RULES REVIEW AND GENERAL OVERSIGHT COMMITTEE

1.    Committee Business

·         Call to order

·         Approval of the minutes of the May 22, 2025, meeting

 

2.    State Tax Commission Updates to Unrelated Business Income Classification

The committee will receive a presentation from the State Tax Commission on proposed changes to corporate tax filings regarding unrelated business income classification.

 

3.    Election Systems: Administration, Oversight, and Signature Verification

The committee will continue its review of administration and oversight in the petition and citizen initiative process. The committee’s review may include input from election officials and a progress update on suggested rulemaking to strengthen the signature gathering process and a discussion of statutory form requirements for local initiatives and referenda under Title 20A, Chapter 7, Issues Submitted to the Voters.

 

4.    Emergency Rules Oversight: Attorney General

In May 2025, the Attorney General’s Office published two notices of emergency rules for R105-5, White Collar Crime Registry and R105-6, Child Protection Registry under the provisions of Utah Code Ann. 63G-3-304. The committee will discuss, with input from stakeholders, the published rules and the circumstances that necessitated emergency rulemaking.

 

5.    Emergency Rules Oversight: Division of Risk Management

In May 2025, the Division of Risk Management published a notice of emergency rules for R37-4, Adjusted Utah Governmental Immunity Act Limitations on Judgments under the provisions of Utah Code Ann. 63G-3-304. The committee will discuss, with input from stakeholders, the published rule and the circumstances that necessitated emergency rulemaking.

 

6.    Review of Administrative Procedures Act: Mayhew v. Labor Commission

During the May interim meeting, the Judiciary Interim Committee referred legislative calls for action in Mayhew v. Labor Commission, to the Rules Review and General Oversight Committee for consideration. The committee will discuss the scope and authority of an administrative law judge to sanction parties under the Utah Administrative Procedures Act and discuss potential statutory changes.
