7     LONG TITLE
8     General Description:
9          This bill directs the Department of Health to study the benefits and risks of pursuing
10     several federal grants and programs.
11     Highlighted Provisions:
12          This bill:
13          ▸     directs the Department of Health to study the benefits and risks of pursuing several
14     federal grants and programs related to serving individuals in home and
15     community-based settings; and
16          ▸     requires the department to report the study findings to legislative committees.
17     Money Appropriated in this Bill:

24     ENACTS:

27     Be it enacted by the Legislature of the state of Utah:
28          Section 1. Section 26-18-411 is enacted to read:
29          26-18-411. Home and community-based services.

30          The department shall:
31          (1) study the benefits and risks of:
32          (a) applying for the Money Follows the Person demonstration project, authorized under
33     the Deficit Reduction Act and extended through the Affordable Care Act;
34          (b) implementing the Community First Choice Option, under Section 1915(k) of the
35     Social Security Act, in the state Medicaid plan;
36          (c) applying for the Balancing Incentive Program, authorized by the Affordable Care
37     Act;
38          (d) modifying or expanding current Home and Community-Based Services Waivers
39     under Section 1915(c) of the Social Security Act;
40          (e) applying for new Home and Community-Based Services Waivers under Section
41     1915(c) of the Social Security Act; and
42          (f) implementing Home and Community-Based Services, under Section 1915(i) of the
43     Social Security Act, in the state Medicaid plan; and
44          (2) report the study findings to the Social Services Appropriations Subcommittee and
45     the Health and Human Services Interim Committee no later than June 1, 2016.
46          Section 2. Section 63I-2-226 is amended to read:
47          63I-2-226. Repeal dates -- Title 26.
48          (1) Title 26, Chapter 46, Utah Health Care Workforce Financial Assistance Program, is
49     repealed July 1, 2017.
50          (2) Section 26-18-411 is repealed December 31, 2016.
