JR 7-1-401 requires
that the committee review the list of approved study items assigned to it by the
Legislative Management Committee at the committee’s first meeting. The rule
also allows the committee to modify or add an item to the study item list
provided the item is consistent with the committee’s duties. After review, the
committee will vote to adopt the study item list, including any modifications
or additions it chooses to make.

Sen. Iwamoto will
propose to toll the statute of limitations in the event of an emergency. The
committee will discuss the proposal.

JR7-1-602 allows
the committee to grant authority to the committee chairs to independently open
bill files on behalf of the committee during the first meeting of the year by
motion and majority vote. This authority can extend to opening bill files on
issues not on the committee’s study list. Chairs are required to report to the
committee when they have opened a bill file and requires the chairs to jointly
agree to open the bill file. The committee will discuss whether to grant this
authority and may take action.

The Utah Court of
Appeals and the Utah Supreme Court in writing opinions sometimes suggest to
the Legislature to take some action such as clarifying a certain provision of
the statute, addressing a circumstance not addressed in the statute, reviewing
whether the outcome of a statute was intended, or revisiting an issue. Staff
will review the 2019-20 appellate decisions that call for legislative action.
The committee will discuss how to proceed.

The committee will
receive a presentation on electronic wills and discuss whether to open a bill
file to authorize them, as recommended by the Uniform Law Commission.

receive presentations regarding the proposal of the brief provided by the
Office of the Legislative Fiscal Analyst including the commission’s core
principles: similarities and differences in indigent defense across states:
effective measures of challenges and metrics for success; and appropriate
state support for indigent defense in Utah.

Utah Code Section 63G-7-401(3)(b)(ii)
currently requires entities to accept hand delivery of governmental immunity
claims. The committee will discuss whether to recommend amending the statute
to remove hand delivery from the submission options while allowing electronic
and mail submissions.
