Eligibility and residency requirements for county, district, precinct, or <ln numlevel="1" lineno="27" slineno="1-3"/>prosecution district office.</bold></catline><subsection ssid="17-17-1" dnum="1-o" numlevel="1" lineno="28" slineno="1-4" level="1" placement="noreturn"><display>(1)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="18" style="2" owner="admin" level="1" deltag="start">A </amend><amend anum="0" ea="erase" pairid="22" groupid="20" style="2" owner="admin" level="1" deltag="end">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="15" style="1" owner="admin" level="1" amendtag="both" space="true">An individual</amend> filing a declaration of candidacy for a county, district, <ln numlevel="1" lineno="29" slineno="1-5"/>precinct, or prosecution district office shall:<subsection ssid="17-17-2" dnum="a-o" numlevel="1" lineno="30" slineno="1-6" level="2"><display>(a)</display>be a United States citizen;</subsection><subsection ssid="17-17-3" dnum="b-o" numlevel="1" lineno="31" slineno="1-7" level="2"><display>(b)</display>except as provided in Section <xref depth="3" refnumber="20A-1-509.2" start="0">20A-1-509.2</xref> with respect to the office of county <ln numlevel="1" lineno="32" slineno="1-8"/>attorney or district attorney, as of the date of the election, have been a resident for at <ln numlevel="1" lineno="33" slineno="1-9"/>least one year of the county, district, precinct, or prosecution district in which the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="21" style="2" owner="admin" level="1" deltag="both"><ln numlevel="1" lineno="34" slineno="1-10"/>person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="16" style="1" owner="admin" level="1" amendtag="both" space="true">individual</amend> seeks office;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="11" style="2" owner="admin" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="17-17-4" dnum="c-o" numlevel="1" lineno="35" slineno="1-11" level="2"><display>(c)</display>be a registered voter in the county, district, precinct, or prosecution district in which <ln numlevel="1" lineno="36" slineno="1-12"/>the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="23" style="2" owner="admin" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="17" style="1" owner="admin" level="1" amendtag="both" space="true">individual</amend> seeks office<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="admin" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="admin" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="17-8" dnum="_-o:d-e" numlevel="1" lineno="37" slineno="1-13" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="admin" level="1" amendtag="end">if the individual is filing a declaration of candidacy for the office of county auditor in <ln numlevel="1" lineno="38" slineno="1-14"/>a county of the first class, meet the qualifications described in Section <xref depth="3" refnumber="17-19a-201.5">17-19a-201.5</xref>.</amend></subsection></subsection><subsection ssid="17-17-5" dnum="2-o" numlevel="1" lineno="39" slineno="1-15" level="1" space="false"><display>(2)</display><subsection ssid="17-17-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A county, district, precinct, or prosecution district officer shall maintain residency <ln numlevel="1" lineno="40" slineno="1-16"/>within the county, district, precinct, or prosecution district in which the officer was <ln numlevel="1" lineno="41" slineno="1-17"/>elected during the officer's term of office.</subsection><subsection ssid="17-17-7" dnum="b-o" numlevel="1" lineno="42" slineno="1-18" level="2"><display>(b)</display>If a county, district, precinct, or prosecution district officer establishes the officer's <ln numlevel="1" lineno="43" slineno="1-19"/>principal place of residence as provided in Section <xref depth="3" refnumber="20A-2-105" start="0">20A-2-105</xref> outside the county, <ln numlevel="1" lineno="44" slineno="1-20"/>district, precinct, or prosecution district in which the officer was elected, the office is <ln numlevel="1" lineno="45" slineno="1-21"/>automatically vacant.