Stratton</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill clarifies when a non-citizen is a restricted person.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">clarifies that aliens who have applications pending for asylum or temporary protected <ln numlevel="1" lineno="9" slineno="0-9"/>status are restricted persons not allowed to possess, purchase, transfer, or own dangerous <ln numlevel="1" lineno="10" slineno="0-10"/>weapons; and</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="12" slineno="0-12" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="13">None</moniNone><oc numlevel="1" lineno="14" slineno="0-14">Other Special Clauses:</oc><ocNone lineno="15">None</ocNone><sa numlevel="1" lineno="16" slineno="0-16">Utah Code Sections Affected:<saamd numlevel="1" lineno="17" slineno="0-17"><snhead>AMENDS:</snhead><sn num="76-10-503" src="code" uid="C76-10-S503_2025050720250507" buid="1" sort="76 10 05030020250507" numlevel="1" lineno="18" slineno="0-18"><bold>76-10-503</bold>, as last amended by Laws of Utah 2023, First Special Session, Chapter 2</sn></saamd></sa></lt><enacthead lineno="19"/><enact numlevel="1" lineno="20" slineno="0-20">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" num="76-10-503" type="amend" src="code" uid="C76-10-S503_2025050720250507" sort="76 10 05030020250507" style="" numlevel="1" lineno="21" slineno="1-1" sn="1"><section number="76-10-503" numlevel="1" lineno="22" slineno="1-2" type="amend"><secline lineno="21">Section 1, Section <bold>76-10-503</bold> is amended to read:</secline><catline lineno="22"><bold>76-10-503<parens/>. Restrictions on possession, purchase, transfer, and ownership of <ln numlevel="1" lineno="23" slineno="1-3"/>dangerous weapons by certain persons -- Exceptions.</bold></catline><subsection ssid="1-1-1" dnum="1-o" numlevel="1" lineno="24" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>For purposes of this section:<subsection ssid="1-1-2" dnum="a-o" numlevel="1" lineno="25" slineno="1-5" level="2"><display>(a)</display>A Category I restricted person is a person who:<subsection ssid="1-1-3" dnum="i-o" numlevel="1" lineno="26" slineno="1-6" level="3"><display>(i)</display>has been convicted of a violent felony;</subsection><subsection ssid="1-1-4" dnum="ii-o" numlevel="1" lineno="27" slineno="1-7" level="3"><display>(ii)</display>is on probation or parole for a felony;</subsection><subsection ssid="1-1-5" dnum="iii-o" numlevel="1" lineno="28" slineno="1-8" level="3"><display>(iii)</display>is on parole from secure care, as defined in Section <xref depth="3" refnumber="80-1-102" start="0">80-1-102</xref>;</subsection><subsection ssid="1-1-6" dnum="iv-o" numlevel="1" lineno="29" slineno="1-9" level="3"><display>(iv)</display>within the last 10 years has been adjudicated under Section <xref depth="3" refnumber="80-6-701" start="0">80-6-701</xref> for an <ln numlevel="1" lineno="30" slineno="1-10"/>offense which if committed by an adult would have been a violent felony as <ln numlevel="1" lineno="31" slineno="1-11"/>defined in Section <xref depth="3" refnumber="76-3-203.5" start="0">76-3-203.5</xref>;</subsection><subsection ssid="1-1-7" dnum="v-o" numlevel="1" lineno="32" slineno="1-12" level="3"><display>(v)</display>is an alien who is illegally or unlawfully in the United States<amend anum="0" ea="amend" pairid="42" groupid="35" style="1" owner="admin" level="1" amendtag="both">, including an alien <ln numlevel="1" lineno="33" slineno="1-13"/>who has:</amend><subsection ssid="1-95" dnum="_-o:A-e" numlevel="1" lineno="34" slineno="1-14" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="36" style="1" owner="admin" level="1" amendtag="end">submitted an asylum application in accordance with 8 U.S.C. Sec. 1158 and is <ln numlevel="1" lineno="35" slineno="1-15"/>waiting for a disposition