Windshields and windows -- Tinting -- Obstructions reducing <ln numlevel="1" lineno="21" slineno="1-3"/>visibility -- Wipers -- Prohibitions.</bold></catline><subsection ssid="1-1" dnum="1-o" numlevel="1" lineno="22" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>Except as provided in Subsections <xref depth="4" refnumber="41-6a-1635(2)" start="0">(2)</xref>, <xref depth="4" refnumber="41-6a-1635(3)" start="0">(3)</xref>, and <xref depth="4" refnumber="41-6a-1635(4)" start="0">(4)</xref> a person may not operate a motor <ln numlevel="1" lineno="23" slineno="1-5"/>vehicle with:<subsection ssid="1-2" dnum="a-o" numlevel="1" lineno="24" slineno="1-6" level="2"><display>(a)</display>a windshield that allows less than 70% light transmittance;</subsection><subsection ssid="1-3" dnum="b-o" numlevel="1" lineno="25" slineno="1-7" level="2"><display>(b)</display>a front side window that allows less than 35% light transmittance, with no more than <ln numlevel="1" lineno="26" slineno="1-8"/>a 5% variance observed by a peace officer metering the light transmittance;</subsection><subsection ssid="1-4" dnum="c-o" numlevel="1" lineno="27" slineno="1-9" level="2"><display>(c)</display>any windshield or window that is composed of, covered by, or treated with any <ln numlevel="1" lineno="28" slineno="1-10"/>material or component that presents a metallic or mirrored appearance;</subsection><subsection ssid="1-5" dnum="d-o" numlevel="1" lineno="29" slineno="1-11" level="2"><display>(d)</display>any sign, poster, or other nontransparent material on the windshield or side windows <ln numlevel="1" lineno="30" slineno="1-12"/>of the motor vehicle except:<subsection ssid="1-6" dnum="i-o" numlevel="1" lineno="31" slineno="1-13" level="3"><display>(i)</display>a certificate or other paper required to be so displayed by law; or</subsection><subsection ssid="1-7" dnum="ii-o" numlevel="1" lineno="32" slineno="1-14" level="3"><display>(ii)</display>the vehicle's identification number displayed or etched in accordance with rules <ln numlevel="1" lineno="33" slineno="1-15"/>made by the department under Section <xref depth="3" refnumber="41-6a-1601" start="0">41-6a-1601</xref>; or</subsection></subsection><subsection ssid="1-8" dnum="e-o" numlevel="1" lineno="34" slineno="1-16" level="2"><display>(e)</display>any debris, frost, or other substance that materially obstructs the operator's view.</subsection></subsection><subsection ssid="1-9" dnum="2-o" numlevel="1" lineno="35" slineno="1-17" level="1" space="false"><display>(2)</display><subsection ssid="1-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A person may not operate a motor vehicle with an object or device hanging or <ln numlevel="1" lineno="36" slineno="1-18"/>mounted in a manner that materially obstructs the operator's view.</subsection><subsection ssid="1-11" dnum="b-o" numlevel="1" lineno="37" slineno="1-19" level="2"><display>(b)</display>A person shall ensure that an object or device hanging or mounted in compliance <ln numlevel="1" lineno="38" slineno="1-20"/>with Subsection <xref depth="4" refnumber="41-6a-1635(2)(a)" start="0">(2)(a)</xref> is used in accordance with this chapter.</subsection></subsection><subsection ssid="1-12" dnum="3-o" numlevel="1" lineno="39" slineno="1-21" level="1"><display>(3)</display>Nontransparent materials may be used:<subsection ssid="1-13" dnum="a-o" numlevel="1" lineno="40" slineno="1-22" level="2"><display>(a)</display>along the top edge of the windshield if the materials do not extend downward more <ln numlevel="1" lineno="41" slineno="1-23"/>than four inches from the top edge of the windshield or beyond the AS-1 line <ln numlevel="1" lineno="42" slineno="1-24"/>whichever is lowest;</subsection><subsection ssid="1-14" dnum="b-o" numlevel="1" lineno="43" slineno="1-25" level="2"><display>(b)</display>in the lower left-hand corner of the windshield provided they do not extend more <ln numlevel="1" lineno="44" slineno="1-26"/>than three inches to the right of the left edge or more than four inches above the <ln numlevel="1" lineno="45" slineno="1-27"/>bottom edge of the windshield; or</subsection><subsection ssid="1-15" dnum="c-o" numlevel="1" lineno="46" slineno="1-28" level="2"><display>(c)</display>on the rear windows including rear side windows located behind the vehicle operator.