8     LONG TITLE
9     General Description:
10          This joint resolution of the Legislature proposes to amend the Utah Constitution to
11     modify a provision relating to the State Board of Education.
12     Highlighted Provisions:
13          This resolution proposes to amend the Utah Constitution to:
14          ▸     specify that the State Board of Education consists of nine members appointed by the
15     Governor with the consent of the Senate;
16          ▸     repeal language relating to board membership; and
17          ▸     provide for the terms of board members and limit the number of terms.
18     Special Clauses:
19          This resolution directs the lieutenant governor to submit this proposal to voters.
20          This resolution provides a contingent effective date of January 1, 2021 for this proposal.

25     Be it resolved by the Legislature of the state of Utah, two-thirds of all members elected to each

26     of the two houses voting in favor thereof:
27          Section 1. It is proposed to amend Utah Constitution, Article X, Section 3, to read:
28          Article X, Section 3. [State Board of Education.]
29          (1) (a) The general control and supervision of the public education system shall be
30     vested in a State Board of Education consisting of nine members, appointed by the Governor
31     with the consent of the Senate. [The membership of the board shall be established and elected
32     as provided by statute.]
33          (b) The term of a board member is six years, and no member may serve more than two
34     full terms.
35          (2) The State Board of Education shall appoint a State Superintendent of Public
36     Instruction who shall be the executive officer of the board.
37          Section 2. Submittal to voters.
38          The lieutenant governor is directed to submit this proposed amendment to the voters of
39     the state at the next regular general election in the manner provided by law.
40          Section 3. Contingent effective date.
41          If the amendment proposed by this joint resolution is approved by a majority of those
42     voting on it at the next regular general election, the amendment shall take effect on January 1,
43     2021.