on the application; or</amend></subsection><subsection ssid="1-96" dnum="_-o:B-e" numlevel="1" lineno="36" slineno="1-16" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="42" style="1" owner="admin" level="1" amendtag="end">submitted a temporary protected status application in accordance with 8 <ln numlevel="1" lineno="37" slineno="1-17"/>U.S.C. Sec. 1254a  and is waiting for a disposition on the application</amend>; or</subsection></subsection><subsection ssid="1-1-8" dnum="vi-o" numlevel="1" lineno="38" slineno="1-18" level="3"><display>(vi)</display>is on probation for a conviction of possessing:<subsection ssid="1-1-9" dnum="A-o" numlevel="1" lineno="39" slineno="1-19" level="4"><display>(A)</display>a substance classified in Section <xref depth="3" refnumber="58-37-4" start="0">58-37-4</xref> as a Schedule I or II controlled <ln numlevel="1" lineno="40" slineno="1-20"/>substance;</subsection><subsection ssid="1-1-10" dnum="B-o" numlevel="1" lineno="41" slineno="1-21" level="4"><display>(B)</display>a controlled substance analog; or</subsection><subsection ssid="1-1-11" dnum="C-o" numlevel="1" lineno="42" slineno="1-22" level="4"><display>(C)</display>a substance listed in Section <xref depth="3" refnumber="58-37-4.2" start="0">58-37-4.2</xref>.</subsection></subsection></subsection><subsection ssid="1-1-12" dnum="b-o" numlevel="1" lineno="43" slineno="1-23" level="2"><display>(b)</display>A Category II restricted person is a person who:<subsection ssid="1-1-13" dnum="i-o" numlevel="1" lineno="44" slineno="1-24" level="3"><display>(i)</display>has been convicted of:<subsection ssid="1-1-14" dnum="A-o" numlevel="1" lineno="45" slineno="1-25" level="4"><display>(A)</display>a domestic violence offense that is a felony;</subsection><subsection ssid="1-1-15" dnum="B-o" numlevel="1" lineno="46" slineno="1-26" level="4"><display>(B)</display>a felony that is not a domestic violence offense or a violent felony and within <ln numlevel="1" lineno="47" slineno="1-27"/>seven years after completing the sentence for the conviction, has been <ln numlevel="1" lineno="48" slineno="1-28"/>convicted of or charged with another felony or class A misdemeanor;</subsection><subsection ssid="1-1-16" dnum="C-o" numlevel="1" lineno="49" slineno="1-29" level="4"><display>(C)</display>multiple felonies that are part of a single criminal episode and are not <ln numlevel="1" lineno="50" slineno="1-30"/>domestic violence offenses or violent felonies and within seven years after <ln numlevel="1" lineno="51" slineno="1-31"/>completing the sentence for the convictions, has been convicted of or charged <ln numlevel="1" lineno="52" slineno="1-32"/>with another felony or class A misdemeanor; or</subsection><subsection ssid="1-1-17" dnum="D-o" numlevel="1" lineno="53" slineno="1-33" level="4"><display>(D)</display>multiple felonies that are not part of a single criminal episode;</subsection></subsection><subsection ssid="1-1-18" dnum="ii-o" numlevel="1" lineno="54" slineno="1-34" level="3" space="false"><display>(ii)</display><subsection ssid="1-1-19" dnum="A-o" level="4" placement="sameline"><display>(A)</display>within the last seven years has completed a sentence for:<subsection ssid="1-1-20" dnum="I-o" numlevel="1" lineno="55" slineno="1-35" level="5" tab="1"><display>(I)</display>a conviction for a felony that is not a domestic violence offense or a violent <ln numlevel="1" lineno="56" slineno="1-36"/>felony; or</subsection><subsection ssid="1-1-21" dnum="II-o" numlevel="1" lineno="57" slineno="1-37" level="5" tab="1"><display>(II)</display>convictions for multiple felonies that are part of a single criminal episode <ln numlevel="1" lineno="58" slineno="1-38"/>and are not domestic violence offenses or violent felonies; and</subsection></subsection><subsection