</subsection></subsection></section></bsec><bsec buid="19" num="17-19a-102" type="amend" src="code" uid="C17-19a-S102_2025050720250507" sort="17 19a01020020250507" numlevel="1" lineno="46" slineno="2-1" sn="2"><section number="17-19a-102" numlevel="1" lineno="47" slineno="2-2" type="amend"><secline lineno="46">Section 2, Section <bold>17-19a-102</bold> is amended to read:</secline><catline lineno="47"><bold>17-19a-102<parens/>. Definitions.</bold></catline><sectionText lineno="48"><tab/>As used in this chapter:</sectionText><subsection ssid="19-19-1" dnum="1-o" numlevel="1" lineno="49" slineno="2-4" level="1"><display>(1)</display>"Account" or "accounting" means:<subsection ssid="19-19-2" dnum="a-o" numlevel="1" lineno="50" slineno="2-5" level="2"><display>(a)</display>the systematic recording, classification, or summarizing of a financial transaction or <ln numlevel="1" lineno="51" slineno="2-6"/>event; and</subsection><subsection ssid="19-19-3" dnum="b-o" numlevel="1" lineno="52" slineno="2-7" level="2"><display>(b)</display>the interpretation or presentation of the result of an action described in Subsection <xref depth="4" refnumber="17-19a-102(1)(a)" start="0"><ln numlevel="1" lineno="53" slineno="2-8"/>(1)(a)</xref>.</subsection></subsection><subsection ssid="19-19-4" dnum="2-o" numlevel="1" lineno="54" slineno="2-9" level="1" space="false"><display>(2)</display><subsection ssid="19-19-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Accounting services" means the creation, modification, or deletion of <ln numlevel="1" lineno="55" slineno="2-10"/>transactions and records in a financial accounting system, including the preparation <ln numlevel="1" lineno="56" slineno="2-11"/>of a county's annual financial report.</subsection><subsection ssid="19-19-6" dnum="b-o" numlevel="1" lineno="57" slineno="2-12" level="2"><display>(b)</display>"Accounting services" does not include the creation of a purchase order.</subsection></subsection><subsection ssid="19-19-7" dnum="3-o" numlevel="1" lineno="58" slineno="2-13" level="1"><display>(3)</display>"Audit" or "auditing" means an examination that is a formal analysis of a county <ln numlevel="1" lineno="59" slineno="2-14"/>account or county financial record:<subsection ssid="19-19-8" dnum="a-o" numlevel="1" lineno="60" slineno="2-15" level="2"><display>(a)</display>to verify accuracy, completeness, or compliance with an internal control;</subsection><subsection ssid="19-19-9" dnum="b-o" numlevel="1" lineno="61" slineno="2-16" level="2"><display>(b)</display>to give a fair presentation of a county's financial status; and</subsection><subsection ssid="19-19-10" dnum="c-o" numlevel="1" lineno="62" slineno="2-17" level="2"><display>(c)</display>that conforms to the uniform classification of accounts established by the state <ln numlevel="1" lineno="63" slineno="2-18"/>auditor.</subsection></subsection><subsection ssid="19-19-11" dnum="4-o" numlevel="1" lineno="64" slineno="2-19" level="1"><display>(4)</display>"Book" means a financial record of the county, regardless of a record's format.</subsection><subsection ssid="19-19-12" dnum="5-o" numlevel="1" lineno="65" slineno="2-20" level="1" space="false"><display>(5)</display><subsection ssid="19-19-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Budget" or "budgeting" means the preparation or presentation of a proposed or <ln numlevel="1" lineno="66" slineno="2-21"/>tentative budget as provided in <xref depth="1" refnumber="17-36" start="1">Chapter 36, Uniform Fiscal Procedures Act for <ln numlevel="1" lineno="67" slineno="2-22"/>Counties</xref>.