9 General Description:
10 This bill creates a grant program to be administered by the State Commission on
11 Criminal and Juvenile Justice.
12 Highlighted Provisions:
13 This bill:
14 ▸ creates a grant program, to be administered by the State Commission on Criminal
15 and Juvenile Justice, to provide a co-response program where a peace officer and a
16 social worker respond jointly to an incident where mental health may be a factor.

28 Be it enacted by the Legislature of the state of Utah:
29 Section 1. Section 63M-7-218 is enacted to read:
30 63M-7-218. Mental health co-response grant program.
31 (1) As used in this section, "co-response model" means a response model that deploys a
32 peace officer and a social worker in response to an incident involving trespassing, drug use, or
33 other illegal or unsafe conduct, where:
34 (a) mental health may be a factor; and
35 (b) the assistance of a social worker, responding with a peace officer, may result in
36 better outcomes, including avoiding incarceration or reducing the possibility of future criminal
37 conduct.
38 (2) The State Commission on Criminal and Juvenile Justice shall:
39 (a) establish and administer a grant program, for law enforcement agencies within a
40 county of the first class or second class, to implement a co-response model; and
41 (b) establish requirements, including tracking and reporting requirements, for a law
42 enforcement agency that receives a grant for a co-response model.
43 Section 2. Appropriation.
44 The following sums of money are appropriated for the fiscal year beginning July 1,
45 2022, and ending June 30, 2023. These are additions to amounts previously appropriated for
46 fiscal year 2023. Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures
47 Act, the Legislature appropriates the following sums of money from the funds or accounts
48 indicated for the use and support of the government of the state of Utah.

54 The Legislature intends that:
55 (1) appropriations provided under this section be used for the mental health
56 co-response grant program described in Section 63M-7-218;
57 (2) no more than $120,000 of the appropriation described in Subsection (1) may be
58 used for expenses to administer the grant program; and
59 (3) under Section 63J-1-603, appropriations provided under this section not lapse at the
60 close of fiscal year 2023 and the use of any nonlapsing funds is limited to the purpose
61 described in Subsections (1) and (2).
