Chair Davis called the meeting to order at 4:23 p.m.

 

S.B. 183          Judicial Salaries and Compensation (Sen. L. Hillyard)

 

Sen. Hillyard explained the bill to the committee.

Spoke for the bill:                   James Gilson, President, Utah State Bar

 

MOTION:  Sen. Urquhart moved to pass the bill out favorably. The motion passed unanimously.

 

Sen. Madsen resumed the chair.

 

MOTION:  Sen. Urquhart moved to approve the minutes of the February 12, 2015 meeting. The motion passed unanimously.    

 

S.B. 82         Forcible Entry Amendments (Sen. Urquhart)

 

Sen. Urquhart explained the bill to the committee.

 

MOTION:   Sen. Urquhart moved S.B. 82 be replaced with 1st Sub. S.B. 82. The motion passed unanimously with Sen. Hillyard and Sen. Weiler absent for the vote.

 

MOTION:      Sen. Urquhart moved to amend the bill as follows:

 

1.                  Page 1, Line 15:       


                                15               requires a law enforcement officer to wear   {a uniform with clear text}    a badge, label, or clothing   that identifies

S.B. 150       Driving Under the Influence Sentencing Revisions (Sen. S. Jenkins )

 

Sen. Jenkins explained the bill to the committee.

MOTION:  Sen. Davis moved to pass the bill out favorably. The motion passed unanimously

H.B. 74        Consent Definition for Sexual Offense (Rep. A. Romero)

 

Rep. Romero explained the bill to the committee.

 

MOTION:  Sen. Weiler moved to pass the bill out favorably. The motion passed unanimously with Sen. Hillyard, Sen. Thatcher, and Sen. Urquhart absent for the vote.

 

S.B. 134       Game Fowl Fighting - Amendments (Sen. G. Davis)

 

Sen. Davis explained the bill to the committee.

 

MOTION:   Sen. Davis moved to amend the bill as follows:

 

1.         Page 1, Line 12:         


               12                  provides that game fowl fighting and specified acts related to game fowl fighting are      class A misdemeanors for the first offense, and that subsequent offenses are    


 

2.         Page 6, Line 159:       


                         159         (1)  As used in this section  {, "game}    :

              (a)  "Game   fowl" means any of several breeds of fowl reared or


 

3.         Page 6, Line 160:       


                         160 used for fighting other fowl.

  (b)  "Promote" means to engage in promoting, producing, or staging events or activities that involve game fowl fighting.   


 

4.         Page 6, Line 165:       


 (c)  promote any activity that involves game fowl fighting, including promoting an activity that is a violation of Subsection (2)(b); 

                         165      {(c)}    (d)    manufacture, buy, sell, trade, or possess an instrument designed to enhance the


 

5.         Page 6, Line 168:       


                         168         {(d)}    (e)    permit or allow any act that violates Subsection (2)(a), (b),   {or}   (c)   , or (d)  on any premises


 

6.         Page 6, Line 170:       


                         170         (3)  A person who violates Subsection (2) is   upon conviction  guilty of a   :

               (a)  class A misdemeanor for the first violation; and

               (b)    third degree felony   for a second or subsequent violation  .


 

7.         Page 6, Line 175:       


                                              175        established in Title 24,   {Utah Uniform Forfeiture Procedures Act}    Forfeiture and Disposition of Property Act  .

 

The motion passed unanimously with Sen. Hillyard, Sen. Thatcher, and Sen. Urquhart absent for

the vote.

MOTION:  Sen. Escamilla moved to pass the bill out favorably. The motion passed with Sen. Madsen voting in opposition. Sen. Hillyard, Sen. Thatcher, and Sen. Urquhart were absent for the vote.

 

H.B. 83        Crimes Against Health Care Providers in Correctional System (Rep. B. Daw )

 

Rep. Daw explained the bill to the committee.

 

MOTION:   Sen. Escamilla move to amend the bill. The motion failed with Sen. Davis and Sen. Weiler voting in opposition. Sen. Hillyard, Sen. Thatcher, and Sen. Urquhart were absent for the vote.

 

MOTION:   Sen. Davis moved to adjourn. The motion passed unanimously with Sen. Hillyard, Sen. Thatcher, and Sen. Urquhart absent for the vote.