</subsection><subsection ssid="19-19-14" dnum="b-o" numlevel="1" lineno="68" slineno="2-23" level="2"><display>(b)</display>"Budget" or "budgeting" includes:<subsection ssid="19-19-15" dnum="i-o" numlevel="1" lineno="69" slineno="2-24" level="3"><display>(i)</display>a revenue projection;</subsection><subsection ssid="19-19-16" dnum="ii-o" numlevel="1" lineno="70" slineno="2-25" level="3"><display>(ii)</display>a budget request compilation; or</subsection><subsection ssid="19-19-17" dnum="iii-o" numlevel="1" lineno="71" slineno="2-26" level="3"><display>(iii)</display>the performance of an activity described in Subsection <xref depth="4" refnumber="17-19a-102(5)(b)(i)" start="0">(5)(b)(i)</xref> or <xref depth="4" refnumber="17-19a-102(5)(b)(ii)" start="0">(ii)</xref>.</subsection></subsection></subsection><subsection ssid="19-19-18" dnum="6-o" numlevel="1" lineno="72" slineno="2-27" level="1" space="false"><display>(6)</display><subsection ssid="19-19-19" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Claim" means under the color of law:<subsection ssid="19-19-20" dnum="i-o" numlevel="1" lineno="73" slineno="2-28" level="3" tab="1"><display>(i)</display>a demand presented for money or damages; or</subsection><subsection ssid="19-19-21" dnum="ii-o" numlevel="1" lineno="74" slineno="2-29" level="3" tab="1"><display>(ii)</display>a cause of action presented for money or damages.</subsection></subsection><subsection ssid="19-19-22" dnum="b-o" numlevel="1" lineno="75" slineno="2-30" level="2"><display>(b)</display>"Claim" does not mean a routine, uncontested, or regular payment, including a bill, <ln numlevel="1" lineno="76" slineno="2-31"/>purchase, or payroll.</subsection></subsection><subsection ssid="19-19-23" dnum="7-o" numlevel="1" lineno="77" slineno="2-32" level="1" space="false"><display>(7)</display><subsection ssid="19-19-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"County auditor" means the county officer elected as the county auditor under <ln numlevel="1" lineno="78" slineno="2-33"/>Section <xref depth="3" refnumber="17-53-101" start="0">17-53-101</xref>.</subsection><subsection ssid="19-19-25" dnum="b-o" numlevel="1" lineno="79" slineno="2-34" level="2"><display>(b)</display>"County auditor" includes <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="admin" level="1" deltag="start">a </amend><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="admin" level="1" deltag="end">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="admin" level="1" amendtag="both" space="true">an individual</amend> given the title of county <ln numlevel="1" lineno="80" slineno="2-35"/>controller under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="17-19a-202(6)" start="0">17-19a-202(6)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true"><xref tempid="425" depth="4" refnumber="17-19a-202(4)">17-19a-202(4)</xref></amend>.</subsection></subsection><subsection ssid="19-19-26" dnum="8-o" numlevel="1" lineno="81" slineno="2-36" level="1"><display>(8)</display>"County executive" means the elected chief executive officer of a county.</subsection><subsection ssid="19-19-27" dnum="9-o" numlevel="1" lineno="82" slineno="2-37" level="1"><display>(9)</display>"Performance audit" means an assessment of whether a county office, officer, <ln numlevel="1" lineno="83" slineno="2-38"/>department, division, court, or entity, or any related county program is:<subsection ssid="19-19-28" dnum="a-o" numlevel="1" lineno="84" slineno="2-39" level="2"><display>(a)</display>managing public resources and exercising authority in compliance with law and <ln numlevel="1" lineno="85" slineno="2-40"/>policy;</subsection><subsection ssid="19-19-29" dnum="b-o" numlevel="1" lineno="86" slineno="2-41" level="2"><display>(b)</display>achieving objectives and desired outcomes; and</subsection><subsection ssid="19-19-30" dnum="c-o" numlevel="1" lineno="87" slineno="2-42" level="2"><display>(c)</display>providing services effectively, efficiently, economically, ethically, and equitably.</subsection></subsection></section></bsec><bsec buid="14" num="17-19a-201.5" type="enact" src="code" uid="C17-19a-S201.5_2025050720250507" sort="17 19a02010520250507" numlevel="1" lineno="88" slineno="3-1" sn="3"><section numlevel="1" lineno="89" slineno="3-2" number="17-19a-201.5" type="enact"><secline lineno="88">Section 3, Section <bold>17-19a-201.5</bold> is enacted to read:</secline><catline lineno="89"><bold>17-19a-201.5<parens/>. Qualifications for a county auditor in a county of the first class.