ssid="1-1-22" dnum="B-o" numlevel="1" lineno="59" slineno="1-39" level="4"><display>(B)</display>within the last seven years and after the completion of a sentence for a <ln numlevel="1" lineno="60" slineno="1-40"/>conviction described in Subsection <xref depth="4" refnumber="76-10-503(1)(b)(ii)(A)" start="0">(1)(b)(ii)(A)</xref>, has not been convicted of or <ln numlevel="1" lineno="61" slineno="1-41"/>charged with another felony or class A misdemeanor;</subsection></subsection><subsection ssid="1-1-23" dnum="iii-o" numlevel="1" lineno="62" slineno="1-42" level="3"><display>(iii)</display>within the last seven years has been adjudicated delinquent for an offense which <ln numlevel="1" lineno="63" slineno="1-43"/>if committed by an adult would have been a felony;</subsection><subsection ssid="1-1-24" dnum="iv-o" numlevel="1" lineno="64" slineno="1-44" level="3"><display>(iv)</display>is an unlawful user of a controlled substance as defined in Section <xref depth="3" refnumber="58-37-2" start="0">58-37-2</xref>;</subsection><subsection ssid="1-1-25" dnum="v-o" numlevel="1" lineno="65" slineno="1-45" level="3"><display>(v)</display>is in possession of a dangerous weapon and is knowingly and intentionally in <ln numlevel="1" lineno="66" slineno="1-46"/>unlawful possession of a Schedule I or II controlled substance as defined in <ln numlevel="1" lineno="67" slineno="1-47"/>Section <xref depth="3" refnumber="58-37-2" start="0">58-37-2</xref>;</subsection><subsection ssid="1-1-26" dnum="vi-o" numlevel="1" lineno="68" slineno="1-48" level="3"><display>(vi)</display>has been found not guilty by reason of insanity for a felony offense;</subsection><subsection ssid="1-1-27" dnum="vii-o" numlevel="1" lineno="69" slineno="1-49" level="3"><display>(vii)</display>has been found mentally incompetent to stand trial for a felony offense;</subsection><subsection ssid="1-1-28" dnum="viii-o" numlevel="1" lineno="70" slineno="1-50" level="3"><display>(viii)</display>has been adjudicated as mentally defective as provided in the Brady Handgun <ln numlevel="1" lineno="71" slineno="1-51"/>Violence Prevention Act, Pub. L. No. 103-159, 107 Stat. 1536 (1993), or has been <ln numlevel="1" lineno="72" slineno="1-52"/>committed to a mental institution;</subsection><subsection ssid="1-1-29" dnum="ix-o" numlevel="1" lineno="73" slineno="1-53" level="3"><display>(ix)</display>has been dishonorably discharged from the armed forces;</subsection><subsection ssid="1-1-30" dnum="x-o" numlevel="1" lineno="74" slineno="1-54" level="3"><display>(x)</display>has renounced the individual's citizenship after having been a citizen of the <ln numlevel="1" lineno="75" slineno="1-55"/>United States;</subsection><subsection ssid="1-1-31" dnum="xi-o" numlevel="1" lineno="76" slineno="1-56" level="3"><display>(xi)</display>is a respondent or defendant subject to a protective order or child protective order <ln numlevel="1" lineno="77" slineno="1-57"/>that is issued after a hearing for which the respondent or defendant received actual <ln numlevel="1" lineno="78" slineno="1-58"/>notice and at which the respondent or defendant has an opportunity to participate, <ln numlevel="1" lineno="79" slineno="1-59"/>that restrains the respondent or defendant from harassing, stalking, threatening, or <ln numlevel="1" lineno="80" slineno="1-60"/>engaging in other conduct that would place an intimate partner, as defined in 18 <ln numlevel="1" lineno="81" slineno="1-61"/>U.S.C. Sec. 921, or a child of the intimate partner, in reasonable fear of bodily <ln numlevel="1" lineno="82" slineno="1-62"/>injury to the intimate partner or child of the intimate partner, and that:<subsection ssid="1-1-32" dnum="A-o" numlevel="1" lineno="83" slineno="1-63" level="4"><display>(A)</display>includes a finding that the respondent or defendant represents a credible