7     LONG TITLE
8     General Description:
9          This bill provides for strategic workforce investments.
10     Highlighted Provisions:
11          This bill:
12          ▸     defines terms; and
13          ▸     establishes a process for investing strategically in workforce development through
14     the development of stackable credentials.
15     Money Appropriated in this Bill:
16          This bill appropriates:
17          ▸     to the Department of Administrative Services - Division of Finance Mandated -
18     Strategic Workforce Investments, as an ongoing appropriation:
19               •     from the Education Fund, $5,000,000; and
20          ▸     to the Governor's Office of Economic Development, as an ongoing appropriation:
21               •     from the General Fund, $50,000.

30     Be it enacted by the Legislature of the state of Utah:
31          Section 1. Section 53B-26-101 is enacted to read:
32     
CHAPTER 26. STRATEGIC WORKFORCE INVESTMENT

33          53B-26-101. Title.
34          This chapter is known as "Strategic Workforce Investment."
35          Section 2. Section 53B-26-102 is enacted to read:
36          53B-26-102. Definitions.
37          As used in this chapter:
38          (1) "College of applied technology" means:
39          (a) a college described in Section 53B-2a-105;
40          (b) the School of Applied Technology at Salt Lake Community College established
41     under Section 53B-16-209;
42          (c) Utah State University Eastern established under Section 53B-18-1201; or
43          (d) the Snow College Richfield campus established under Section 53B-16-205.
44          (2) "CTE" means career and technical education.
45          (3) "CTE Region" means an economic service area created in Section 35A-2-101.
46          (4) "Eligible partnership" means a partnership:
47          (a) between at least two of the following:
48          (i) a college of applied technology;
49          (ii) a school district or charter school; or
50          (iii) an institution of higher education; and
51          (b) that provides educational services within the same CTE region.
52          (5) "Employer" means a private employer, public employer, industry association, the
53     military, or a union.
54          (6) "Industry advisory group" means:
55          (a) a group of at least five employers that represent the strategic industry cluster that a
56     proposal submitted under Section 53B-26-103 is responsive to; and

57          (b) a representative of the Governor's Office of Economic Development, appointed by
58     the executive director of the Governor's Office of Economic Development.
59          (7) "Institution of higher education" means the University of Utah, Utah State
60     University, Southern Utah University, Weber State University, Snow College, Dixie State
61     University, Utah Valley University, and Salt Lake Community College.
62          (8) "Stackable sequence of credentials" means a sequence of credentials that:
63          (a) an individual can build upon to access an advanced job or higher wage;
64          (b) is part of a career pathway system;
65          (c) provides a pathway culminating in the equivalent of an associate's or bachelor's
66     degree;
67          (d) facilitates multiple exit and entry points; and
68          (e) recognizes sub-goals or momentum points.
69          Section 3. Section 53B-26-103 is enacted to read:
70          53B-26-103. GOED reporting requirement -- Proposals -- Funding.
71          (1) The Governor's Office of Economic Development shall publish, on a biannual
72     basis, a report detailing the high demand technical jobs projected to support economic growth
73     in high need strategic industry clusters, including:
74          (a) aerospace and defense;
75          (b) energy and natural resources;
76          (c) financial services;
77          (d) life sciences;
78          (e) outdoor products;
79          (f) software development and information technology; or
80          (g) any other strategic industry cluster designated by the Governor's Office of
81     Economic Development.
82          (2) To receive funding under this section, an eligible partnership shall submit a
83     proposal containing the elements described in Subsection (3) to the Legislature:
84          (a) on or before July 1, 2016, for fiscal year 2017; or
85          (b) on or before January 5 for fiscal year 2018 and any succeeding fiscal year.
86          (3) The proposal shall include:
87          (a) a program of study that:

88          (i) is responsive to the workforce needs of the CTE region in a high need strategic
89     industry cluster as identified by the Governor's Office of Economic Development under
90     Subsection (1);
91          (ii) leads to the attainment of a stackable sequence of credentials; and
92          (iii) includes a non-duplicative progression of courses that include both academic and
93     CTE content;
94          (b) expected student enrollment, attainment rates, and job placement rates;
95          (c) evidence of input and support for the proposal from an industry advisory group;
96          (d) evidence of an official action in support of the proposal from:
97          (i) the Utah College of Applied Technology Board of Trustees, if the eligible
98     partnership includes a college described in Section 53B-2a-105; or
99          (ii) the Board of Regents, if the eligible partnership includes:
100          (A) an institution of higher education; or
101          (B) a college described in Subsection 53B-26-102(1)(b), (c), or (d); and
102          (e) a funding request, including justification for the request.
103          (4) The Legislature shall:
104          (a) review a proposal submitted under this section using the following criteria:
105          (i) the proposal contains the elements described in Subsection (3);
106          (ii) support for the proposal is widespread within the CTE region; and
107          (iii) the proposal expands the capacity to meet regional workforce needs; and
108          (b) determine the extent to which to fund the proposal.
109          Section 4. Appropriation.
110          Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, for
111     the fiscal year beginning July 1, 2016, and ending June 30, 2017, the following sums of money
112     are appropriated from resources not otherwise appropriated, or reduced from amounts
113     previously appropriated, out of the funds or amounts indicated. These sums of money are in
114     addition to amounts previously appropriated for fiscal year 2017.

120          The Legislature intends that appropriations under Item 1:
121          (1) be reallocated in a future appropriations act to eligible partnerships that submit a
122     proposal that meets the criteria described in Subsection 53B-26-103(4); and
123          (2) under Section 63J-1-603, not lapse at the close of fiscal year 2017.
