Inspection of vital records.</bold></catline><subsection ssid="1-1-37" dnum="1-o" numlevel="1" lineno="35" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-1-38" dnum="a-o" numlevel="1" lineno="36" slineno="1-5" level="2"><display>(a)</display>"Designated legal representative" means an attorney, physician, funeral service <ln numlevel="1" lineno="37" slineno="1-6"/>director, genealogist, or other agent of the subject, or an immediate family member of <ln numlevel="1" lineno="38" slineno="1-7"/>the subject, who has been delegated the authority to access vital records.</subsection><subsection ssid="1-1-39" dnum="b-o" numlevel="1" lineno="39" slineno="1-8" level="2"><display>(b)</display>"Drug use intervention or suicide prevention effort" means a program that studies or <ln numlevel="1" lineno="40" slineno="1-9"/>promotes the prevention of drug overdose deaths or suicides in the state.</subsection><subsection ssid="1-1-40" dnum="c-o" numlevel="1" lineno="41" slineno="1-10" level="2"><display>(c)</display>"Immediate family member" means a spouse, child, parent, sibling, grandparent, or <ln numlevel="1" lineno="42" slineno="1-11"/>grandchild.</subsection></subsection><subsection ssid="1-1-41" dnum="2-o" numlevel="1" lineno="43" slineno="1-12" level="1" space="false"><display>(2)</display><subsection ssid="1-1-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The vital records shall be open to inspection, but only in compliance with the <ln numlevel="1" lineno="44" slineno="1-13"/>provisions of this part, department rules, and Sections <xref depth="3" refnumber="78B-6-141" start="0">78B-6-141</xref> and <xref depth="3" refnumber="78B-6-144" start="0">78B-6-144</xref>.</subsection><subsection ssid="1-1-43" dnum="b-o" numlevel="1" lineno="45" slineno="1-14" level="2"><display>(b)</display>It is unlawful for any state or local officer or employee to disclose data contained in <ln numlevel="1" lineno="46" slineno="1-15"/>vital records contrary to this part, department rule, Section <xref depth="3" refnumber="78B-6-141" start="0">78B-6-141</xref>, or Section <xref depth="3" refnumber="78B-6-144" start="0"><ln numlevel="1" lineno="47" slineno="1-16"/>78B-6-144</xref>.</subsection><subsection ssid="1-1-44" dnum="c-o" numlevel="1" lineno="48" slineno="1-17" level="2" space="false"><display>(c)</display><subsection ssid="1-1-45" dnum="i-o" level="3" placement="sameline"><display>(i)</display>An adoption document is open to inspection as provided in Section <xref depth="3" refnumber="78B-6-141" start="0">78B-6-141</xref> <ln numlevel="1" lineno="49" slineno="1-18"/>or Section <xref depth="3" refnumber="78B-6-144" start="0">78B-6-144</xref>.</subsection><subsection ssid="1-1-46" dnum="ii-o" numlevel="1" lineno="50" slineno="1-19" level="3"><display>(ii)</display>A birth parent may not access an adoption document under Subsection <xref depth="4" refnumber="78B-6-141(3)" start="0"><ln numlevel="1" lineno="51" slineno="1-20"/>78B-6-141(3)</xref>.</subsection></subsection><subsection ssid="1-1-47" dnum="d-o" numlevel="1" lineno="52" slineno="1-21" level="2"><display>(d)</display>A custodian of vital records may permit inspection of a vital record or issue a <ln numlevel="1" lineno="53" slineno="1-22"/>certified copy of a record or a part of a record when the custodian is satisfied that the <ln numlevel="1" lineno="54" slineno="1-23"/>applicant has demonstrated a direct, tangible, and legitimate interest.</subsection></subsection><subsection ssid="1-1-48" dnum="3-o" numlevel="1" lineno="55" slineno="1-24" level="1"><display>(3)</display>Except as provided in Subsection <xref depth="4" refnumber="26B-8-125(4)" start="0">(4)</xref>, a direct, tangible, and legitimate interest in a vital <ln numlevel="1" lineno="56" slineno="1-25"/>record is present only if:<subsection ssid="1-1-49" dnum="a-o" numlevel="1" lineno="57" slineno="1-26" level="2"><display>(a)</display>the request is from:<subsection ssid="1-1-50" dnum="i-o" numlevel="1" lineno="58" slineno="1-27" level="3"><display>(i)</display>the subject;</subsection><subsection ssid="1-1-51" dnum="ii-o" numlevel="1" lineno="59" slineno="1-28" level="3"><display>(ii)</display>an immediate family member of the subject;</subsection><subsection ssid="1-1-52" dnum="iii-o" numlevel="1" lineno="60" slineno="1-29" level="3"><display>(iii)</display>the guardian of the subject;</subsection><subsection ssid="1-1-53" dnum="iv-o" numlevel="1" lineno="61" slineno="1-30" level="3"><display>(iv)</display>a designated legal representative of the subject; or</subsection><subsection ssid="1-1-54" dnum="v-o" numlevel="1" lineno="62" slineno="1-31" level="3"><display>(v)</display>a person, including a child-placing agency as defined in Section <xref depth="3" refnumber="78B-6-103" start="0">78B-6-103</xref>, with <ln numlevel="1" lineno="63" slineno="1-32"/>whom a child has been placed pending finalization of an adoption of the child;</subsection></subsection><subsection ssid="1-1-55" dnum="b-o" numlevel="1" lineno="64" slineno="1-33" level="2"><display>(b)</display>the request involves a personal or property right of the subject of the record;</subsection><subsection ssid="1-1-56" dnum="c-o" numlevel="1" lineno="65" slineno="1-34" level="2"><display>(c)</display>the request is for official purposes of a public health authority or a state, local, or <ln numlevel="1" lineno="66" slineno="1-35"/>federal governmental agency;</subsection><subsection ssid="1-1-57" dnum="d-o" numlevel="1" lineno="67" slineno="1-36" level="2"><display>(d)</display>the request is for a drug use intervention or suicide prevention effort or a statistical or <ln numlevel="1" lineno="68" slineno="1-37"/>medical research program and prior consent has been obtained from the state <ln numlevel="1" lineno="69" slineno="1-38"/>registrar; or</subsection><subsection ssid="1-1-58" dnum="e-o" numlevel="1" lineno="70" slineno="1-39" level="2"><display>(e)</display>the request is a certified copy of an order of a court of record specifying the record to <ln numlevel="1" lineno="71" slineno="1-40"/>be examined or copied.</subsection></subsection><subsection ssid="1-1-59" dnum="4-o" numlevel="1" lineno="72" slineno="1-41" level="1" space="false"><display>(4)</display><subsection ssid="1-1-60" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in <xref depth="2" refnumber="78B-6-1" start="0">Title 78B, Chapter 6, Part 1, Utah Adoption Act</xref>, a parent, <ln numlevel="1" lineno="73" slineno="1-42"/>or an immediate family member of a parent, who does not have legal or physical <ln numlevel="1" lineno="74" slineno="1-43"/>custody of or visitation or parent-time rights for a child because of the termination of <ln numlevel="1" lineno="75" slineno="1-44"/>parental rights under <xref depth="1" refnumber="80-4" start="0">Title 80, Chapter 4, Termination and Restoration of Parental <ln numlevel="1" lineno="76" slineno="1-45"/>Rights</xref>, or by virtue of consenting to or relinquishing a child for adoption pursuant to <xref depth="2" refnumber="78B-6-1" start="0"><ln numlevel="1" lineno="77" slineno="1-46"/>Title 78B, Chapter 6, Part 1, Utah Adoption Act</xref>, may not be considered as having a <ln numlevel="1" lineno="78" slineno="1-47"/>direct, tangible, and legitimate interest under this section.</subsection><subsection ssid="1-1-61" dnum="b-o" numlevel="1" lineno="79" slineno="1-48" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="26B-8-125(2)(d)" start="0">(2)(d)</xref>, a commercial firm or agency requesting <ln numlevel="1" lineno="80" slineno="1-49"/>names, addresses, or similar information may not be considered as having a direct, <ln numlevel="1" lineno="81" slineno="1-50"/>tangible, and legitimate interest under this section.