7 LONG TITLE
8 General Description:
9 This bill amends provisions related to driver license testing for an individual who is a
10 covered humanitarian parolee.
11 Highlighted Provisions:
12 This bill:
13 ▸ amends provisions related to testing to obtain a driver license to allow a covered
14 humanitarian parolee the same testing procedures provided to refugees and
15 approved asylees; and
16 ▸ makes technical changes.
17 Money Appropriated in this Bill:

19 Other Special Clauses:
20 This bill provides a special effective date.

25 Be it enacted by the Legislature of the state of Utah:
26 Section 1. Section 53-3-206 is amended to read:
27 53-3-206. Examination of applicant's physical and mental fitness to drive a motor
28 vehicle.
29 (1) The division shall examine every applicant for a license, including a test of the
30 applicant's:
31 (a) eyesight either:
32 (i) by the division; or
33 (ii) by allowing the applicant to furnish to the division a statement from a physician
34 licensed under Title 58, Chapter 67, Utah Medical Practice Act, or an optometrist licensed
35 under Title 58, Chapter 16a, Utah Optometry Practice Act;
36 (b) ability to read and understand highway signs regulating, warning, and directing
37 traffic;
38 (c) ability to read and understand simple English used in highway traffic and
39 directional signs;
40 (d) knowledge of the state traffic laws;
41 (e) other physical and mental abilities the division finds necessary to determine the
42 applicant's fitness to drive a motor vehicle safely on the highways; and
43 (f) ability to exercise ordinary and responsible control driving a motor vehicle, as
44 determined by actual demonstration or other indicator.
45 (2) (a) Notwithstanding the provisions of Subsection (1) or any other provision of law,
46 the division shall allow a refugee [
47 to take an examination of the person's knowledge of the state traffic laws in the person's native
48 language:
49 (i) the first time the person applies for a limited-term license certificate; and
50 (ii) the first time the person applies for a renewal of a limited-term license certificate.
51 (b) Upon the second renewal of a refugee's [
52 humanitarian parolee's limited-term license certificate for a refugee [
53 a covered humanitarian parolee that has taken the knowledge exam in the person's native
54 language under Subsection (2)(a), the division shall re-examine the person's knowledge of the
55 state traffic laws in English.
56 (c) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the
57 division shall make rules establishing the procedures and requirements for a refugee [
58 approved asylee, or a covered humanitarian parolee to take an examination of the person's
59 knowledge of the state traffic laws in the person's native language.
60 (3) The division shall determine whether any facts exist that would bar granting a
61 license under Section 53-3-204.
62 (4) The division shall examine each applicant according to the class of license applied
63 for.
64 (5) An applicant for a CDL shall meet all additional requirements of Part 4, Uniform
65 Commercial Driver License Act, of this chapter.
66 Section 2. Effective date.
67 If approved by two-thirds of all the members elected to each house, this bill takes effect
68 upon approval by the governor, or the day following the constitutional time limit of Utah
69 Constitution, Article VII, Section 8, without the governor's signature, or in the case of a veto,
70 the date of veto override.