</bold></catline><subsection ssid="14-13" dnum="_-o:1-e" numlevel="1" lineno="90" slineno="3-3" ea="amend" anum="0" owner="admin" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="31" style="1" owner="admin" level="1" amendtag="end">In a county of the first class, in addition to the requirements described in Section <xref depth="3" refnumber="17-16-1">17-16-1</xref>, <ln numlevel="1" lineno="91" slineno="3-4"/>an individual filing a declaration of candidacy for the office of county auditor, an <ln numlevel="1" lineno="92" slineno="3-5"/>individual elected to the office of county auditor, or an interim replacement appointed <ln numlevel="1" lineno="93" slineno="3-6"/>under Subsection <xref refnumber="20A-1-508(3)" depth="4">20A-1-508(3)</xref>, shall have one or more of the following professional <ln numlevel="1" lineno="94" slineno="3-7"/>certifications active and in good standing:</amend><subsection ssid="14-2" dnum="_-o:a-e" numlevel="1" lineno="95" slineno="3-8" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="admin" level="1" amendtag="end">certified public accountant;</amend></subsection><subsection ssid="14-3" dnum="_-o:b-e" numlevel="1" lineno="96" slineno="3-9" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="16" style="1" owner="admin" level="1" amendtag="end">certified internal auditor;</amend></subsection><subsection ssid="14-4" dnum="_-o:c-e" numlevel="1" lineno="97" slineno="3-10" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="20" style="1" owner="admin" level="1" amendtag="end">certified fraud examiner;</amend></subsection><subsection ssid="14-5" dnum="_-o:d-e" numlevel="1" lineno="98" slineno="3-11" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="24" style="1" owner="admin" level="1" amendtag="end">certified management accountant; or</amend></subsection><subsection ssid="14-6" dnum="_-o:e-e" numlevel="1" lineno="99" slineno="3-12" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="e" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="28" style="1" owner="admin" level="1" amendtag="end">certified information systems auditor.</amend></subsection></subsection><subsection ssid="14-14" dnum="_-o:2-e" numlevel="1" lineno="100" slineno="3-13" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="83" groupid="35" style="1" owner="admin" level="1" amendtag="end">Subsection <xref tempid="262" depth="4" refnumber="(1)">(1)</xref> does not apply to any other position within an auditor's office, except <ln numlevel="1" lineno="101" slineno="3-14"/>that a chief deputy or other individual filling the vacancy of an elected auditor in a <ln numlevel="1" lineno="102" slineno="3-15"/>county of the first class may not be appointed as an interim replacement under <ln numlevel="1" lineno="103" slineno="3-16"/>Subsection <xref depth="4" refnumber="20A-1-508(3)">20A-1-508(3)</xref> unless the individual meets the qualifications of Subsection <xref tempid="266" depth="4" refnumber="(1)">(1)</xref> <ln numlevel="1" lineno="104" slineno="3-17"/>and Section <xref depth="3" refnumber="17-16-1">17-16-1</xref>.</amend></subsection></section></bsec><bsec buid="22" num="17-19a-202" type="amend" src="code" uid="C17-19a-S202_2025050720250507" sort="17 19a02020020250507" numlevel="1" lineno="105" slineno="4-1" sn="4"><section number="17-19a-202" numlevel="1" lineno="106" slineno="4-2" type="amend"><secline lineno="105">Section 4, Section <bold>17-19a-202</bold> is amended to read:</secline><catline lineno="106"><bold>17-19a-202<parens/>. Duties and services.