</subsection></subsection><subsection ssid="1-1-62" dnum="5-o" numlevel="1" lineno="82" slineno="1-51" level="1"><display>(5)</display>Upon payment of a fee established in accordance with Section <xref depth="3" refnumber="63J-1-504" start="0">63J-1-504</xref>, the office <ln numlevel="1" lineno="83" slineno="1-52"/>shall make the following records available to the public:<subsection ssid="1-1-63" dnum="a-o" numlevel="1" lineno="84" slineno="1-53" level="2"><display>(a)</display>except as provided in Subsection <xref depth="4" refnumber="26B-8-110(4)(b)" start="0">26B-8-110(4)(b)</xref>, a birth record, excluding <ln numlevel="1" lineno="85" slineno="1-54"/>confidential information collected for medical and health use, if 100 years or more <ln numlevel="1" lineno="86" slineno="1-55"/>have passed since the date of birth;</subsection><subsection ssid="1-1-64" dnum="b-o" numlevel="1" lineno="87" slineno="1-56" level="2"><display>(b)</display>a death record if 50 years or more have passed since the date of death; and</subsection><subsection ssid="1-1-65" dnum="c-o" numlevel="1" lineno="88" slineno="1-57" level="2"><display>(c)</display>a vital record not subject to Subsection <xref depth="4" refnumber="26B-8-125(5)(a)" start="0">(5)(a)</xref> or <xref depth="4" refnumber="26B-8-125(5)(b)" start="0">(b)</xref> if 75 years or more have passed <ln numlevel="1" lineno="89" slineno="1-58"/>since the date of the event upon which the record is based.</subsection></subsection><subsection ssid="1-1-66" dnum="6-o" numlevel="1" lineno="90" slineno="1-59" level="1"><display>(6)</display>Upon payment of a fee established in accordance with Section <xref depth="3" refnumber="63J-1-504" start="0">63J-1-504</xref>, the office <ln numlevel="1" lineno="91" slineno="1-60"/>shall make an adoption document available as provided in Sections <xref depth="3" refnumber="78B-6-141" start="0">78B-6-141</xref> and <xref depth="3" refnumber="78B-6-144" start="0"><ln numlevel="1" lineno="92" slineno="1-61"/>78B-6-144</xref>.</subsection><subsection ssid="1-1-67" dnum="7-o" numlevel="1" lineno="93" slineno="1-62" level="1"><display>(7)</display>The office shall make rules in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="94" slineno="1-63"/>Administrative Rulemaking Act</xref>, establishing procedures and the content of forms as <ln numlevel="1" lineno="95" slineno="1-64"/>follows:<subsection ssid="1-1-68" dnum="a-o" numlevel="1" lineno="96" slineno="1-65" level="2"><display>(a)</display>for the inspection of adoption documents under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="4" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="78B-6-141(4)" start="0">78B-6-141(4)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="admin" level="1" amendtag="both" space="true"><xref refnumber="78B-6-141(3)" depth="4"><ln numlevel="1" lineno="97" slineno="1-66"/>78B-6-141(3)</xref></amend>;</subsection><subsection ssid="1-1-69" dnum="b-o:_-e" numlevel="1" lineno="98" slineno="1-67" ea="erase" anum="0" owner="admin" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1032" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="6" groupid="5" style="2" owner="admin" level="1" deltag="end">for a birth parent's election to permit identifying information about the birth parent <ln numlevel="1" lineno="99" slineno="1-68"/>to be made available, under Section <xref depth="3" refnumber="78B-6-141" start="0">78B-6-141</xref>;</amend><amendoutend style="2"/></subsection><subsection ssid="1-1-70" dnum="c-o:b-e" numlevel="1" lineno="100" slineno="1-69" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1033" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1034" style="1" owner="e" level="1" amendtag="both" space="true">(b)</amend></display>for the release of information by the mutual-consent, voluntary adoption <ln numlevel="1" lineno="101" slineno="1-70"/>registry, under Section <xref depth="3" refnumber="78B-6-144" start="0">78B-6-144</xref>;</subsection><subsection ssid="1-1-71" dnum="d-o:c-e" numlevel="1" lineno="102" slineno="1-71" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1034" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1035" style="1" owner="e" level="1" amendtag="both" space="true">(c)</amend></display>for collecting fees and donations under Section <xref depth="3" refnumber="78B-6-144.5" start="0">78B-6-144.5</xref>; and</subsection><subsection ssid="1-1-72" dnum="e-o:d-e" numlevel="1" lineno="103" slineno="1-72" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1035" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1036" style="1" owner="e" level="1" amendtag="both" space="true">(d)</amend></display>for the review and approval of a request described in Subsection <xref depth="4" refnumber="26B-8-125(3)(d)" start="0">(3)(d)</xref>.</subsection></subsection></section></bsec><bsec buid="5" num="78A-6-103" type="amend" src="code" uid="C78A-6-S103_2025110120251101" sort="78A06 01030020251101" numlevel="1" lineno="105" slineno="2-2" sn="2"><section number="78A-6-103" numlevel="1" lineno="106" slineno="2-3" type="amend"><secline lineno="105">Section 2, Section <bold>78A-6-103</bold> is amended to read:</secline><catline lineno="106"><bold>78A-6-103<parens/>. Original jurisdiction of the juvenile court -- Magistrate functions -- <ln numlevel="1" lineno="107" slineno="2-4"/>Findings -- Transfer of a case from another court.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="108" slineno="2-5" level="1" placement="noreturn"><display>(1)</display>Except as provided in Subsection (3), the juvenile court has original jurisdiction over:<subsection ssid="5-null-2" dnum="a-o" numlevel="1" lineno="109" slineno="2-6" level="2"><display>(a)</display>a felony, misdemeanor, infraction, or violation of an ordinance, under municipal, <ln numlevel="1" lineno="110" slineno="2-7"/>state, or federal law, that was committed by a child;</subsection><subsection ssid="5-null-3" dnum="b-o" numlevel="1" lineno="111" slineno="2-8" level="2"><display>(b)</display>a felony, misdemeanor, infraction, or violation of an ordinance, under municipal, <ln numlevel="1" lineno="112" slineno="2-9"/>state, or federal law, that was committed by an individual:<subsection ssid="5-null-4" dnum="i-o" numlevel="1" lineno="113" slineno="2-10" level="3"><display>(i)</display>who is under 21 years old at the time of all court proceedings; and</subsection><subsection ssid="5-null-5" dnum="ii-o" numlevel="1" lineno="114" slineno="2-11" level="3"><display>(ii)</display>who was under 18 years old at the time the offense was committed; and</subsection></subsection><subsection ssid="5-null-6" dnum="c-o" numlevel="1" lineno="115" slineno="2-12" level="2"><display>(c)</display>a misdemeanor, infraction, or violation of an ordinance, under municipal or state law, <ln numlevel="1" lineno="116" slineno="2-13"/>that was committed:<subsection ssid="5-null-7" dnum="i-o" numlevel="1" lineno="117" slineno="2-14" level="3"><display>(i)</display>by an individual:<subsection ssid="5-null-8" dnum="A-o" numlevel="1" lineno="118" slineno="2-15" level="4"><display>(A)</display>who was 18 years old and enrolled in high school at the time of the offense; <ln numlevel="1" lineno="119" slineno="2-16"/>and</subsection><subsection ssid="5-null-9" dnum="B-o" numlevel="1" lineno="120" slineno="2-17" level="4"><display>(B)</display>who is under 21 years old at the time of all court proceedings; and</subsection></subsection><subsection ssid="5-null-10" dnum="ii-o" numlevel="1" lineno="121" slineno="2-18" level="3"><display>(ii)</display>on school property where the individual was enrolled:<subsection ssid="5-null-11" dnum="A-o" numlevel="1" lineno="122" slineno="2-19" level="4"><display>(A)</display>when school was in session; or</subsection><subsection ssid="5-null-12" dnum="B-o" numlevel="1" lineno="123" slineno="2-20" level="4"><display>(B)</display>during a school-sponsored activity, as defined in Section <xref depth="3" refnumber="53G-8-211">53G-8-211</xref>.