Article VIII, Section 16. [Public prosecutors.]
The Legislature shall provide for a system of public prosecutors who shall have primary
responsibility for the prosecution of criminal actions brought in the name of the State of Utah and
shall perform such other duties as may be provided by statute. Public prosecutors shall be elected
in a manner provided by statute, and shall be admitted to practice law in Utah. If a public
prosecutor fails or refuses to prosecute, the Supreme Court shall have power to appoint a
prosecutor pro tempore.
