8     LONG TITLE
9     General Description:
10          This joint resolution encourages local boards of health to enact regulations to limit the
11     number of tobacco retail permits the local health department may issue.
12     Highlighted Provisions:
13          This resolution:
14          ▸     highlights the adverse health effects of electronic cigarette use in youth; and
15          ▸     encourages local boards of health to enact regulations that limit the number of
16     tobacco retail permits the local health department may issue.

20     Be it resolved by the Legislature of the state of Utah:
21          WHEREAS, in 2018, the Surgeon General of the United States issued an advisory on
22     electronic cigarette use among youth, calling the rise in youth electronic cigarette use an
23     epidemic;
24          WHEREAS, in addition to nicotine exposure, the aerosol and flavoring that electronic
25     cigarette users inhale can expose them to other harmful substances, including heavy metals,
26     volatile organic compounds, and ultrafine particles;
27          WHEREAS, nicotine exposure during adolescence can harm the developing brain and

28     impact memory, learning, and attention;
29          WHEREAS, approximately two-thirds of 15-24 year-olds surveyed did not know that
30     electronic cigarettes contained nicotine;
31          WHEREAS, the use of electronic cigarettes among Utah high school students increased
32     from 5.8% in 2013 to 11.1% in 2017;
33          WHEREAS, in 2017, 32.1% of high school seniors had tried an electronic cigarette;
34          WHEREAS, there is substantial evidence that youth who use electronic cigarettes are
35     four times more likely to become traditional cigarette users;
36          WHEREAS, in 2017, nearly 10% of Utah students reported that they bought electronic
37     cigarette products in vape shops and an additional 8.6% bought electronic cigarette products in
38     other stores, tobacco specialty shops, or on the Internet;
39          WHEREAS, higher densities of tobacco retailer stores increase the likelihood of a
40     minor's ability to access electronic cigarettes and other nicotine and tobacco products; and
41          WHEREAS, in 2019, Summit County enacted an ordinance to limit the total number of
42     tobacco retail permits issued by the local health department to a level that is appropriate and
43     meaningful for its jurisdiction:
44          NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah
45     encourages local boards of health to enact regulations to limit the number of tobacco retail
46     permits local health departments may issue.