</subsection></subsection></subsection></subsection><subsection ssid="5-null-13" dnum="2-o" numlevel="1" lineno="124" slineno="2-21" level="1"><display>(2)</display>The juvenile court has original jurisdiction over:<subsection ssid="5-null-14" dnum="a-o" numlevel="1" lineno="125" slineno="2-22" level="2"><display>(a)</display>any proceeding concerning:<subsection ssid="5-null-15" dnum="i-o" numlevel="1" lineno="126" slineno="2-23" level="3"><display>(i)</display>a child who is an abused child, neglected child, or dependent child;</subsection><subsection ssid="5-null-16" dnum="ii-o" numlevel="1" lineno="127" slineno="2-24" level="3"><display>(ii)</display>a protective order for a child in accordance with Title 78B, Chapter 7, Part 2, <ln numlevel="1" lineno="128" slineno="2-25"/>Child Protective Orders;</subsection><subsection ssid="5-null-17" dnum="iii-o" numlevel="1" lineno="129" slineno="2-26" level="3"><display>(iii)</display>the appointment of a guardian of the individual or other guardian of a minor who <ln numlevel="1" lineno="130" slineno="2-27"/>comes within the court's jurisdiction under other provisions of this section;</subsection><subsection ssid="5-null-18" dnum="iv-o" numlevel="1" lineno="131" slineno="2-28" level="3"><display>(iv)</display>the emancipation of a minor in accordance with Title 80, Chapter 7, <ln numlevel="1" lineno="132" slineno="2-29"/>Emancipation;</subsection><subsection ssid="5-null-19" dnum="v-o" numlevel="1" lineno="133" slineno="2-30" level="3"><display>(v)</display>the termination of parental rights in accordance with Title 80, Chapter 4, <ln numlevel="1" lineno="134" slineno="2-31"/>Termination and Restoration of Parental Rights, including termination of residual <ln numlevel="1" lineno="135" slineno="2-32"/>parental rights and duties;</subsection><subsection ssid="5-null-20" dnum="vi-o" numlevel="1" lineno="136" slineno="2-33" level="3"><display>(vi)</display>the treatment or commitment of a minor who has an intellectual disability;</subsection><subsection ssid="5-null-21" dnum="vii-o" numlevel="1" lineno="137" slineno="2-34" level="3"><display>(vii)</display>the judicial consent to the marriage of a minor who is 16 or 17 years old in <ln numlevel="1" lineno="138" slineno="2-35"/>accordance with Section <xref depth="3" refnumber="81-2-304">81-2-304</xref>;</subsection><subsection ssid="5-null-22" dnum="viii-o" numlevel="1" lineno="139" slineno="2-36" level="3"><display>(viii)</display>an order for a parent or a guardian of a child under Subsection <xref depth="3" refnumber="80-6-705">80-6-705</xref>(3);</subsection><subsection ssid="5-null-23" dnum="ix-o" numlevel="1" lineno="140" slineno="2-37" level="3"><display>(ix)</display>a minor under Title 80, Chapter 6, Part 11, Interstate Compact for Juveniles;</subsection><subsection ssid="5-null-24" dnum="x-o" numlevel="1" lineno="141" slineno="2-38" level="3"><display>(x)</display>the treatment or commitment of a child with a mental illness;</subsection><subsection ssid="5-null-25" dnum="xi-o" numlevel="1" lineno="142" slineno="2-39" level="3"><display>(xi)</display>the commitment of a child to a secure drug or alcohol facility in accordance with <ln numlevel="1" lineno="143" slineno="2-40"/>Section <xref depth="3" refnumber="26B-5-204">26B-5-204</xref>;</subsection><subsection ssid="5-null-26" dnum="xii-o" numlevel="1" lineno="144" slineno="2-41" level="3"><display>(xii)</display>a minor found not competent to proceed in accordance with Title 80, Chapter 6, <ln numlevel="1" lineno="145" slineno="2-42"/>Part 4, Competency;</subsection><subsection ssid="5-null-27" dnum="xiii-o" numlevel="1" lineno="146" slineno="2-43" level="3"><display>(xiii)</display>de novo review of final agency actions resulting from an informal adjudicative <ln numlevel="1" lineno="147" slineno="2-44"/>proceeding as provided in Section <xref depth="3" refnumber="63G-4-402">63G-4-402</xref>;</subsection><subsection ssid="5-null-28" dnum="xiv-o" numlevel="1" lineno="148" slineno="2-45" level="3"><display>(xiv)</display>adoptions conducted in accordance with the procedures described in Title 78B, <ln numlevel="1" lineno="149" slineno="2-46"/>Chapter 6, Part 1, Utah Adoption Act, if the juvenile court has previously entered <ln numlevel="1" lineno="150" slineno="2-47"/>an order terminating the rights of a parent and finds that adoption is in the best <ln numlevel="1" lineno="151" slineno="2-48"/>interest of the child;</subsection><subsection ssid="5-null-29" dnum="xv-o" numlevel="1" lineno="152" slineno="2-49" level="3"><display>(xv)</display>an ungovernable or runaway child who is referred to the juvenile court by the <ln numlevel="1" lineno="153" slineno="2-50"/>Division of Juvenile Justice and Youth Services if, despite earnest and persistent <ln numlevel="1" lineno="154" slineno="2-51"/>efforts by the Division of Juvenile Justice and Youth Services, the child has <ln numlevel="1" lineno="155" slineno="2-52"/>demonstrated that the child:<subsection ssid="5-null-30" dnum="A-o" numlevel="1" lineno="156" slineno="2-53" level="4"><display>(A)</display>is beyond the control of the child's parent, guardian, or custodian to the extent <ln numlevel="1" lineno="157" slineno="2-54"/>that the child's behavior or condition endangers the child's own welfare or the <ln numlevel="1" lineno="158" slineno="2-55"/>welfare of others; or</subsection><subsection ssid="5-null-31" dnum="B-o" numlevel="1" lineno="159" slineno="2-56" level="4"><display>(B)</display>has run away from home; and</subsection></subsection><subsection ssid="5-null-32" dnum="xvi-o" numlevel="1" lineno="160" slineno="2-57" level="3"><display>(xvi)</display>a criminal information filed under Part 4a, Adult Criminal Proceedings, for an <ln numlevel="1" lineno="161" slineno="2-58"/>adult alleged to have committed an offense under Subsection <xref depth="3" refnumber="78A-6-352">78A-6-352</xref>(4)(b) for <ln numlevel="1" lineno="162" slineno="2-59"/>failure to comply with a promise to appear and bring a child to the juvenile court;</subsection></subsection><subsection ssid="5-null-33" dnum="b-o" numlevel="1" lineno="163" slineno="2-60" level="2"><display>(b)</display>a petition for expungement under Title 80, Chapter 6, Part 10, Juvenile Records and <ln numlevel="1" lineno="164" slineno="2-61"/>Expungement; </subsection><subsection ssid="5-null-34" dnum="c-o" numlevel="1" lineno="165" slineno="2-62" level="2"><display>(c)</display>the extension of a nonjudicial adjustment under Section <xref depth="3" refnumber="80-6-304">80-6-304</xref>;</subsection><subsection ssid="5-null-35" dnum="d-o" numlevel="1" lineno="166" slineno="2-63" level="2"><display>(d)</display>a petition for special findings under Section <xref depth="3" refnumber="80-3-305">80-3-305</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="admin" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-36" dnum="e-o" numlevel="1" lineno="167" slineno="2-64" level="2"><display>(e)</display>a referral of a minor for being a habitual truant as defined in Section <xref depth="3" refnumber="53G-8-211">53G-8-211</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="admin" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="admin" level="1" amendtag="both" space="true">; <ln numlevel="1" lineno="168" slineno="2-65"/>and</amend></subsection><subsection ssid="5-47" dnum="_-o:f-e" numlevel="1" lineno="169" slineno="2-66" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="e" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="admin" level="1" amendtag="end">a pre-existing parent's petition to seal adoption documents as described in Subsection <ln numlevel="1" lineno="170" slineno="2-67"/>78B-6-141(5).