Chair Jackson called the meeting to order at 8:40 a.m.

 

MOTION:  Sen.Van Tassell moved to approve the minutes of the March 2, 2015 meeting.  The motion passed unanimously with Sen. Hinkins absent for the vote.    

 

H.B.   63      2nd Sub.     Distracted Driver Amendments (J. Anderegg))

 

Rep. Anderegg explained the bill to the committee.

 

MOTION:   Sen. Van Tassell moved to amend the bill as follows:

 

1.      Page 3, Lines 75 through 76:  

 


                                  75        [(4)] (5)   A person convicted of a violation of this section is guilty of a:

                                 76        (a)   class C misdemeanor with a maximum fine of   {[}  $100  {]}     {$500}  ; or

 

The motion passed unanimously with Sen. Hinkins absent for the vote.

 

MOTION:   Sen. Harper moved to adopt the following amendments:

 

1.         Page 2, Lines 30 through 38: 

 


                                    30      (a)   (i)     "Handheld wireless communication device" means a handheld device used for the

                                    31      transfer of information without the use of electrical conductors or wires.

                                    32                {(b)}    (ii)    "Handheld wireless communication device" includes a:

                                    33                {(i)}    (A)    wireless telephone;

                                    34                {(ii)}    (B)    text messaging device;

                                    35                {(iii)}    (C)    laptop; or

 

 

                                    36                {(iv)}    (D)    any substantially similar communication device that is readily removable from the

                                    37      vehicle and is used to write, send, or read text or data through manual input.

                      (iii) "Handheld wireless communication device" does not include:

                     (A) an Amateur Radio or ham radio;

                     (B) a two-way communication commercial radio;

                     (C) a Citizens Band (CB) radio;

                     (D) a Family Radio Service (FRS);  or

                     (E) a General Mobile Radio Service (GMRS) radio. 

                                     38               {(c)}    (d)    "Information" means

 

 

The motion passed unanimously with Sen. Hinkins absent for the vote.

 

Spoke to the bill:  George Chapman, Citizen, requested that the bill to go to interim study.

 

MOTION:  Sen. Harper moved to pass the bill out favorably as amended.  The motion passed unanimously with Sen. Hinkins absent for the vote.

 

H.B.   269   1st Sub.     Tourist-oriented Highway Signing Program (M. Noel)

 

Sen. Van Tassell explained the bill to the committee.

H.B.   284    2nd Sub. Minor Alcohol or Drug Related Offenses and Driving Privileges (E.    

                                    Redd)

 

Rep. Redd explained the bill to the committee.

H.B.   332    Local Transportation Corridor Preservation Fund Amendments (M. Kennedy)

 

Rep. Kennedy explained the bill to the committee assisted by Andrew Jackson, Executive

Director, Mountainland Association of Governments.

MOTION:   Sen. Harper moved to pass the bill out favorably.  The motion passed unanimously.

 

MOTION:   Sen. Hinkins moved to place the bill on the Consent Calendar.  The motion passed unanimously.

 

MOTION:   Sen. Van Tassell moved to adjourn.  The motion passed unanimously.
