Chair Bramble called the meeting to order at 8:07 a.m. and announced that S.B. 265 would not be heard today.

 

MOTION:  Sen. Weiler moved to approve the minutes of the February 25, 2015 meeting.  The motion passed unanimously with Sen. Davis absent for the vote.    

 

S.B.   272     Payment of Wages Amendments (K. Mayne)

 

Sen. Mayne explained the bill to the committee.

 

MOTION:   Sen Weiler moved to pass the bill out favorably.  The motion passed unanimously with Sen. Davis absent for the vote.

 

MOTION:  Sen. Mayne moved to place the bill on the Consent Calendar.  The motion passed unanimously with Sen. Davis absent for the vote.

 

Sen. Henderson assumed the Committee Chair.

 

S.B. 271       Health Benefit Plan Amendments (C. Bramble)

 

MOTION:  Sen. Bramble moved to adopt the following amendments:

 

1.      Page 1, Lines 15 through 16:

           


                                    15           provides that the prohibition may not be interpreted to require an insurer to offer a

 

 

16     particular benefit or service as part of a health benefit plan  or alter certain policies of a health          


  benefit plan  ;

 

2.    Page 3, Lines 65 through 66:

     


                                65          (6)  This section may not be interpreted to  :

                     (a)   require an insurer to offer a particular benefit

                                66   or service as part of a health benefit plan  {.}    ; or

       (b) alter the clinical policies of a health benefit plan regarding the appropriate location for         services.   

 

 

The motion passed unanimously with Sen. Davis absent for the vote.

S.B.   257     Antitrust Amendments (C. Bramble)

 

Sen. Bramble explained the bill to the committee.

 

David Sonnenreich, Division Director, Office of the Attorney General, further explained the bill.

 

MOTION:  Sen. Bramble moved to pass the bill out favorably.  The motion passed unanimously with Sen. Davis absent for the vote.

 

MOTION:  Sen. Bramble moved that the bill be placed on the Consent Calendar.  The motion passed unanimously with Sen. Davis absent for the vote.

 

S.B.   266     Professional Licensing Amendments (C. Bramble)

 

At the request of the sponsor the bill was not heard today.

Sen. Bramble resumed the Committee Chair.

 

H.B.   290    2nd Sub.     New Car Dealership Franchise Amendments (M. McKell)

 

Rep.  McKell explained the bill to the committee.

MOTION:   Sen. Davis moved to adopt the following amendment:

 

1.         Page 10, Lines 279 through 280:

           


                                    279   before taking the action, the franchisor shall, in writing, notify the advisory board,   the clerk of  each

                                    280   affected municipality, and each franchisee in that line-make in the relevant market area.

 

The paper copy of the amendment distributed to the committee, which referred to 1st Substitute HB 290, was deemed as an amendment to 2nd Substitute HB 290.

 

The motion passed unanimously.

 

MOTION:   Sen. Davis moved to pass the bill out favorably as amended.  The motion passed unanimously

 

H.B.   96   2nd Sub     Real Estate Transaction Amendments (B. Greene)

 

Rep. Greene explained the bill to the committee.

 

Sen. Weiler assumed the Committee Chair.

MOTION:   Sen. Henderson moved to pass the bill out favorably.

H.B.   299    Attorneys Lien Amendments (T. Hawkes)

 

Rep. Hawkes explained the bill to the committee.

 

John Stringham, Attorney, further clarified the bill.

 

MOTION:  Sen. Davis moved to adopt the following amendments:

 

1.     Page 3, Lines 81 through 83:

 


 (9)     {[}  An attorney's lien on real property has as

             81        its priority the date and time when a notice of lien is filed with the county recorder of the

             82        county in which real property that is subject to a lien under this section is located.  {]}