</amend></subsection></subsection><subsection ssid="5-null-37" dnum="3-o" numlevel="1" lineno="171" slineno="2-68" level="1"><display>(3)</display>The juvenile court does not have original jurisdiction over an offense committed by a <ln numlevel="1" lineno="172" slineno="2-69"/>minor as described in Subsection <xref tempid="585" depth="4" refnumber="78A-6-103(1)">(1)</xref> if:<subsection ssid="5-null-38" dnum="a-o" numlevel="1" lineno="173" slineno="2-70" level="2"><display>(a)</display>the district court has original jurisdiction over the offense under Section <xref depth="3" refnumber="78A-5-102.5">78A-5-102.5</xref>;</subsection><subsection ssid="5-null-39" dnum="b-o" numlevel="1" lineno="174" slineno="2-71" level="2"><display>(b)</display>the district court has original jurisdiction over the offense under Subsection <xref tempid="988" depth="4" refnumber="78A-5-102(8)"><ln numlevel="1" lineno="175" slineno="2-72"/>78A-5-102(8)</xref>, unless the juvenile court has exclusive jurisdiction over the offense <ln numlevel="1" lineno="176" slineno="2-73"/>under Section <xref depth="3" refnumber="78A-6-103.5">78A-6-103.5</xref>; or</subsection><subsection ssid="5-null-40" dnum="c-o" numlevel="1" lineno="177" slineno="2-74" level="2"><display>(c)</display>the justice court has original jurisdiction over the offense under Subsection <xref tempid="1010" depth="4" refnumber="78A-7-106(2)"><ln numlevel="1" lineno="178" slineno="2-75"/>78A-7-106(2)</xref>, unless the juvenile court has exclusive jurisdiction over the offense <ln numlevel="1" lineno="179" slineno="2-76"/>under Section <xref depth="3" refnumber="78A-6-103.5">78A-6-103.5</xref>.</subsection></subsection><subsection ssid="5-null-41" dnum="4-o" numlevel="1" lineno="180" slineno="2-77" level="1"><display>(4)</display>It is not necessary for a minor to be adjudicated for an offense or violation of the law <ln numlevel="1" lineno="181" slineno="2-78"/>under Section <xref depth="3" refnumber="80-6-701">80-6-701</xref> for the juvenile court to exercise jurisdiction under Subsection <ln numlevel="1" lineno="182" slineno="2-79"/>(2)(a)(xvi), (b), or (c).</subsection><subsection ssid="5-null-42" dnum="5-o" numlevel="1" lineno="183" slineno="2-80" level="1"><display>(5)</display>This section does not restrict the right of access to the juvenile court by private agencies <ln numlevel="1" lineno="184" slineno="2-81"/>or other persons.</subsection><subsection ssid="5-null-43" dnum="6-o" numlevel="1" lineno="185" slineno="2-82" level="1"><display>(6)</display>The juvenile court has jurisdiction of all magistrate functions relative to cases arising <ln numlevel="1" lineno="186" slineno="2-83"/>under Title 80, Chapter 6, Part 5, Transfer to District Court.</subsection><subsection ssid="5-null-44" dnum="7-o" numlevel="1" lineno="187" slineno="2-84" level="1"><display>(7)</display>The juvenile court has jurisdiction to make a finding of substantiated, unsubstantiated, <ln numlevel="1" lineno="188" slineno="2-85"/>or without merit, in accordance with Section <xref depth="3" refnumber="80-3-404">80-3-404</xref>.</subsection><subsection ssid="5-null-45" dnum="8-o" numlevel="1" lineno="189" slineno="2-86" level="1"><display>(8)</display>The juvenile court has jurisdiction over matters transferred to the juvenile court by <ln numlevel="1" lineno="190" slineno="2-87"/>another trial court in accordance with Subsection <xref depth="4" refnumber="78A-7-106(6)">78A-7-106(6)</xref> and Section <xref depth="3" refnumber="80-6-303">80-6-303</xref>.</subsection><subsection ssid="5-null-46" dnum="9-o" numlevel="1" lineno="191" slineno="2-88" level="1"><display>(9)</display>The juvenile court has jurisdiction to enforce foreign protection orders as described in <ln numlevel="1" lineno="192" slineno="2-89"/>Subsection <xref Court hearings may be closed -- Adoption documents.</bold></catline><subsection ssid="2-2-71" dnum="1-o" numlevel="1" lineno="196" slineno="3-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="2-2-72" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding Section <xref depth="3" refnumber="80-4-106" start="0">80-4-106</xref>, court hearings in adoption cases may be <ln numlevel="1" lineno="197" slineno="3-5"/>closed to the public upon request of a party to the adoption petition and upon court <ln numlevel="1" lineno="198" slineno="3-6"/>approval.</subsection><subsection ssid="2-2-73" dnum="b-o" numlevel="1" lineno="199" slineno="3-7" level="2"><display>(b)</display>In a closed hearing, only the following individuals may be admitted:<subsection ssid="2-2-74" dnum="i-o" numlevel="1" lineno="200" slineno="3-8" level="3"><display>(i)</display>a party to the proceeding;</subsection><subsection ssid="2-2-75" dnum="ii-o" numlevel="1" lineno="201" slineno="3-9" level="3"><display>(ii)</display>the adoptee;</subsection><subsection ssid="2-2-76" dnum="iii-o" numlevel="1" lineno="202" slineno="3-10" level="3"><display>(iii)</display>a representative of an agency having custody of the adoptee;</subsection><subsection ssid="2-2-77" dnum="iv-o" numlevel="1" lineno="203" slineno="3-11" level="3"><display>(iv)</display>in a hearing to relinquish parental rights, the individual whose rights are to be <ln numlevel="1" lineno="204" slineno="3-12"/>relinquished and invitees of that individual to provide emotional support;</subsection><subsection ssid="2-2-78" dnum="v-o" numlevel="1" lineno="205" slineno="3-13" level="3"><display>(v)</display>in a hearing on the termination of parental rights, the individual whose rights may <ln numlevel="1" lineno="206" slineno="3-14"/>be terminated;</subsection><subsection ssid="2-2-79" dnum="vi-o" numlevel="1" lineno="207" slineno="3-15" level="3"><display>(vi)</display>in a hearing on a petition to intervene, the proposed intervenor;</subsection><subsection ssid="2-2-80" dnum="vii-o" numlevel="1" lineno="208" slineno="3-16" level="3"><display>(vii)</display>in a hearing to finalize an adoption, invitees of the petitioner; and</subsection><subsection ssid="2-2-81" dnum="viii-o" numlevel="1" lineno="209" slineno="3-17" level="3"><display>(viii)</display>other individuals for good cause, upon order of the court.</subsection></subsection></subsection><subsection ssid="2-2-82" dnum="2-o" numlevel="1" lineno="210" slineno="3-18" level="1"><display>(2)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="217" groupid="168" style="2" owner="admin" level="1" deltag="both">An</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="215" groupid="166" style="1" owner="admin" level="1" amendtag="both" space="true">Except as provided in Subsections <xref refnumber="78B-6-141(3)" depth="4">(3)</xref> and (4), an</amend> adoption document and any other <ln numlevel="1" lineno="211" slineno="3-19"/>documents filed in connection with a petition for adoption are sealed.</subsection><subsection ssid="2-2-83" dnum="3-o" numlevel="1" lineno="212" slineno="3-20" level="1"><display>(3)</display>The documents described in Subsection <xref depth="4" refnumber="78B-6-141(2)" start="0">(2)</xref> may only be open to inspection and copying:<subsection ssid="2-2-84" dnum="a-o" numlevel="1" lineno="213" slineno="3-21" level="2"><display>(a)</display>in accordance with Subsection <xref depth="4" refnumber="78B-6-141(5)(a)" start="0">(5)(a)</xref>, by a party to the adoption proceeding:<subsection ssid="2-2-85" dnum="i-o" numlevel="1" lineno="214" slineno="3-22" level="3"><display>(i)</display>while the proceeding is pending; and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="2-2-104" dnum="ii-o:_-e" numlevel="1" lineno="246" slineno="3-54" ea="erase" anum="0" owner="admin" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1116" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="57" groupid="42" style="2" owner="admin" level="1" deltag="end">at any time, file, electronically or on a written document with the office, to:</amend><amendoutend style="2"/><subsection ssid="2-2-105" dnum="A-o:_-e" numlevel="1" lineno="247" slineno="3-55" ea="erase" anum="0" owner="admin" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1117" style="2" owner="o" level="1" deltag="start">(A)</amend></display><amend anum="0" ea="erase" pairid="58" groupid="43" style="2" owner="admin" level="1" deltag="end">change the election described in Subsection <xref depth="4" refnumber="78B-6-141(4)(b)" start="0">(4)(b)</xref>; or</amend><amendoutend style="2"/></subsection><subsection ssid="2-2-106" dnum="B-o:_-e" numlevel="1" lineno="248" slineno="3-56" ea="erase" anum="0" owner="admin" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1118" style="2" owner="o" level="1" deltag="start">(B)</amend></display><amend anum="0" ea="erase" pairid="61" groupid="46" style="2" owner="admin" level="1" deltag="end">elect to make other information about the birth parent, including an updated <ln numlevel="1" lineno="249" slineno="3-57"/>medical history, available for inspection by an adult adoptee.