Vice Chair Knotwell called the meeting to order at 4:37 p.m.


MOTION:     Rep. Anderegg moved to approve the minutes of the March 2, 2016 meeting. The motion passed unanimously with Rep. Duckworth, Rep. Owens, Rep. Roberts, Rep. Webb, and Rep. Wilson absent for the vote.

 

H.B. 453         Bail Bond Recovery Act Amendments (Rep. C. Oda)


Rep. Oda explained the bill


MOTION:     Rep. Pitcher moved to pass H.B. 453 out favorably. The motion passed unanimously with Rep. Duckworth, Rep. Roberts, Rep. Webb, and Rep. Wilson absent for the vote.

 

S.B. 178          Economic Development Revisions (Sen. C. Bramble)


Sen. Bramble explained the bill.


MOTION:     Rep. Peterson moved to pass S.B. 178 out favorably. The motion passed unanimously with Rep. Roberts, Rep. Webb, and Rep. Wilson absent for the vote.


MOTION:     Rep. Owens moved to place S.B. 178 on the Consent Calendar. The motion failed with Rep. Schultz and Rep. Stanard voting in opposition.

MOTION:     Rep. Stanard moved to amend H.B. 463 as follows:

 

1.    Page 1, Line 26 through Page 2, Line 34:     

 

26   (1) No bond is required of a personal representative appointed in formal or informal

27proceedings, except:

28   (a) upon the appointment of a special administrator without notice having been given;

29   (b) when an executor or other personal representative is appointed to administer an

30estate under a will containing an express requirement of bond;

31   (c) when  the court determines it is necessary and  an executor or other personal representative is appointed to administer an

32estate under a will and the beneficiary of the estate is a minor, unless a conservator is appointed

33under Title 75, Chapter 5, Part 4, Protection of Property of Persons Under Disability and

34Minors;

SUBSTITUTE MOTION:   Rep. Duckworth moved to pass H.B. 463 out favorably. The motion passed with Rep. Roberts, Rep. Stanard, and Rep. Knotwell voting in opposition.

 

H.B. 384         New Auto Dealer Franchise Amendments (Rep. K. Coleman)

 

Rep. Coleman distributed a handout and using a PowerPoint presentation explained the bill accompanied by Sam Johnston, Office of Legislative Research and General Counsel.

 

MOTION:     Rep. Wilson moved to return H.B. 384 to the Rules Committee for interim study. The motion passed unanimously with Rep. Anderegg absent for the vote.

 

MOTION:     Rep. Schultz moved to reconsider the previous action which resulted in S.B. 178 not being placed on the Consent Calendar and moved that it be placed on the Consent Calendar. The motion passed unanimously with Rep. Anderegg absent for the vote.

 

MOTION:     Rep. Schultz moved to reconsider the previous action which resulted in 1st Sub. S.B. 186 not being placed on the Consent Calendar and moved that it be placed on the Consent Calendar. The motion passed unanimously with Rep. Anderegg absent for the vote.

 

1st Sub. S.B. 138       Health Insurance Coverage for Emergency Care (Sen. K. Mayne)

Rep. Hemingway distributed a handout, "What is a Living Wage in Your District?" and explained the bill assisted by Barbara Munoz, Community Action Partnership of Utah, and Jean Hill, Catholic Diocese of Salt Lake City.

1st Sub. S.B. 136       Division of Occupational and Professional Licensing Amendments (Sen. E. Vickers)

 

Sen. Vickers explained the bill accompanied by Mark Steinagel, Director, Division of Occupational and Professional Licensing.

1st Sub. S.B. 156       State Facilities Amendments (Sen. W. Harper)

MOTION:     Rep. Froerer moved to amend 1st Sub. S.B. 156 as follows:

 

1.    Page 18, Lines 538 through 542:    

 

538 (7) (a) Except as provided in Subsection (7)(b) [or (c)], the Legislature may not fund

539the design or construction of any new capital development projects, except to complete the

540funding of projects for which partial funding has been previously provided, until the

541Legislature has appropriated {  [  } 1.1% {  ]  } {  1.3%  } of the replacement cost of existing state facilities and

542infrastructure to capital improvements.

 

The motion passed unanimously with Rep. Anderegg, Rep. Schultz, and Rep. Wilson absent for the vote.

 

MOTION:     Rep. Pitcher moved to pass 1st Sub. S.B. 156 out favorably. The motion passed unanimously with Rep. Anderegg and Rep. Wilson absent for the vote.

 

MOTION:     Rep. Froerer moved to place 1st Sub. S.B. 156 on the Consent Calendar. The motion passed unanimously with Rep. Anderegg and Rep. Wilson absent for the vote. Due to unknown fiscal impact the bill was returned to the Rules Committee for prioritization.

 

S.B. 185          Labor Remedy Amendments (Sen. J. Iwamoto)

109 (ii) files charges, testifies, assists, or participates in any way in a proceeding,

110investigation, or hearing under this chapter[.]; or

111  {  (iii) inquires about, discusses, or discloses the employee's wages or another employee's  }

112 {  wages.  }

 

The motion passed unanimously with Rep. Anderegg and Rep. Wilson absent for the vote.

 

MOTION:     Rep. Webb moved to pass S.B. 185 out favorably. The motion passed unanimously with Rep. Anderegg and Rep. Wilson absent for the vote.

 

MOTION:     Rep. King moved to adjourn. The motion passed unanimously with Rep. Anderegg and Rep. Wilson absent for the vote.
