1.   Committee Business

 

Chair Webb called the meeting to order at 1:30 p.m.

 

MOTION: Rep. Westwood moved to approve the minutes of the October 19, 2016, meeting. The motion passed unanimously. Sen. Mayne and Rep. Coleman were absent for the vote.

 

2.    Mobile Home Park Helpline – Required Report/Sunset Review

 

Ms. Linda Smith, professor, S.J. Quinney College of Law, University of Utah Law School, and Ms. Jessica Sanwitz, staff attorney, Mobile Home Helpline, presented the report "Mobile Home Park Helpline." They discussed representative calls that were received and possible improvements that could be made to the Mobile Home Park Residency Act. They did not recommend that the Mobile Home Park Helpline be continued due to its limited effectiveness in resolving residents' issues. They responded to questions from the committee.

 

Mr. Richard Robinson, resident, Westwood Village City, expressed gratitude to the committee for hearing the issue of the helpline.

 

MOTION: Sen. Thatcher moved to move to the next agenda item. The motion passed unanimously.

 

3.    Zoning for Substance Abuse Recovery Facilities

 

Rep. LaVar Christensen gave an update on zoning for substance abuse recovery facilities. He discussed the challenges local zoning and planning officials face when balancing local concerns with federal regulations regarding substance abuse recovery facilities. He also encouraged creating legislation to support municipalities should they challenge federal regulations. He responded to questions from the committee.

 

MOTION: Rep. Powell moved to recommended that more time be taken to develop solutions and consensus on this issue. The motion passed unanimously. Sen. Mayne and Rep. Briscoe were absent for the vote.

 

4.    Local and Special Service Districts

 

Rep. Justin L. Fawson explained draft legislation "Dissolution of Local Districts" (2017FL-821/003). He responded to questions from the committee. The committee discussed various approaches which the legislature could take to implement the concepts in the draft legislation.

 

MOTION: Sen. Thatcher moved to recommended that more time be taken to develop solutions and consensus on this issue. The motion passed unanimously. Sen. Stevenson was absent for the vote.

 

5.    Local District Budgets – Draft Legislation

 

Sen. Lincoln Fillmore explained draft legislation "Local District Revisions" (2017FL-0034/005).

 

6.    Statewide Crisis Line – Draft Legislation

 

Sen. Thatcher explained draft legislation "Statewide Crisis Line" (2017FL-0648/002). He responded to questions from the committee.

 

MOTION: Rep. Westwood moved to approve draft legislation "Statewide Crisis Line" as a committee recommended bill. The motion passed unanimously. Sen. Stevenson was absent for the vote.

 

7.    Culinary Water Improvement Districts – Draft Legislation

 

Chair Webb relinquished the chair to Sen. Thatcher. Rep. Webb discussed the progress on draft legislation regarding culinary water improvement districts.

 

8.   Historic Preservation Districts – Draft Legislation

 

Rep. Webb discussed draft legislation "Historic Preservation Amendments" (2017FL-387/014). He responded to questions from the committee.

 

Mr. Lynn Pace, Utah League of Cities and Towns, discussed his involvement with Rep. Webb in the creation of draft legislation "Historic Preservation Amendments." He offered further explanation of the draft legislation.

 

MOTION: Rep. Westwood moved to approve draft legislation "Historic Preservation Amendments" as a committee recommended bill. The motion passed with Sen. Harper voting in opposition. Sen. Stevenson and Rep. Briscoe were absent for the vote.

 

9.    Local Officer Appointments – Draft Legislation

 

Rep. Webb briefly explained draft legislation "Local Officer Amendments" (2017FL-0652/011). He responded to questions from the committee.

 

Mr. Cameron Diehl, Director of Governmental Affairs, Utah League of Cities and Towns, responded to questions from the committee regarding the draft legislation.

 

MOTION: Sen. Thatcher moved to approve draft legislation "Local Officer Amendments" as a committee recommended bill. The motion passed unanimously. Sen. Stevenson and Rep. Briscoe were absent for the vote.

 

10.    Common or Community Area Land Use – Draft Legislation

 

Rep. Webb briefly discussed draft legislation "Common or Community Area Land Use" (2017FL-0653/007).

 

Ms. Jodi Hoffmann, Utah League of Cities and Towns, expressed the league's concerns regarding draft legislation "Common or Community Area Land Use." Rep. Webb responded to her questions.

 

11.   Political Subdivisions Ethics Review Commission – Required Report

 

This item was not discussed during the meeting.

 

12.   Adjourn

 

MOTION:  Rep. Sagers moved to adjourn the meeting. The motion passed unanimously. Sen. Stevenson and Rep. Briscoe were absent for the vote.

 

Chair Webb adjourned the meeting at 2:50 p.m.