</bold></catline><subsection ssid="22-14" dnum="_-o:1-e" numlevel="1" lineno="107" slineno="4-3" ea="amend" anum="0" owner="admin" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="e" level="1" amendtag="both">(1)</amend></display>A county auditor shall perform:<subsection ssid="22-22-1" dnum="1-o:a-e" numlevel="1" lineno="108" slineno="4-4" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1046" style="2" owner="o" level="1" deltag="both">(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1047" style="1" owner="e" level="1" amendtag="both" space="true">(a)</amend></display>in accordance with Section <xref depth="3" refnumber="17-19a-205" start="0">17-19a-205</xref>, an accounting duty or service described <ln numlevel="1" lineno="109" slineno="4-5"/>in this chapter or otherwise required by law;</subsection><subsection ssid="22-22-2" dnum="2-o:b-e" numlevel="1" lineno="110" slineno="4-6" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1047" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1048" style="1" owner="e" level="1" amendtag="both" space="true">(b)</amend></display>an auditing duty or service described in this chapter or otherwise required by <ln numlevel="1" lineno="111" slineno="4-7"/>law; and</subsection><subsection ssid="22-22-3" dnum="3-o:c-e" numlevel="1" lineno="112" slineno="4-8" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1048" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1049" style="1" owner="e" level="1" amendtag="both" space="true">(c)</amend></display>other duties as may be required by law.</subsection></subsection><subsection ssid="22-22-4" dnum="4-o:2-e" numlevel="1" lineno="113" slineno="4-9" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1049" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1050" style="1" owner="e" level="1" amendtag="both" space="true">(2)</amend></display>A county auditor may conduct, in relation to any county office, officer, department, <ln numlevel="1" lineno="114" slineno="4-10"/>division, court, or entity, as the county auditor deems necessary, the following duties <ln numlevel="1" lineno="115" slineno="4-11"/>and services:<subsection ssid="22-22-5" dnum="a-o" numlevel="1" lineno="116" slineno="4-12" level="2"><display>(a)</display>financial audits;</subsection><subsection ssid="22-22-6" dnum="b-o" numlevel="1" lineno="117" slineno="4-13" level="2"><display>(b)</display>attestation-level examinations, reviews, and agreed-upon procedures engagements or <ln numlevel="1" lineno="118" slineno="4-14"/>reviews of financial statements;</subsection><subsection ssid="22-22-7" dnum="c-o" numlevel="1" lineno="119" slineno="4-15" level="2"><display>(c)</display>subject to Section <xref depth="3" refnumber="17-19a-206" start="0">17-19a-206</xref>, performance audits;</subsection><subsection ssid="22-22-8" dnum="d-o" numlevel="1" lineno="120" slineno="4-16" level="2"><display>(d)</display>subject to Section <xref depth="3" refnumber="17-19a-205" start="0">17-19a-205</xref>, accounting services; and</subsection><subsection ssid="22-22-9" dnum="e-o" numlevel="1" lineno="121" slineno="4-17" level="2"><display>(e)</display>other duties as required by law.</subsection></subsection><subsection ssid="22-22-10" dnum="5-o:3-e" numlevel="1" lineno="122" slineno="4-18" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1055" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1056" style="1" owner="e" level="1" amendtag="both" space="true">(3)</amend></display>In a county of the first class, the county auditor shall conduct the services under <ln numlevel="1" lineno="123" slineno="4-19"/>Subsections <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="24" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="17-19a-202(4)(a)" start="0">(4)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="22" style="1" owner="admin" level="1" amendtag="both" space="true">(2)(a)</amend> through <xref depth="4" refnumber="17-19a-202(4)(c)" start="0">(c)</xref> in accordance with generally accepted government <ln numlevel="1" lineno="124" slineno="4-20"/>auditing standards.</subsection><subsection ssid="22-22-11" dnum="6-o:4-e" numlevel="1" lineno="125" slineno="4-21" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1056" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1057" style="1" owner="e" level="1" amendtag="both" space="true">(4)</amend></display>A county legislative body may change the title of county auditor to county <ln numlevel="1" lineno="126" slineno="4-22"/>controller for a county auditor's office that predominantly performs accounting services.