</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="2-2-107" dnum="c-o:_-e" numlevel="1" lineno="250" slineno="3-58" ea="erase" anum="0" owner="admin" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1119" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="62" groupid="47" style="2" owner="admin" level="1" deltag="end">A birth parent may not access any identifying information or an adoption document <ln numlevel="1" lineno="251" slineno="3-59"/>under this Subsection <xref depth="4" refnumber="78B-6-141(4)" start="0">(4)</xref>.</amend><amendoutend style="2"/></subsection><subsection ssid="2-2-108" dnum="d-o:_-e" numlevel="1" lineno="252" slineno="3-60" ea="erase" anum="0" owner="admin" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1120" style="2" owner="o" level="1" deltag="start">(d)</amend></display><amend anum="0" ea="erase" pairid="65" groupid="50" style="2" owner="admin" level="1" deltag="end">If two birth parents are listed on the original birth certificate and only one birth <ln numlevel="1" lineno="253" slineno="3-61"/>parent consents under Subsection <xref depth="4" refnumber="78B-6-141(4)(b)" start="0">(4)(b)</xref> or is deceased, the office may redact the <ln numlevel="1" lineno="254" slineno="3-62"/>name of the other birth parent.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="2-136" dnum="_-o:4-e" numlevel="1" lineno="255" slineno="3-63" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1121" style="1" owner="e" level="1" amendtag="start">(4)</amend></display><subsection ssid="2-157" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1122" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="423" groupid="328" style="1" owner="admin" level="1" amendtag="end">Unless there is a court order sealing the documents, an adult adoptee may inspect <ln numlevel="1" lineno="256" slineno="3-64"/>and copy the following adoption documents associated with the adult adoptee's <ln numlevel="1" lineno="257" slineno="3-65"/>adoption, without a court order:</amend><subsection ssid="2-141" dnum="_-o:i-e" numlevel="1" lineno="258" slineno="3-66" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1123" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="364" groupid="285" style="1" owner="admin" level="1" amendtag="end">the report of adoption;</amend></subsection><subsection ssid="2-142" dnum="_-o:ii-e" numlevel="1" lineno="259" slineno="3-67" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="369" groupid="289" style="1" owner="admin" level="1" amendtag="end">the original birth certificate;</amend></subsection><subsection ssid="2-143" dnum="_-o:iii-e" numlevel="1" lineno="260" slineno="3-68" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="374" groupid="293" style="1" owner="admin" level="1" amendtag="end">the findings of fact for the adoption; and </amend></subsection><subsection ssid="2-144" dnum="_-o:iv-e" numlevel="1" lineno="261" slineno="3-69" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="379" groupid="297" style="1" owner="admin" level="1" amendtag="end">the final decree of adoption.</amend></subsection></subsection><subsection ssid="2-158" dnum="_-o:b-e" numlevel="1" lineno="262" slineno="3-70" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="418" groupid="324" style="1" owner="admin" level="1" amendtag="end">A pre-existing parent of an adult adoptee may bring a petition in the court that <ln numlevel="1" lineno="263" slineno="3-71"/>entered the final decree of adoption to keep the documents described in Subsection <xref refnumber="2-157"><ln numlevel="1" lineno="264" slineno="3-72"/>(4)(a)</xref> sealed for 10 years after the day on which the adult adoptee reaches 18 years <ln numlevel="1" lineno="265" slineno="3-73"/>old.</amend></subsection><subsection ssid="2-147" dnum="_-o:c-e" numlevel="1" lineno="266" slineno="3-74" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="387" groupid="303" style="1" owner="admin" level="1" amendtag="end">The pre-existing parent shall:</amend><subsection ssid="2-148" dnum="_-o:i-e" numlevel="1" lineno="267" slineno="3-75" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1129" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="390" groupid="305" style="1" owner="admin" level="1" amendtag="end">file a petition described in Subsection (4)(a) before the adoptee reaches 18 years <ln numlevel="1" lineno="268" slineno="3-76"/>old; and</amend></subsection><subsection ssid="2-149" dnum="_-o:ii-e" numlevel="1" lineno="269" slineno="3-77" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1130" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="393" groupid="307" style="1" owner="admin" level="1" amendtag="end">include in the petition sufficient information for the court to reliably determine <ln numlevel="1" lineno="270" slineno="3-78"/>the adoption documents at issue in the petition.</amend></subsection></subsection><subsection ssid="2-150" dnum="_-o:d-e" numlevel="1" lineno="271" slineno="3-79" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1131" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="396" groupid="309" style="1" owner="admin" level="1" amendtag="end">The court may only grant the petition described in Subsection <xref refnumber="2-158">(4)(b)</xref> if the <ln numlevel="1" lineno="272" slineno="3-80"/>pre-existing parent establishes by sworn affidavit that the adult adoptee's access to <ln numlevel="1" lineno="273" slineno="3-81"/>the documents described in Subsection <xref refnumber="2-157">(4)(a)</xref> would place the pre-existing parent in <ln numlevel="1" lineno="274" slineno="3-82"/>reasonable fear of harm from an individual.</amend></subsection><subsection ssid="2-151" dnum="_-o:e-e" numlevel="1" lineno="275" slineno="3-83" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1132" style="1" owner="e" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="399" groupid="311" style="1" owner="admin" level="1" amendtag="end">If the court grants a pre-existing parent's petition, the documents described in <ln numlevel="1" lineno="276" slineno="3-84"/>Subsection <xref refnumber="2-157">(4)(a)</xref> shall remain sealed for 10 years from the entry of the order, unless <ln numlevel="1" lineno="277" slineno="3-85"/>the court permits access to the documents under Subsection <xref refnumber="2-2-88">(3)(c)</xref>.</amend></subsection><subsection ssid="2-153" dnum="_-o:f-e" numlevel="1" lineno="278" slineno="3-86" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1133" style="1" owner="e" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="405" groupid="315" style="1" owner="admin" level="1" amendtag="end">The pre-existing parent may bring a new petition every 10 years for an order <ln numlevel="1" lineno="279" slineno="3-87"/>extending the sealing of the documents described in Subsection <xref refnumber="2-157">(4)(a)</xref> for an <ln numlevel="1" lineno="280" slineno="3-88"/>additional 10 years.</amend></subsection><subsection ssid="2-154" dnum="_-o:g-e" numlevel="1" lineno="281" slineno="3-89" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="e" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="408" groupid="317" style="1" owner="admin" level="1" amendtag="end">The pre-existing parent shall file a petition described in Subsection (4)(f) before the <ln numlevel="1" lineno="282" slineno="3-90"/>expiration of the previous order.</amend></subsection><subsection ssid="2-155" dnum="_-o:h-e" numlevel="1" lineno="283" slineno="3-91" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="e" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="411" groupid="319" style="1" owner="admin" level="1" amendtag="end">A petition to extend the sealing of the documents described in Subsection <xref refnumber="2-157">(4)(a)</xref> shall <ln numlevel="1" lineno="284" slineno="3-92"/>satisfy all of the requirements described in Subsections (4)(b) through (d) for the <ln numlevel="1" lineno="285" slineno="3-93"/>original petition.