9          The Political Subdivisions Interim Committee recommended this bill.
10     General Description:
11          This bill modifies provisions related to the appointment of the recorder and treasurer in
12     certain municipalities.
13     Highlighted Provisions:
14          This bill:
15          ▸     modifies provisions related to the date by which the mayor of certain municipalities
16     shall appoint, with the advice and consent of the city council, a city recorder or
17     treasurer.

26     Be it enacted by the Legislature of the state of Utah:
27          Section 1. Section 10-3-916 is amended to read:

28          10-3-916. Appointment of recorder and treasurer in a city of third, fourth, or
29     fifth class or a town -- Vacancies in office.
30          (1) (a) In each city of the third, fourth, or fifth class and in each town, [on or before the
31     first Monday in February following a municipal election,] the mayor, with the advice and
32     consent of the city council, shall appoint a qualified person to [each of the offices] the office of
33     city recorder and a qualified person to the office of city treasurer.
34          (b) The mayor and city council shall use best efforts to ensure the office of city
35     recorder or office of city treasurer is not vacant.
36          (2) The city recorder is ex officio the city auditor and shall perform the duties of that
37     office.
38          (3) The mayor, with the advice and consent of the council, may also appoint and fill
39     vacancies in all offices provided for by law or ordinance.
40          (4) All appointed officers shall continue in office until their successors are appointed
41     and qualified.
