cannot find an individual who meets the requirements
50     described in Subsection (2) to fill a vacancy described in Subsection (3), the county legislative
51     body may contract with a state-licensed or state-certified appraiser from outside the county to
52     fill the remainder of the county assessor's term of office.