threat <ln numlevel="1" lineno="84" slineno="1-64"/>to the physical safety of an individual who meets the definition of an intimate <ln numlevel="1" lineno="85" slineno="1-65"/>partner in 18 U.S.C. Sec. 921 or the child of the individual; or</subsection><subsection ssid="1-1-33" dnum="B-o" numlevel="1" lineno="86" slineno="1-66" level="4"><display>(B)</display>explicitly prohibits the use, attempted use, or threatened use of physical force <ln numlevel="1" lineno="87" slineno="1-67"/>that would reasonably be expected to cause bodily harm against an intimate <ln numlevel="1" lineno="88" slineno="1-68"/>partner or the child of an intimate partner; or</subsection></subsection><subsection ssid="1-1-34" dnum="xii-o" numlevel="1" lineno="89" slineno="1-69" level="3"><display>(xii)</display>except as provided in Subsection <xref depth="4" refnumber="76-10-503(1)(d)" start="0">(1)(d)</xref>, has been convicted of the commission <ln numlevel="1" lineno="90" slineno="1-70"/>or attempted commission of misdemeanor assault under Section <xref depth="3" refnumber="76-5-102" start="0">76-5-102</xref> or <ln numlevel="1" lineno="91" slineno="1-71"/>aggravated assault under Section <xref depth="3" refnumber="76-5-103" start="0">76-5-103</xref> against an individual:<subsection ssid="1-1-35" dnum="A-o" numlevel="1" lineno="92" slineno="1-72" level="4"><display>(A)</display>who is a current or former spouse, parent, or guardian;</subsection><subsection ssid="1-1-36" dnum="B-o" numlevel="1" lineno="93" slineno="1-73" level="4"><display>(B)</display>with whom the restricted person shares a child in common;</subsection><subsection ssid="1-1-37" dnum="C-o" numlevel="1" lineno="94" slineno="1-74" level="4"><display>(C)</display>who is cohabitating or has cohabitated with the restricted person as a spouse, <ln numlevel="1" lineno="95" slineno="1-75"/>parent, or guardian;</subsection><subsection ssid="1-1-38" dnum="D-o" numlevel="1" lineno="96" slineno="1-76" level="4"><display>(D)</display>involved in a dating relationship with the restricted person within the last five <ln numlevel="1" lineno="97" slineno="1-77"/>years; or</subsection><subsection ssid="1-1-39" dnum="E-o" numlevel="1" lineno="98" slineno="1-78" level="4"><display>(E)</display>similarly situated to a spouse, parent, or guardian of the restricted person.</subsection></subsection></subsection><subsection ssid="1-1-40" dnum="c-o" numlevel="1" lineno="99" slineno="1-79" level="2" space="false"><display>(c)</display><subsection ssid="1-1-41" dnum="i-o" level="3" placement="sameline"><display>(i)</display>As used in this section, a conviction of a felony or adjudication of delinquency <ln numlevel="1" lineno="100" slineno="1-80"/>for an offense which would be a felony if committed by an adult does not include:<subsection ssid="1-1-42" dnum="A-o" numlevel="1" lineno="101" slineno="1-81" level="4" tab="1"><display>(A)</display>a conviction or an adjudication under Section <xref depth="3" refnumber="80-6-701" start="0">80-6-701</xref> for an offense <ln numlevel="1" lineno="102" slineno="1-82"/>pertaining to antitrust violations, unfair trade practices, restraint of trade, or <ln numlevel="1" lineno="103" slineno="1-83"/>other similar offenses relating to the regulation of business practices not <ln numlevel="1" lineno="104" slineno="1-84"/>involving theft or fraud; or</subsection><subsection ssid="1-1-43" dnum="B-o" numlevel="1" lineno="105" slineno="1-85" level="4" tab="1"><display>(B)</display>a conviction or an adjudication under Section <xref depth="3" refnumber="80-6-701" start="0">80-6-701</xref> which, in accordance <ln numlevel="1" lineno="106" slineno="1-86"/>with the law of the jurisdiction in which the conviction or adjudication <ln numlevel="1" lineno="107" slineno="1-87"/>occurred, has been expunged, set aside, reduced to a misdemeanor by court <ln numlevel="1" lineno="108" slineno="1-88"/>order, pardoned or regarding which the person's civil rights have been restored <ln numlevel="1" lineno="109" slineno="1-89"/>unless the pardon, reduction, expungement, or restoration of civil rights <ln numlevel="1" lineno="110" slineno="1-90"/>expressly provides that the person may not ship, transport, possess, or receive <ln numlevel="1" lineno="111" slineno="1-91"/>firearms.