Vice Chair Peterson called the meeting to order at 2:08 a.m.

 

H.J.R. 8          Joint Resolution Calling for a Convention to Amend the Constitution of the United States (Rep. K. Ivory)


Rep. Ivory explained the resolution to the committee with the assistance of Mark Meckler, President, Convention of States. A Jan. 8, 2016 press release from Governor Greg Abbott, Texas, was distributed to the committee.

MOTION:     Rep. Stanard moved to pass the resolution out favorably. The motion passed with Rep. Briscoe, Rep. King, and Rep. Sagers voting in opposition and Rep. Greene absent for the vote.


 

H.B. 99           Military Retirement Income Tax Exemption (Rep. L. Perry)


Rep. Perry explained the bill to the committee with the assistance of Ruel Michael Dunn, citizen; Brian Garrett, Salt Lake Chamber Military Affairs; Harold Hardin, citizen; and Richard Schaffert, citizen. A handout, "Taxation of Military Retirement Pay," was distributed to the committee. Terry Schow, Utah Veterans Affairs, Retired, answered questions from the committee.

MOTION:     Rep. Hutchings moved to return the bill to the Rules Committee for interim study. The motion passed unanimously with Rep. McCay and Rep. Stanard absent for the vote.

 

H.B. 265         Mental Health Practitioner Amendments (Rep. S. Eliason)


Rep. Eliason explained the bill to the committee and provided two handouts, "Utah Student Association Mental Health Resolution" and "The Silent Shortage."

MOTION:     Rep. Ivory moved to replace H.B. 265 with 1st Sub. H.B. 265. The motion passed unanimously with Rep. Briscoe, Rep. Knotwell, and Rep. Stanard absent for the vote.

 

MOTION:     Rep. Ivory moved to amend 1st Sub. H.B. 265 as follows:

 

1.    Page 3, Lines 79 through 84:   

 

79   (b)  (i) an attestation that the individual was licensed on or after January 1, 2017 to provide licensed services; or

       (ii)  if the individual was licensed to provide licensed services prior to January 1, 2017,

80an attestation:

81     (A)  that the individual did not provide licensed services for the two calendar years

82before the date the individual initially applied for the income tax credit under this subsection;

83and

84    {  (ii)  }  (B)  the date on which the individual resumed providing licensed services in the state;

 

2.    Page 6, Line 163:       

 

163 This bill takes effect {  on  }  for a taxable year beginning on or after  January 1, 2017.

 

The motion to amend passed unanimously with Rep. Briscoe, Rep. Knotwell, and Rep. Stanard absent for the vote.

 

MOTION:     Rep. Ivory moved to pass 1st Sub. H.B. 265 out favorably as amended. The motion passed unanimously with Rep. Briscoe, Rep. Knotwell, and Rep. Stanard absent for the vote.

H.B. 310         Tax Credit Review Amendments (Rep. J. Peterson)

 

Rep. Peterson explained the bill to the committee.

MOTION:     Rep. Sagers moved to adjourn the meeting. The motion passed unanimously with Rep. Briscoe, Rep. Knotwell, and Rep. Stanard absent for the vote.
