10 General Description:
11 This bill establishes the kindergarten supplemental enrichment program.
12 Highlighted Provisions:
13 This bill:
14 ▸ defines terms;
15 ▸ establishes the kindergarten supplemental enrichment program;

42 Be it enacted by the Legislature of the state of Utah:
43 Section 1. Section 53A-15-2001 is enacted to read:

45 53A-15-2001. Title.
46 This part is known as "Kindergarten Supplemental Enrichment Program."
47 Section 2. Section 53A-15-2002 is enacted to read:
48 53A-15-2002. Definitions.
49 As used in this part:
50 (1) "Board" means the State Board of Education.
51 (2) "Eligible school" means a charter or school district school in which:
52 (a) at least 10% of the students experience intergenerational poverty; or
53 (b) 50% of students were eligible to receive free or reduced lunch in the previous
54 school year.
55 (3) "Intergenerational poverty" means the same as that term is defined in Section
56 35A-9-102.
57 (4) "Kindergarten supplemental enrichment program" means a program to improve the
58 academic competency of kindergarten students that:
59 (a) meets the criteria described in Section 53A-15-2003;
60 (b) receives funding from a grant program described in Section 53A-15-2003; and
61 (c) is administered by an eligible school.
62 Section 3. Section 53A-15-2003 is enacted to read:
63 53A-15-2003. Grant funding for kindergarten supplemental enrichment
64 programs.
65 (1) (a) In accordance with this section, the board shall distribute funds appropriated
66 under this section to support kindergarten supplemental enrichment programs, giving priority
67 first to awarding funds to an eligible school with at least 10% of the students experiencing
68 intergenerational poverty and second priority to an eligible school in which 50% of students
69 were eligible to receive free or reduced lunch in the previous school year.
70 (b) The board shall develop kindergarten entry and exit assessments for use by a
71 kindergarten supplemental enrichment program.
72 (2) (a) The board shall administer a qualifying grant program as described in this
73 Subsection (2) to distribute funds described in Subsection (1)(a) to an eligible school:
74 (i) that applies for a grant;
75 (ii) that offers a kindergarten supplemental enrichment program that meets the
76 requirements described in Subsection (3);
77 (iii) that has an overall need for a kindergarten supplemental enrichment program,
78 based on the results of the eligible school's kindergarten entry and exit assessments described
79 in Subsection (3)(b)(ii);
80 (iv) if the eligible school has previously established a kindergarten supplemental
81 enrichment program under this section, that shows success of the eligible school's kindergarten
82 supplemental enrichment program, based on the results of the eligible school's kindergarten
83 entry and exit assessments described in Subsection (3)(b)(ii); and
84 (v) that proposes a kindergarten supplemental enrichment program that addresses the
85 particular needs of students at risk of experiencing intergenerational poverty.
86 (b) An eligible school shall include in a grant application a letter from the principal of
87 the eligible school certifying that the eligible school's proposed kindergarten supplemental
88 enrichment program will meet the needs of either children in intergenerational poverty or
89 children who are eligible to receive free or reduced lunch as appropriate for the eligible school.
90 (3) An eligible school that receives a grant as described in Subsection (2) shall:
91 (a) use the grant money to offer a kindergarten supplemental enrichment program to:
92 (i) target kindergarten students at risk for not meeting grade 3 core standards for Utah
93 public schools, established by the board under Section 53A-1-402.6, by the end of each
94 student's grade 3 year;
95 (ii) use an evidence-based early intervention model;
96 (iii) focus on academically improving age-appropriate literacy and numeracy skills;
97 (iv) emphasize the use of live instruction;
98 (v) administer the kindergarten entry and exit assessments described in Subsection
99 (1)(c); and
100 (vi) deliver the kindergarten supplemental enrichment program through additional
101 hours or other means; and
102 (b) report to the board annually regarding:
103 (i) how the eligible school used grant money received under Subsection (2);
104 (ii) the results of the eligible school's kindergarten entry and exit assessments for the
105 prior year;
106 (iii) with assistance from board employees, the number of students served, including
107 the number of students who are eligible for free or reduced lunch; and
108 (iv) with assistance from board employees, student performance outcomes achieved by
109 the eligible school's kindergarten supplemental enrichment program, disaggregated by
110 economic and ethnic subgroups.
111 (4) An eligible school that receives a grant as described in Subsection (2) may not
112 receive funds appropriated under Section 53A-17a-167.
113 (5) A parent or legal guardian may decline participation of the parent or legal
114 guardian's kindergarten student in an eligible school's kindergarten supplemental enrichment
115 program.
116 (6) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
117 board shall make rules to establish reporting procedures and administer this section.
118 Section 4. Appropriation.
119 The following sums of money are appropriated for the fiscal year beginning July 1,
120 2017, and ending June 30, 2018. These are additions to amounts previously appropriated for
121 fiscal year 2018. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
122 Act, the Legislature appropriates the following sums of money from the funds or accounts
123 indicated for the use and support of the government of the state of Utah.

139 The Legislature intends that the Department of Workforce Services (DWS) authorize
140 Temporary Assistance for Needy Families (TANF) for three years for the Kindergarten
141 Supplemental Enrichment Program ($2,880,000 per year). This TANF funding is dependent
142 upon availability of TANF funding and expenditures meeting the necessary requirements to
143 qualify for the federal Temporary Assistance for Needy Families program. The Legislature
144 further intends that DWS report to the Office of the Legislative Fiscal Analyst no later than
145 September 1, 2017, regarding the status of these efforts.