</subsection></subsection><subsection ssid="1-1-44" dnum="ii-o" numlevel="1" lineno="112" slineno="1-92" level="3"><display>(ii)</display>As used in this section, a conviction for misdemeanor assault under Subsection <xref depth="4" refnumber="76-10-503(1)(b)(xii)" start="0"><ln numlevel="1" lineno="113" slineno="1-93"/>(1)(b)(xii)</xref>, does not include a conviction which, in accordance with the law of the <ln numlevel="1" lineno="114" slineno="1-94"/>jurisdiction in which the conviction occurred, has been expunged, set aside, <ln numlevel="1" lineno="115" slineno="1-95"/>reduced to an infraction by court order, pardoned, or regarding which the person's <ln numlevel="1" lineno="116" slineno="1-96"/>civil rights have been restored, unless the pardon, reduction, expungement, or <ln numlevel="1" lineno="117" slineno="1-97"/>restoration of civil rights expressly provides that the person may not ship, <ln numlevel="1" lineno="118" slineno="1-98"/>transport, possess, or receive firearms.</subsection><subsection ssid="1-1-45" dnum="iii-o" numlevel="1" lineno="119" slineno="1-99" level="3"><display>(iii)</display>It is the burden of the defendant in a criminal case to provide evidence that a <ln numlevel="1" lineno="120" slineno="1-100"/>conviction or an adjudication under Section <xref depth="3" refnumber="80-6-701" start="0">80-6-701</xref> is subject to an exception <ln numlevel="1" lineno="121" slineno="1-101"/>provided in this Subsection <xref depth="4" refnumber="76-10-503(1)(c)" start="0">(1)(c)</xref>, after which it is the burden of the state to prove <ln numlevel="1" lineno="122" slineno="1-102"/>beyond a reasonable doubt that the conviction or the adjudication is not subject to <ln numlevel="1" lineno="123" slineno="1-103"/>that exception.</subsection></subsection><subsection ssid="1-1-46" dnum="d-o" numlevel="1" lineno="124" slineno="1-104" level="2"><display>(d)</display>A person is not a restricted person for a conviction under Subsection <xref depth="4" refnumber="76-10-503(1)(b)(xii)(D)" start="0">(1)(b)(xii)(D)</xref> if:<subsection ssid="1-1-47" dnum="i-o" numlevel="1" lineno="125" slineno="1-105" level="3"><display>(i)</display>five years have elapsed from the later of:<subsection ssid="1-1-48" dnum="A-o" numlevel="1" lineno="126" slineno="1-106" level="4"><display>(A)</display>the day on which the conviction is entered;</subsection><subsection ssid="1-1-49" dnum="B-o" numlevel="1" lineno="127" slineno="1-107" level="4"><display>(B)</display>the day on which the person is released from incarceration following the <ln numlevel="1" lineno="128" slineno="1-108"/>conviction; or</subsection><subsection ssid="1-1-50" dnum="C-o" numlevel="1" lineno="129" slineno="1-109" level="4"><display>(C)</display>the day on which the person's probation for the conviction is successfully <ln numlevel="1" lineno="130" slineno="1-110"/>terminated;</subsection></subsection><subsection ssid="1-1-51" dnum="ii-o" numlevel="1" lineno="131" slineno="1-111" level="3"><display>(ii)</display>the person only has a single conviction for misdemeanor assault as described in <ln numlevel="1" lineno="132" slineno="1-112"/>Subsection <xref depth="4" refnumber="76-10-503(1)(b)(xii)(D)" start="0">(1)(b)(xii)(D)</xref>; and</subsection><subsection ssid="1-1-52" dnum="iii-o" numlevel="1" lineno="133" slineno="1-113" level="3"><display>(iii)</display>the person is not otherwise a restricted person under Subsection <xref depth="4" refnumber="76-10-503(1)(a)" start="0">(1)(a)</xref> or <xref depth="4" refnumber="76-10-503(1)(b)" start="0">(b)</xref>.