7     LONG TITLE
8     General Description:
9          This resolution amends the Legislature's Joint Rules governing legislation that increases
10     legislative workload.
11     Highlighted Provisions:
12          This resolution:
13          ▸     modifies existing provisions governing reporting of legislation affecting legislative
14     workload; and
15          ▸     requires the Office of Legislative Research and General Counsel to report
16     legislation that increases legislative workload to the president of the Senate, speaker
17     of the House of Representatives, minority leaders, and Senate and House Rules
18     Committee chairs.

25     Be it resolved by the Legislature of the state of Utah:
26          Section 1. JR4-3-110 is amended to read:
27          JR4-3-110. Legislation increasing legislative workload.
28          (1) (a) As used in this section, "increases legislative workload" means to propose a
29     statute, resolution, or rule that:

30          (i) [place] places a member of the Legislature on a board, commission, task force, or
31     other public body; [or]
32          (ii) [give] gives authority to a member of the Legislative Management Committee to
33     appoint a member of a board, commission, task force, or other public body; or
34          (iii) requires a legislative staff office to staff a board, commission, task force, or other
35     public body.
36          (b) "Increases legislative workload" includes reauthorizing an existing provision
37     described in Subsection (1)(a).
38          (2) (a) The [Legislative Management Committee shall review] Office of Legislative
39     Research and General Counsel shall:
40          (i) identify legislation that increases legislative workload[: (i) in accordance with
41     Subsection (2)(b); and (ii) if practicable,] before the legislation passes both houses of the
42     Legislature; and
43          (ii) report legislation that increases legislative workload to the president of the Senate,
44     speaker of the House of Representatives, minority leaders, and the chairs of the Senate and
45     House Rules Committees.
46          (b) [When reviewing legislation that increases legislative workload, the Legislative
47     Management Committee shall consider] In making the report required by Subsection (2)(a)(ii),
48     the Office of Legislative Research and General Counsel may provide information and make
49     recommendations about:
50          (i) the funding required by the legislation;
51          (ii) the staffing resources required to implement the legislation;
52          (iii) the time legislators and legislative staff will be required to commit as a result of
53     the legislation;
54          (iv) if the legislation creates or reauthorizes a board, commission, task force, or other
55     public body, whether the responsibilities of that board, commission, task force, or other public
56     body could reasonably be accomplished through an existing entity or without legislation; and
57          (v) whether the legislation [complies with Subsection (3)] sunsets or repeals the board,

58     commission, task force, or other public body created by the legislation.
59          [(c) The Office of Legislative Research and General Counsel shall assist the
60     Legislative Management Committee in identifying:]
61          [(i) legislation that increases legislative workload; and]
62          [(ii) information described in Subsection (2)(b) related to legislation that increases
63     legislative workload.]
64          [(3) Legislation that increases legislative workload shall include a sunset or repeal date
65     on the provision that creates the board, commission, task force, or other body that is related to
66     the increase.]
