9 LONG TITLE
10 General Description:
11 This bill creates a scholarship for individuals who meet certain conditions to attend a
12 technical college.
13 Highlighted Provisions:
14 This bill:
15 ▸ defines terms;
16 ▸ creates a scholarship to fund attendance at a technical college for individuals who
17 meet certain conditions;
18 ▸ enacts provisions related to a technical college scholarship, including provisions
19 related to:
20 • eligibility for a scholarship;
21 • the amount of a scholarship; and
22 • the duration of a scholarship, including the circumstances under which a
23 technical college may cancel a scholarship or grant a deferral to a scholarship
24 recipient; and
25 ▸ requires the Utah System of Technical Colleges Board of Trustees to make rules.

34 Be it enacted by the Legislature of the state of Utah:
35 Section 1. Section 53B-2a-116 is enacted to read:
36 53B-2a-116. Technical college scholarships.
37 (1) As used in this section:
38 (a) "High demand program" means a program that:
39 (i) prepares an individual to work in a targeted job; and
40 (ii) is offered by a technical college.
41 (b) "Institution of higher education" means an institution within the Utah System of
42 Higher Education described in Subsection 53B-1-102(1)(a).
43 (c) "Membership hour" means 60 minutes of scheduled instruction provided by a
44 technical college to a student enrolled in the technical college.
45 (d) "Scholarship" means a technical college scholarship described in this section.
46 (e) "Targeted job" means the same as that term is defined in Section 53B-7-702.
47 (2) (a) Subject to future budget constraints, the Legislature shall annually appropriate
48 money to the board of trustees to be distributed to technical colleges to award scholarships.
49 (b) The board of trustees shall annually distribute:
50 (i) 50% of the appropriation described in Subsection (2)(a) to each technical college in
51 an equal amount; and
52 (ii) 50% of the appropriation described in Subsection (2)(a) to each technical college
53 based on the technical college's prior year share of secondary student membership hours
54 completed at all technical colleges.
55 (3) In accordance with the rules described in Subsection (6), a technical college may
56 award a scholarship to an individual who:
57 (a) graduates or will graduate from high school within the seven months prior to the
58 individual receiving a scholarship;
59 (b) is enrolled in, or intends to enroll in, a high demand program; and
60 (c) while the individual is enrolled in a secondary school, makes satisfactory progress
61 in a career and technical education pathway offered by:
62 (i) a technical college;
63 (ii) an institution of higher education; or
64 (iii) a school district or charter school.
65 (4) Subject to Subsection (5), a technical college may award a scholarship for an
66 amount of money up to the total cost of tuition, program fees, and required textbooks for the
67 high demand program in which the scholarship recipient is enrolled or intends to enroll.
68 (5) (a) Except as provided in Subsection (5)(b), a technical college may only apply a
69 scholarship toward a scholarship recipient's costs described in Subsection (4) from the day on
70 which the technical college awards the scholarship until seven months after the day on which
71 the scholarship recipient graduates from high school.
72 (b) (i) A technical college may defer a scholarship for up to three years after the day on
73 which the scholarship recipient graduates from high school.
74 (ii) A technical college that defers a scholarship may apply the scholarship toward the
75 scholarship recipient's costs described in Subsection (4) for up to a total of seven months.
76 (c) A technical college may cancel a scholarship if the scholarship recipient does not:
77 (i) maintain enrollment in the technical college on at least a half time basis, as
78 determined by the technical college; or
79 (ii) make satisfactory progress toward the completion of a certificate.
80 (6) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
81 board of trustees shall make rules that establish:
82 (a) requirements related to a technical college's administration of a scholarship
83 described in this section;
84 (b) requirements related to eligibility for a scholarship, including requiring technical
85 colleges to prioritize scholarships for underserved populations;
86 (c) a process for an individual to apply to a technical college to receive a scholarship;
87 and
88 (d) how to determine satisfactory progress for purposes described in Subsections (3)(c)
89 and (5)(c)(ii).