</subsection></subsection></subsection><subsection ssid="1-1-53" dnum="2-o" numlevel="1" lineno="134" slineno="1-114" level="1"><display>(2)</display>A Category I restricted person who intentionally or knowingly agrees, consents, offers, <ln numlevel="1" lineno="135" slineno="1-115"/>or arranges to purchase, transfer, possess, use, or have under the person's custody or <ln numlevel="1" lineno="136" slineno="1-116"/>control, or who intentionally or knowingly purchases, transfers, possesses, uses, or has <ln numlevel="1" lineno="137" slineno="1-117"/>under the person's custody or control:<subsection ssid="1-1-54" dnum="a-o" numlevel="1" lineno="138" slineno="1-118" level="2"><display>(a)</display>a firearm is guilty of a second degree felony; or</subsection><subsection ssid="1-1-55" dnum="b-o" numlevel="1" lineno="139" slineno="1-119" level="2"><display>(b)</display>a dangerous weapon other than a firearm is guilty of a third degree felony.</subsection></subsection><subsection ssid="1-1-56" dnum="3-o" numlevel="1" lineno="140" slineno="1-120" level="1"><display>(3)</display>A Category II restricted person who intentionally or knowingly purchases, transfers, <ln numlevel="1" lineno="141" slineno="1-121"/>possesses, uses, or has under the person's custody or control:<subsection ssid="1-1-57" dnum="a-o" numlevel="1" lineno="142" slineno="1-122" level="2"><display>(a)</display>a firearm is guilty of a third degree felony; or</subsection><subsection ssid="1-1-58" dnum="b-o" numlevel="1" lineno="143" slineno="1-123" level="2"><display>(b)</display>a dangerous weapon other than a firearm is guilty of a class A misdemeanor.</subsection></subsection><subsection ssid="1-1-59" dnum="4-o" numlevel="1" lineno="144" slineno="1-124" level="1"><display>(4)</display>A person may be subject to the restrictions of both categories at the same time.</subsection><subsection ssid="1-1-60" dnum="5-o" numlevel="1" lineno="145" slineno="1-125" level="1"><display>(5)</display>A Category I or Category II restricted person may not use an antique firearm for an <ln numlevel="1" lineno="146" slineno="1-126"/>activity regulated under <xref depth="0" refnumber="23A" start="0">Title 23A, Wildlife Resources Act</xref>.</subsection><subsection ssid="1-1-61" dnum="6-o" numlevel="1" lineno="147" slineno="1-127" level="1"><display>(6)</display>If a higher penalty than is prescribed in this section is provided in another section for <ln numlevel="1" lineno="148" slineno="1-128"/>one who purchases, transfers, possesses, uses, or has under this custody or control a <ln numlevel="1" lineno="149" slineno="1-129"/>dangerous weapon, the penalties of that section control.</subsection><subsection ssid="1-1-62" dnum="7-o" numlevel="1" lineno="150" slineno="1-130" level="1"><display>(7)</display>It is an affirmative defense to a charge based on the definition in Subsection <xref depth="4" refnumber="76-10-503(1)(b)(v)" start="0">(1)(b)(v)</xref> <ln numlevel="1" lineno="151" slineno="1-131"/>that the person was:<subsection ssid="1-1-63" dnum="a-o" numlevel="1" lineno="152" slineno="1-132" level="2"><display>(a)</display>in possession of a controlled substance pursuant to a lawful order of a practitioner for <ln numlevel="1" lineno="153" slineno="1-133"/>use of a member of the person's household or for administration to an animal owned <ln numlevel="1" lineno="154" slineno="1-134"/>by the person or a member of the person's household; or</subsection><subsection ssid="1-1-64" dnum="b-o" numlevel="1" lineno="155" slineno="1-135" level="2"><display>(b)</display>otherwise authorized by law to possess the substance.