</amend></subsection></subsection><subsection ssid="2-2-109" dnum="5-o" numlevel="1" lineno="286" slineno="3-94" level="1" space="false"><display>(5)</display><subsection ssid="2-2-110" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual who files a motion to intervene in an adoption proceeding:<subsection ssid="2-2-111" dnum="i-o" numlevel="1" lineno="287" slineno="3-95" level="3" tab="1"><display>(i)</display>is not a party to the adoption proceeding, unless the motion to intervene is granted; <ln numlevel="1" lineno="288" slineno="3-96"/>and</subsection><subsection ssid="2-2-112" dnum="ii-o" numlevel="1" lineno="289" slineno="3-97" level="3" tab="1"><display>(ii)</display>may not be granted access to the documents described in Subsection <xref depth="4" refnumber="78B-6-141(2)" start="0">(2)</xref>, unless <ln numlevel="1" lineno="290" slineno="3-98"/>the motion to intervene is granted.</subsection></subsection><subsection ssid="2-2-113" dnum="b-o" numlevel="1" lineno="291" slineno="3-99" level="2"><display>(b)</display>An order described in Subsection <xref depth="4" refnumber="78B-6-141(3)(b)" start="0">(3)(b)</xref> shall:<subsection ssid="2-2-114" dnum="i-o" numlevel="1" lineno="292" slineno="3-100" level="3"><display>(i)</display>prohibit the individual described in Subsection <xref depth="4" refnumber="78B-6-141(3)(b)" start="0">(3)(b)</xref> from inspecting a document <ln numlevel="1" lineno="293" slineno="3-101"/>described in Subsection <xref depth="4" refnumber="78B-6-141(2)" start="0">(2)</xref> that contains identifying information of the adoptive <ln numlevel="1" lineno="294" slineno="3-102"/>or prospective adoptive parent; and</subsection><subsection ssid="2-2-115" dnum="ii-o" numlevel="1" lineno="295" slineno="3-103" level="3"><display>(ii)</display>permit the individual described in Subsection <xref depth="4" refnumber="78B-6-141(5)(b)(i)" start="0">(5)(b)(i)</xref> to review a copy of a <ln numlevel="1" lineno="296" slineno="3-104"/>document described in Subsection <xref depth="4" refnumber="78B-6-141(5)(b)(i)" start="0">(5)(b)(i)</xref> after the identifying information <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="162" groupid="122" style="2" owner="admin" level="1" deltag="both"><ln numlevel="1" lineno="297" slineno="3-105"/>described in Subsection <xref depth="4" refnumber="78B-6-141(5)(b)(i)" start="0">(5)(b)(i)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="161" groupid="121" style="1" owner="admin" level="1" amendtag="both" space="true">of the adoptive or prospective adoptive parent</amend> is <ln numlevel="1" lineno="298" slineno="3-106"/>redacted from the document.</subsection></subsection></subsection></section></bsec><bsec buid="11" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="299" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="299">Section 4.  <bold>Effective Date.</bold></secline><sectionText lineno="300"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="admin" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="11/1/2025">November 1, 2025</effdate>.</amend></sectionText></section></bsec><bsec buid="10" type="uncod" untype="coord" src="uncod" uid="CRD0000" sort="UZT00000" langlock="false" numlevel="1" lineno="301" slineno="5-1" sn="5"><section ccsum="true" type="uncod" untype="coord" display="false" src="uncod"><secline lineno="301">Section 5.  <bold>Coordinating H.B. 129 with S.B. 119.</bold></secline><sectionText lineno="302"><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both">If H.B. 129, Adoption Records Access Amendments, and S.B. 119, Domestic Relations <ln numlevel="1" lineno="303" slineno="5-3"/>Recodification, both pass and become law, the Legislature intends that:</amend></sectionText><subsection ssid="10-16" dnum="_-o:1-e" numlevel="1" lineno="304" slineno="5-4" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="138" groupid="133" style="1" owner="admin" level="1" amendtag="end">on September 1, 2025, the coordination clause in S.B. 119 that coordinates H.B. 129 <ln numlevel="1" lineno="305" slineno="5-5"/>with S.B. 119 not take effect; or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="59" groupid="54" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="348" slineno="5-48"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="110" groupid="105" style="2" owner="admin" level="1" deltag="both">(ii) within six months after the day on which the adoption decree is entered;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="63" groupid="58" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="349" slineno="5-49"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="111" groupid="106" style="2" owner="admin" level="1" deltag="both">(b) subject to Subsection (5)(b), if a court enters an order permitting access to the <ln numlevel="1" lineno="350" slineno="5-50"/>documents by an individual who has appealed the denial of that individual's motion <ln numlevel="1" lineno="351" slineno="5-51"/>to intervene;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="61" groupid="56" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="352" slineno="5-52"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="112" groupid="107" style="2" owner="admin" level="1" deltag="both">(c) upon order of the court expressly permitting inspection or copying, after good <ln numlevel="1" lineno="353" slineno="5-53"/>cause has been shown;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="62" groupid="57" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="354" slineno="5-54"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="113" groupid="108" style="2" owner="admin" level="1" deltag="both">(d) as provided under Section 78B-6-144;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="60" groupid="55" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="355" slineno="5-55"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="114" groupid="109" style="2" owner="admin" level="1" deltag="both">(e) when the adoption document becomes public on the one hundredth <ln numlevel="1" lineno="356" slineno="5-56"/>anniversary of the date the final decree of adoption was entered;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="64" groupid="59" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="357" slineno="5-57"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="115" groupid="110" style="2" owner="admin" level="1" deltag="both">(f) when the birth certificate becomes public on the one hundredth anniversary of <ln numlevel="1" lineno="358" slineno="5-58"/>the date of birth;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="65" groupid="60" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="359" slineno="5-59"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="116" groupid="111" style="2" owner="admin" level="1" deltag="both">(g) to a mature adoptee or a parent who adopted the mature adoptee, without a <ln numlevel="1" lineno="360" slineno="5-60"/>court order, unless the final decree of adoption is entered by the juvenile court under <ln numlevel="1" lineno="361" slineno="5-61"/>Subsection 78B-6-115(3)(b); or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="66" groupid="61" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="362" slineno="5-62"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="117" groupid="112" style="2" owner="admin" level="1" deltag="both">(h) to an adult adoptee, to the extent permitted under Subsection (4).