Chair Daw called the meeting to order.

1. H.B. 370 Amendments to Tobacco Regulations (Last, B.)

Rep. Bradley G. Last presented the bill.

Ms. Lania Fletcher, Utah Health Department, spoke in favor of the bill.

Mr. Tad Jensen, Utah Smoke Free Association, spoke in opposition to the bill.

Mr. Shilo Platts, Smoke-Free Alternatives Association, spoke in favor of the bill.

Mr. Lewis Lambres, owner, Vapor Dreams, spoke in opposition to the bill.

Mr. Mark Brinton, Utah Medical Association, spoke in favor of the bill.

MOTION:     Vice Chair Kennedy moved to replace H.B. 370 with 1st Substitute H.B. 370.

The motion passed with a vote of 9-0-3.

MOTION:     Rep. Ward moved to pass 1st Substitute H.B. 370 out favorably.

The motion passed with a vote of 9-0-3.

2. H.B. 373 Substance Abuse and Mental Health Amendments (Redd, E.)

Rep. Edward H. Redd presented the bill with the assistance of Ms. Ginger Phillips, peer support specialist trainer.

Mr. John Wilkes spoke in favor of the bill.

MOTION:     Rep. Hollins moved to pass H.B. 373 out favorably.

The motion passed with a vote of 9-0-3. 

3. H.B. 400 Coverage Parity for Amino Acid-Based Formula (Redd, E.)

Rep. Edward H. Redd presented the bill with the assistance of Dr. Kathy Peterson, gastroenterologist, University of Utah.

Mr. Kelly Atkinson, Utah Health Insurance Association, spoke in opposition to the bill. Mr. Atkinson also corrected a statement he made at the committee's February 21, 2017, meeting during the discussion of H.B. 266, Pharmaceutical Step Therapy (E. Hutchings).

Mr. Preston Zundel spoke in favor of the bill.

Mr. Travis Wood, Utah Health Plans, spoke in opposition to the bill.

Ms. Tammy Zundel spoke in favor of the bill.

MOTION:     Rep. Redd moved to pass H.B. 400 out favorably.

The motion failed with a vote of 4-4-4.

4. H.B. 390 Suicide Prevention Modifications (Eliason, S.)

Rep. Steve Eliason presented the bill with the assistance of Mr. Clark Aposhian, Utah Shooting Sports Council.

Mr. Mark Brinton, Utah Medical Association, spoke in favor of the bill.

MOTION:     Rep. Miles moved to pass H.B. 390 out favorably.

The motion passed with a vote of 8-0-4.

Vice Chair Kennedy assumed the chair.

5. H.B. 374 Long-term Care Ombudsman Amendments (Daw, B.)

Rep. Brad M. Daw presented the bill with the assistance of Mr. Nels Holmgren, Division of Aging and Adult Services, Department of Human Services.

Mr. Mark Brinton, Utah Medical Association, spoke in favor of the bill.

MOTION:     Rep. Ward moved to pass H.B. 374 out favorably.

The motion passed with a vote of 8-0-4.

6. H.B. 384 Abortion Clinic Licensing Amendments (King, B. S.)

Rep. Brian S. King presented the bill with the assistance of Ms. Marina Lowe, Legislative Counsel for the Utah American Civil Liberties Union, and Dr. Leah Torres, OB/GYN.

CONFLICT OF INTEREST DISCLOSURE: Rep. King noted that he is a member of the national ACLU, he is a member of the ACLU of Utah, and he is on the board of directors for the ACLU of Utah, and that attorney fees could be awarded to a plaintiff who prevailed in a suit over the issue addressed by H.B. 384.

Chair Daw assumed the chair.

Dr. Leah Torres spoke in favor of the bill.

Mr. Rose Marie Murray, Family Policy Resource, spoke in opposition to the bill.

Ms. Deanna Holland, Pro-Life Utah, spoke in opposition to the bill.

Ms. Maryann Christensen, Executive Director, Utah Eagle Forum, spoke in opposition to the bill.

Ms. Mary Kelsch spoke in opposition to the bill.

Ms. Mary Taylor, President, Pro-Life Utah, spoke in opposition to the bill.

MOTION:     Rep. Hollins moved to pass H.B. 384 out favorably.

SUBSTITUTE MOTION:   Rep. Ward moved to amend H.B. 384 with Amendment #1.

1.    Page 2, Lines 36 through 37:   

36   (ii) may not require hospital admitting privileges

37abortion service provider, including an attending physician or a medical director.

MOTION:     Rep. Spendlove moved to adjourn.

The motion passed with a vote of 8-3-1.