</subsection></subsection><subsection ssid="1-1-65" dnum="8-o" numlevel="1" lineno="156" slineno="1-136" level="1" space="false"><display>(8)</display><subsection ssid="1-1-66" dnum="a-o" level="2" placement="sameline"><display>(a)</display>It is an affirmative defense to transferring a firearm or other dangerous weapon by <ln numlevel="1" lineno="157" slineno="1-137"/>a person restricted under Subsection <xref depth="4" refnumber="76-10-503(2)" start="0">(2)</xref> or <xref depth="4" refnumber="76-10-503(3)" start="0">(3)</xref> that the firearm or dangerous weapon:<subsection ssid="1-1-67" dnum="i-o" numlevel="1" lineno="158" slineno="1-138" level="3" tab="1"><display>(i)</display>was possessed by the person or was under the person's custody or control before <ln numlevel="1" lineno="159" slineno="1-139"/>the person became a restricted person;</subsection><subsection ssid="1-1-68" dnum="ii-o" numlevel="1" lineno="160" slineno="1-140" level="3" tab="1"><display>(ii)</display>was not used in or possessed during the commission of a crime or subject to <ln numlevel="1" lineno="161" slineno="1-141"/>disposition under Section <xref depth="2" refnumber="77-11a-4" start="0">Title 77, Chapter 11a, Part 4, Disposal of Seized <ln numlevel="1" lineno="162" slineno="1-142"/>Property and Contraband</xref>;</subsection><subsection ssid="1-1-69" dnum="iii-o" numlevel="1" lineno="163" slineno="1-143" level="3" tab="1"><display>(iii)</display>is not being held as evidence by a court or law enforcement agency;</subsection><subsection ssid="1-1-70" dnum="iv-o" numlevel="1" lineno="164" slineno="1-144" level="3" tab="1"><display>(iv)</display>was transferred to a person not legally prohibited from possessing the weapon; <ln numlevel="1" lineno="165" slineno="1-145"/>and</subsection><subsection ssid="1-1-71" dnum="v-o" numlevel="1" lineno="166" slineno="1-146" level="3" tab="1"><display>(v)</display>unless a different time is ordered by the court, was transferred within 10 days of <ln numlevel="1" lineno="167" slineno="1-147"/>the person becoming a restricted person.</subsection></subsection><subsection ssid="1-1-72" dnum="b-o" numlevel="1" lineno="168" slineno="1-148" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="76-10-503(8)(a)" start="0">(8)(a)</xref> is not a defense to the use, purchase, or possession on the person of <ln numlevel="1" lineno="169" slineno="1-149"/>a firearm or other dangerous weapon by a restricted person.</subsection></subsection><subsection ssid="1-1-73" dnum="9-o" numlevel="1" lineno="170" slineno="1-150" level="1" space="false"><display>(9)</display><subsection ssid="1-1-74" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A person may not sell, transfer, or otherwise dispose of a firearm or dangerous <ln numlevel="1" lineno="171" slineno="1-151"/>weapon to a person, knowing that the recipient is a person described in Subsection <xref depth="4" refnumber="76-10-503(1)(a)" start="0"><ln numlevel="1" lineno="172" slineno="1-152"/>(1)(a)</xref> or <xref depth="4" refnumber="76-10-503(1)(b)" start="0">(b)</xref>.</subsection><subsection ssid="1-1-75" dnum="b-o" numlevel="1" lineno="173" slineno="1-153" level="2"><display>(b)</display>A person who violates Subsection <xref depth="4" refnumber="76-10-503(9)(a)" start="0">(9)(a)</xref> when the recipient is:<subsection ssid="1-1-76" dnum="i-o" numlevel="1" lineno="174" slineno="1-154" level="3"><display>(i)</display>a person described in Subsection <xref depth="4" refnumber="76-10-503(1)(a)" start="0">(1)(a)</xref> and the transaction involves a firearm, is <ln numlevel="1" lineno="175" slineno="1-155"/>guilty of a second degree felony;</subsection><subsection ssid="1-1-77" dnum="ii-o" numlevel="1" lineno="176" slineno="1-156" level="3"><display>(ii)</display>a person described in Subsection <xref