</subsection></subsection><subsection ssid="1-16" dnum="4-o" numlevel="1" lineno="47" slineno="1-29" level="1"><display>(4)</display>A windshield or other window is considered to comply with the requirements of <ln numlevel="1" lineno="48" slineno="1-30"/>Subsection <xref depth="4" refnumber="41-6a-1635(1)" start="0">(1)</xref> if the windshield or other window meets the federal statutes and <ln numlevel="1" lineno="49" slineno="1-31"/>regulations for motor vehicle window composition, covering, light transmittance, and <ln numlevel="1" lineno="50" slineno="1-32"/>treatment.</subsection><subsection ssid="1-17" dnum="5-o" numlevel="1" lineno="51" slineno="1-33" level="1"><display>(5)</display>Except for material used on the windshield in compliance with Subsections <xref depth="4" refnumber="41-6a-1635(3)(a)" start="0">(3)(a)</xref> and <xref depth="4" refnumber="41-6a-1635(3)(b)" start="0"><ln numlevel="1" lineno="52" slineno="1-34"/>(b)</xref>, a motor vehicle with tinting or nontransparent material on any window shall be <ln numlevel="1" lineno="53" slineno="1-35"/>equipped with rear-view mirrors mounted on the left side and on the right side of the <ln numlevel="1" lineno="54" slineno="1-36"/>motor vehicle to reflect to the driver a view of the highway to the rear of the motor <ln numlevel="1" lineno="55" slineno="1-37"/>vehicle.</subsection><subsection ssid="1-18" dnum="6-o" numlevel="1" lineno="56" slineno="1-38" level="1" space="false"><display>(6)</display><subsection ssid="1-19" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="1-20" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>The windshield on a motor vehicle shall be equipped with a device for <ln numlevel="1" lineno="57" slineno="1-39"/>cleaning rain, snow, or other moisture from the windshield.</subsection><subsection ssid="1-21" dnum="ii-o" numlevel="1" lineno="58" slineno="1-40" level="3" tab="1"><display>(ii)</display>The device shall be constructed to be operated by the operator of the motor <ln numlevel="1" lineno="59" slineno="1-41"/>vehicle.</subsection></subsection><subsection ssid="1-22" dnum="b-o" numlevel="1" lineno="60" slineno="1-42" level="2"><display>(b)</display>A windshield wiper on a motor vehicle shall be maintained in good working order.</subsection></subsection><subsection ssid="1-23" dnum="7-o" numlevel="1" lineno="61" slineno="1-43" level="1"><display>(7)</display>A person may not have for sale, sell, offer for sale, install, cover, or treat a windshield <ln numlevel="1" lineno="62" slineno="1-44"/>or window in violation of this section.</subsection><subsection ssid="1-24" dnum="8-o" numlevel="1" lineno="63" slineno="1-45" level="1"><display>(8)</display>Notwithstanding this section, any person subject to the federal Motor Vehicle Safety <ln numlevel="1" lineno="64" slineno="1-46"/>Standards, including motor vehicle manufacturers, distributors, dealers, importers, and <ln numlevel="1" lineno="65" slineno="1-47"/>repair businesses, shall comply with the federal standards on motor vehicle window <ln numlevel="1" lineno="66" slineno="1-48"/>tinting.</subsection><subsection ssid="1-25" dnum="9-o" numlevel="1" lineno="67" slineno="1-49" level="1"><display>(9)</display>A violation of this section is an infraction.</subsection><subsection ssid="1-28" dnum="_-o:10-e" numlevel="1" lineno="68" slineno="1-50" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="e" level="1" amendtag="start">(10)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="admin" level="1" amendtag="end">A peace officer may not request that the Motor Vehicle Division or Driver License <ln numlevel="1" lineno="69" slineno="1-51"/>Division revoke or suspend an individual's vehicle registration or driver license for a <ln numlevel="1" lineno="70" slineno="1-52"/>violation or multiple violations of Subsection (1)(a) or (b).</amend></subsection></section></bsec><bsec buid="2" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="71" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="71">Section 2.  <bold>Effective date.</bold></secline><sectionText lineno="72"><amend anum="0" ea="amend" pairid="6" groupid="-1" style="1" owner="admin" level="1" amendtag="both">This bill takes effect on <effdate uid="bill" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>3-6-25 4:58 PM</tm></rev></foot></leg>