</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="67" groupid="62" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="363" slineno="5-63"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="118" groupid="113" style="2" owner="admin" level="1" deltag="both">(4)(a) An adult adoptee that was born in the state may access an adoption <ln numlevel="1" lineno="364" slineno="5-64"/>document associated with the adult adoptee's adoption without a court order:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="85" groupid="80" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="365" slineno="5-65"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="119" groupid="114" style="2" owner="admin" level="1" deltag="both">(i) to the extent that a birth parent consents under Subsection (4)(b); or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="86" groupid="81" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="366" slineno="5-66"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="120" groupid="115" style="2" owner="admin" level="1" deltag="both">(ii) if the birth parents listed on the original birth certificate are deceased.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="68" groupid="63" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="367" slineno="5-67"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="121" groupid="116" style="2" owner="admin" level="1" deltag="both">(b) A birth parent may:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="69" groupid="64" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="368" slineno="5-68"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="122" groupid="117" style="2" owner="admin" level="1" deltag="both">(i) provide consent to allow the access described in Subsection (4)(a) by electing, <ln numlevel="1" lineno="369" slineno="5-69"/>electronically or on a written form provided by the office, allowing the birth parent to <ln numlevel="1" lineno="370" slineno="5-70"/>elect to:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="70" groupid="65" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="371" slineno="5-71"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="123" groupid="118" style="2" owner="admin" level="1" deltag="both">(A) allow the office to provide the adult adoptee with the contact information of <ln numlevel="1" lineno="372" slineno="5-72"/>the birth parent that the birth parent indicates;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="71" groupid="66" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="373" slineno="5-73"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="124" groupid="119" style="2" owner="admin" level="1" deltag="both">(B) allow the office to provide the adult adoptee with the contact information of <ln numlevel="1" lineno="374" slineno="5-74"/>an intermediary that the birth parent indicates;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="72" groupid="67" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="375" slineno="5-75"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="125" groupid="120" style="2" owner="admin" level="1" deltag="both">(C) prohibit the office from providing any contact information to the adult <ln numlevel="1" lineno="376" slineno="5-76"/>adoptee;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="74" groupid="69" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="377" slineno="5-77"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="126" groupid="121" style="2" owner="admin" level="1" deltag="both">(D) allow the office to provide the adult adoptee with a noncertified copy of the <ln numlevel="1" lineno="378" slineno="5-78"/>original birth certificate; and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="75" groupid="70" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="379" slineno="5-79"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="127" groupid="122" style="2" owner="admin" level="1" deltag="both">(ii) at any time, file, electronically or on a written document with the office, to:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="73" groupid="68" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="380" slineno="5-80"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="128" groupid="123" style="2" owner="admin" level="1" deltag="both">(A) change the election described in Subsection (4)(b); or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="77" groupid="72" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="381" slineno="5-81"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="129" groupid="124" style="2" owner="admin" level="1" deltag="both">(B) elect to make other information about the birth parent, including an updated <ln numlevel="1" lineno="382" slineno="5-82"/>medical history, available for inspection by an adult adoptee.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="78" groupid="73" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="383" slineno="5-83"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="130" groupid="125" style="2" owner="admin" level="1" deltag="both">(c) A birth parent may not access any identifying information or an adoption <ln numlevel="1" lineno="384" slineno="5-84"/>document under this Subsection (4).</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="76" groupid="71" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="385" slineno="5-85"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="131" groupid="126" style="2" owner="admin" level="1" deltag="both">(d) If two birth parents are listed on the original birth certificate and only one <ln numlevel="1" lineno="386" slineno="5-86"/>birth parent consents under Subsection (4)(b) or is deceased, the office may redact <ln numlevel="1" lineno="387" slineno="5-87"/>the name of the other birth parent.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="79" groupid="74" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="388" slineno="5-88"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="132" groupid="127" style="2" owner="admin" level="1" deltag="both">(5)(a) An individual who files a motion to intervene in an adoption proceeding:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="80" groupid="75" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="389" slineno="5-89"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="133" groupid="128" style="2" owner="admin" level="1" deltag="both">(i) is not a party to the adoption proceeding, unless the motion to intervene is <ln numlevel="1" lineno="390" slineno="5-90"/>granted; and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="81" groupid="76" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="391" slineno="5-91"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="134" groupid="129" style="2" owner="admin" level="1" deltag="both">(ii) may not be granted access to the documents described in Subsection (2), <ln numlevel="1" lineno="392" slineno="5-92"/>unless the motion to intervene is granted.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="82" groupid="77" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="393" slineno="5-93"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="135" groupid="130" style="2" owner="admin" level="1" deltag="both">(b) An order described in Subsection (3)(b) shall:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="83" groupid="78" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="394" slineno="5-94"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="136" groupid="131" style="2" owner="admin" level="1" deltag="both">(i) prohibit the individual described in Subsection (3)(b) from inspecting a <ln numlevel="1" lineno="395" slineno="5-95"/>document described in Subsection (2) that contains identifying information of the <ln numlevel="1" lineno="396" slineno="5-96"/>adoptive or prospective adoptive parent; and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="84" groupid="79" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="397" slineno="5-97"/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="137" groupid="132" style="2" owner="admin" level="1" deltag="both">(ii) permit the individual described in Subsection (5)(b)(i) to review a copy of a <ln numlevel="1" lineno="398" slineno="5-98"/>document described in Subsection (5)(b)(i) after the identifying information <ln numlevel="1" lineno="399" slineno="5-99"/>described in Subsection (5)(b)(i) is redacted from the document.