Chair Bramble called the meeting to order at 2:09 p.m.

 

MOTION:  Sen. Mayne moved to approve the minutes of the February 10, 2014 meeting.  The motion passed unanimously with Sen. Weiler absent for the vote.    

 

S.J.R.  13     Joint Rules Resolution Modifying Eligibility Requirements for Independent Legislative Ethics Commission Members  (J. Valentine)

 

Sen. Valentine explained the bill to the committee:

 

MOTION:  Sen. Valentine moved to pass the resolution out favorably.  The motion passed unanimously with Sen. Hinkins absent for the vote.

 

S.B.  163      Employee Meal Periods  (L. Robles)

 

MOTION:   Sen. Weiler moved to adopt 1st Sub. S.B. 163.  The motion passed unanimously.

 

MOTION:   Sen. Weiler moved to adopt the following amendments:

 

1.                  Page 3, Lines 74 through 80:    

 

74                 (ii)  a jail, prison, correctional facility, or other place of involuntary incarceration ,

75                 including a juvenile detention facility ;

76                 (d)  a classified school employee;

77                 (e)  an employee of a utility owned and operated by a political subdivision of the state;

                              (f) a juvenile justice services employee who provides direct supervision of minors in custody or in a juvenile justice services program; 

78                 or

79                 (f)  (g)   an employee covered by a collective bargaining agreement that includes meal period

80                 requirements.

 

The motion passed unanimously.

 

Sen. Robles explained the bill to the members of the committee and answered questions from the committee.

 

MOTION:  Sen. Valentine moved to proceed to the next item on the agenda.  The motion passed unanimously.

 

S.B. 162       Secondhand Sales Amendments (D. Thatcher)         

 

Sen. Thatcher explained the bill to the committee.

 

MOTION:  Sen. Valentine moved to adopt the following amendments:

 

1.                  Page 1, Line 14:


       14          that is   {valued less than $50  a retail media item, including recorded music, a movie, or a video game ,     {and that   that is paid for as specified, and that  does not contain:


 

2.              Page 2, Lines 41 through 42:


        41     (ii)  any   {item valued at less than $50 and   retail media item, including recorded music, a movie, or a video game, that is produced and distributed in hard copy format for retail sale and that is the subject of a transaction with the retail establishment that involves only a credit for future purchases and that does not involve cash, credit or debit cards, or a retail establishment gift card, and   that does not  

                         {include  contain  :

                                     42           (A)  {  a serial number or other identifying numbers   {or   ,  marks  , or any indication of ownership  ; or

The motion passed unanimously.

MOTION:   Sen. Valentine moved to pass the bill out favorably as amended.  The motion passed unanimously with Sen. Mayne voting in opposition.

 

1st Sub. H.B.  26   Association Lien Amendment   (J. Stanard)

 

Rep. Stanard explained the bill to the committee.

 

Spoke against the bill:  Keven Dwyer, Attorney, Home Owner Associations

 

MOTION:   Sen. Henderson moved to pass the bill out favorably.  The motion passed unanimously.

 

H.J.R.  5     Uniform Building Code Commission Review of Proposed Building Code Changes Joint Resolution  (J. Nielson)

                    

Rep. Nielson explained the bill to the committee.

 

Spoke for the bill:  Michael Ostermiller, American Institute of Architects, further clarified the bill

 

MOTION:  Sen. Hinkins moved to pass the bill out favorably.  The motion passed unanimously with Sen. Valentine absent for the vote.

 

H.B.  40       Beer Excise Tax Revenue Amendments (J. Draxler)

 

Rep. Draxler explained the bill to the committee.

 

Mary Lou Emerson, Director, Utah Substance Abuse Advisory Council distributed a handout and further explained the bill.

MOTION:   Sen. Henderson moved to adjourn. The motion passed with Sen. Hinkins and Sen. Valentine absent for the vote.

 

Chair Bramble adjourned the meeting at 4:00 p.m.