depth="4" refnumber="76-10-503(1)(a)" start="0">(1)(a)</xref> and the transaction involves a dangerous <ln numlevel="1" lineno="177" slineno="1-157"/>weapon other than a firearm, and the transferor has knowledge that the recipient <ln numlevel="1" lineno="178" slineno="1-158"/>intends to use the weapon for any unlawful purpose, is guilty of a third degree <ln numlevel="1" lineno="179" slineno="1-159"/>felony;</subsection><subsection ssid="1-1-78" dnum="iii-o" numlevel="1" lineno="180" slineno="1-160" level="3"><display>(iii)</display>a person described in Subsection <xref depth="4" refnumber="76-10-503(1)(b)" start="0">(1)(b)</xref> and the transaction involves a firearm, is <ln numlevel="1" lineno="181" slineno="1-161"/>guilty of a third degree felony; or</subsection><subsection ssid="1-1-79" dnum="iv-o" numlevel="1" lineno="182" slineno="1-162" level="3"><display>(iv)</display>a person described in Subsection <xref depth="4" refnumber="76-10-503(1)(b)" start="0">(1)(b)</xref> and the transaction involves a dangerous <ln numlevel="1" lineno="183" slineno="1-163"/>weapon other than a firearm, and the transferor has knowledge that the recipient <ln numlevel="1" lineno="184" slineno="1-164"/>intends to use the weapon for an unlawful purpose, is guilty of a class A <ln numlevel="1" lineno="185" slineno="1-165"/>misdemeanor.</subsection></subsection></subsection><subsection ssid="1-1-80" dnum="10-o" numlevel="1" lineno="186" slineno="1-166" level="1" space="false"><display>(10)</display><subsection ssid="1-1-81" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A person may not knowingly solicit, persuade, encourage or entice a dealer or <ln numlevel="1" lineno="187" slineno="1-167"/>other person to sell, transfer or otherwise dispose of a firearm or dangerous weapon <ln numlevel="1" lineno="188" slineno="1-168"/>under circumstances which the person knows would be a violation of the law.</subsection><subsection ssid="1-1-82" dnum="b-o" numlevel="1" lineno="189" slineno="1-169" level="2"><display>(b)</display>A person may not provide to a dealer or other person information that the person <ln numlevel="1" lineno="190" slineno="1-170"/>knows to be materially false information with intent to deceive the dealer or other <ln numlevel="1" lineno="191" slineno="1-171"/>person about the legality of a sale, transfer or other disposition of a firearm or <ln numlevel="1" lineno="192" slineno="1-172"/>dangerous weapon.</subsection><subsection ssid="1-1-83" dnum="c-o" numlevel="1" lineno="193" slineno="1-173" level="2"><display>(c)</display>"Materially false information" means information that portrays an illegal transaction <ln numlevel="1" lineno="194" slineno="1-174"/>as legal or a legal transaction as illegal.</subsection><subsection ssid="1-1-84" dnum="d-o" numlevel="1" lineno="195" slineno="1-175" level="2"><display>(d)</display>A person who violates this Subsection <xref depth="4" refnumber="76-10-503(10)" start="0">(10)</xref> is guilty of:<subsection ssid="1-1-85" dnum="i-o" numlevel="1" lineno="196" slineno="1-176" level="3"><display>(i)</display>a third degree felony if the transaction involved a firearm; or</subsection><subsection ssid="1-1-86" dnum="ii-o" numlevel="1" lineno="197" slineno="1-177" level="3"><display>(ii)</display>a class A misdemeanor if the transaction involved a dangerous weapon other than <ln numlevel="1" lineno="198" slineno="1-178"/>a firearm.</subsection></subsection></subsection></section></bsec><bsec buid="4" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="199" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="199">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="200"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="shadlarson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>3-14-25 1:35 PM</tm></rev></foot></leg>