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="94" groupid="89" style="1" owner="admin" level="1" amendtag="both" space="true"><eol numlevel="1" lineno="400" slineno="5-100"/>(3) A person may only inspect and copy the documents described in Subsection <ln numlevel="1" lineno="401" slineno="5-101"/>(2):<eol numlevel="1" lineno="402" slineno="5-102"/>(a) if the adoption proceeding is pending and the person is a party to the adoption <ln numlevel="1" lineno="403" slineno="5-103"/>proceeding;<eol numlevel="1" lineno="404" slineno="5-104"/>(b) within 180 days after the day on which the final decree of adoption is entered <ln numlevel="1" lineno="405" slineno="5-105"/>if the person is a party to the adoption proceeding;<eol numlevel="1" lineno="406" slineno="5-106"/>(c) if the court enters an order expressly permitting the inspection or copying the <ln numlevel="1" lineno="407" slineno="5-107"/>documents after the person filed a motion to intervene and the motion to intervene <ln numlevel="1" lineno="408" slineno="5-108"/>was granted on appeal;<eol numlevel="1" lineno="409" slineno="5-109"/>(d) if the court enters an order expressly permitting the inspection or copying of <ln numlevel="1" lineno="410" slineno="5-110"/>the documents after good cause is shown;<eol numlevel="1" lineno="411" slineno="5-111"/>(e) if the office is permitted to release the documents to the person as described in <ln numlevel="1" lineno="412" slineno="5-112"/>Section 81-13-504;<eol numlevel="1" lineno="413" slineno="5-113"/>(f) when the documents become public 100 years after the day on which the final <ln numlevel="1" lineno="414" slineno="5-114"/>decree of adoption was entered;<eol numlevel="1" lineno="415" slineno="5-115"/>(g) when the birth certificate becomes public 100 years after the day on which the <ln numlevel="1" lineno="416" slineno="5-116"/>adoptee was born; or<eol numlevel="1" lineno="417" slineno="5-117"/>(h) if the person is permitted access to the documents under Subsection (6) or (7).<eol numlevel="1" lineno="418" slineno="5-118"/>(4) A person who files a motion to intervene in an adoption proceeding:<eol numlevel="1" lineno="419" slineno="5-119"/>(a) is not a party to the adoption proceeding, unless the motion to intervene is <ln numlevel="1" lineno="420" slineno="5-120"/>granted; and<eol numlevel="1" lineno="421" slineno="5-121"/>(b) subject to Subsection (5), may not be granted access to the documents <ln numlevel="1" lineno="422" slineno="5-122"/>described in Subsection (2), unless the motion to intervene is granted.<eol numlevel="1" lineno="423" slineno="5-123"/>(5) If the court enters an order under Subsection (3)(c) or a potential birth father is <ln numlevel="1" lineno="424" slineno="5-124"/>made a party to the adoption proceeding upon a motion to intervene, the court shall:<eol numlevel="1" lineno="425" slineno="5-125"/>(a) prohibit the person described in Subsection (3)(c) or the potential birth father <ln numlevel="1" lineno="426" slineno="5-126"/>from inspecting a document described in Subsection (2) that contains identifying <ln numlevel="1" lineno="427" slineno="5-127"/>information of an adoptive or prospective adoptive parent; and<eol numlevel="1" lineno="428" slineno="5-128"/>(b) permit the person described in Subsection (3)(c) or the potential birth father to <ln numlevel="1" lineno="429" slineno="5-129"/>review a copy of the document described in Subsection (5)(a) after the identifying <ln numlevel="1" lineno="430" slineno="5-130"/>information of the adoptive or prospective adoptive parent is redacted from the <ln numlevel="1" lineno="431" slineno="5-131"/>document.<eol numlevel="1" lineno="432" slineno="5-132"/>(6) (a) Unless there is a court order sealing the documents, a child adoptee may <ln numlevel="1" lineno="433" slineno="5-133"/>inspect and copy the following documents associated with the child adoptee's <ln numlevel="1" lineno="434" slineno="5-134"/>adoption, without a court order, if the child adoptee is 18 years old or older:<eol numlevel="1" lineno="435" slineno="5-135"/>(i) the report of adoption;<eol numlevel="1" lineno="436" slineno="5-136"/>(ii) the original birth certificate;<eol numlevel="1" lineno="437" slineno="5-137"/>(iii) the findings of fact for the adoption; and<eol numlevel="1" lineno="438" slineno="5-138"/>(iv) the final decree of adoption.<eol numlevel="1" lineno="439" slineno="5-139"/>(b) A pre-existing parent of a child adoptee may bring a petition in the court that <ln numlevel="1" lineno="440" slineno="5-140"/>entered the final decree of adoption to keep the documents described in Subsection <xref tempid="150"><ln numlevel="1" lineno="441" slineno="5-141"/>(6)(a)</xref> sealed for 10 years after the day on which the child adoptee reaches 18 years <ln numlevel="1" lineno="442" slineno="5-142"/>old.<eol numlevel="1" lineno="443" slineno="5-143"/>(c) The pre-existing parent shall:<eol numlevel="1" lineno="444" slineno="5-144"/>(i) file a petition described in Subsection (6)(b) before the child adoptee reaches <ln numlevel="1" lineno="445" slineno="5-145"/>18 years old; and<eol numlevel="1" lineno="446" slineno="5-146"/>(ii) include in the petition sufficient information for the court to reliably determine <ln numlevel="1" lineno="447" slineno="5-147"/>the adoption documents at issue in the petition.<eol numlevel="1" lineno="448" slineno="5-148"/>(d) The court may only grant the petition described in Subsection (6)(b) if the <ln numlevel="1" lineno="449" slineno="5-149"/>pre-existing parent establishes by sworn affidavit that the child adoptee's access to <ln numlevel="1" lineno="450" slineno="5-150"/>the documents described in Subsection <xref tempid="959">(6)(a)</xref> would place the pre-existing parent in <ln numlevel="1" lineno="451" slineno="5-151"/>reasonable fear of harm from an individual.<eol numlevel="1" lineno="452" slineno="5-152"/>(e) If the court grants a pre-existing parent's petition, the documents described in <ln numlevel="1" lineno="453" slineno="5-153"/>Subsection (6)(a) shall remain sealed for 10 years from the entry of the order, unless <ln numlevel="1" lineno="454" slineno="5-154"/>the court permits access to the documents under Subsection (3)(d).<eol numlevel="1" lineno="455" slineno="5-155"/>(f) The pre-existing parent may bring a new petition every 10 years for an order <ln numlevel="1" lineno="456" slineno="5-156"/>extending the sealing of the documents described in Subsection <xref tempid="893">(6)(a)</xref> for an <ln numlevel="1" lineno="457" slineno="5-157"/>additional 10 years.<eol numlevel="1" lineno="458" slineno="5-158"/>(g) The pre-existing parent shall file a petition described in Subsection (6)(f) <ln numlevel="1" lineno="459" slineno="5-159"/>before the expiration of the previous order.<eol numlevel="1" lineno="460" slineno="5-160"/>(h) A petition to extend the sealing of the documents described in Subsection <xref tempid="958">(6)(a)</xref> <ln numlevel="1" lineno="461" slineno="5-161"/>shall satisfy all of the requirements described in Subsections (6)(b) through (d) for <ln numlevel="1" lineno="462" slineno="5-162"/>the original petition.<eol numlevel="1" lineno="463" slineno="5-163"/>(7) An adult adoptee, or the adoptive parent of the adult adoptee, may inspect an <ln numlevel="1" lineno="464" slineno="5-164"/>adoption document associated with the adult adoptee's adoption without a court <ln numlevel="1" lineno="465" slineno="5-165"/>order, unless the final decree of adoption is entered by the juvenile court.<eol numlevel="1" lineno="466" slineno="5-166"/>(8) A pre-existing parent may not access the documents described in Subsection <ln numlevel="1" lineno="467" slineno="5-167"/>(2)."; and</amend></subsection><subsection ssid="10-31" dnum="_-o:d-e" numlevel="1" lineno="468" slineno="5-168" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="167" groupid="155" style="1" owner="admin" level="1" amendtag="end">the changes to Section 78B-6-141 in H.B. 129 not be made.</amend></subsection></subsection></section></bsec></bdy><foot><rev><tm>3-3-25 2:23 PM</tm></rev></foot></leg>