</subsection><subsection ssid="22-22-12" dnum="7-o:5-e" numlevel="1" lineno="127" slineno="4-23" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1057" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1058" style="1" owner="e" level="1" amendtag="both" space="true">(5)</amend></display>The county auditor may not conduct the services described in Subsections <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="25" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="17-19a-202(4)(a)" start="0">(4)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="23" style="1" owner="admin" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="128" slineno="4-24"/>(2)(a)</amend> through <xref depth="4" refnumber="17-19a-202(4)(c)" start="0">(c)</xref> with respect to the auditor's own office, accounts, or financial records.</subsection><subsection ssid="22-22-13" dnum="8-o:6-e" numlevel="1" lineno="129" slineno="4-25" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1058" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1059" style="1" owner="e" level="1" amendtag="both" space="true">(6)</amend></display>Nothing in this chapter limits a county legislative body's authority under Section <xref depth="3" refnumber="17-53-212" start="0"><ln numlevel="1" lineno="130" slineno="4-26"/>17-53-212</xref> or a county executive's authority under Section <xref depth="3" refnumber="17-53-303" start="0">17-53-303</xref>.</subsection></section></bsec><bsec buid="24" num="20A-1-508" type="amend" src="code" uid="C20A-1-S508_2025050720250507" sort="20A01 05080020250507" numlevel="1" lineno="131" slineno="5-1" sn="5"><section number="20A-1-508" numlevel="1" lineno="132" slineno="5-2" type="amend"><secline lineno="131">Section 5, Section <bold>20A-1-508</bold> is amended to read:</secline><catline lineno="132"><bold>20A-1-508<parens/>. Midterm vacancies in county elected offices -- Temporary manager <ln numlevel="1" lineno="133" slineno="5-3"/>-- Interim replacement.</bold></catline><subsection ssid="24-24-1" dnum="1-o" numlevel="1" lineno="134" slineno="5-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="24-24-2" dnum="a-o" numlevel="1" lineno="135" slineno="5-5" level="2" space="false"><display>(a)</display><subsection ssid="24-24-3" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"County offices" includes the county executive, members of the county <ln numlevel="1" lineno="136" slineno="5-6"/>legislative body, the county treasurer, the county sheriff, the county clerk, the <ln numlevel="1" lineno="137" slineno="5-7"/>county auditor, the county recorder, the county surveyor, and the county assessor.</subsection><subsection ssid="24-24-4" dnum="ii-o" numlevel="1" lineno="138" slineno="5-8" level="3"><display>(ii)</display>"County offices" does not include the office of county attorney, district attorney, <ln numlevel="1" lineno="139" slineno="5-9"/>or judge.</subsection></subsection><subsection ssid="24-24-5" dnum="b-o" numlevel="1" lineno="140" slineno="5-10" level="2"><display>(b)</display>"Party liaison" means the political party officer designated to serve as a liaison with <ln numlevel="1" lineno="141" slineno="5-11"/>each county legislative body on all matters relating to the political party's relationship <ln numlevel="1" lineno="142" slineno="5-12"/>with a county as required by Section <xref depth="3" refnumber="20A-8-401" start="0">20A-8-401</xref>.</subsection></subsection><subsection ssid="24-24-6" dnum="2-o" numlevel="1" lineno="143" slineno="5-13" level="1" space="false"><display>(2)</display><subsection ssid="24-24-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="20A-1-508(2)(d)" start="0">(2)(d)</xref>, until a county legislative body appoints <ln numlevel="1" lineno="144" slineno="5-14"/>an interim replacement to fill a vacant county office under Subsection <xref depth="4" refnumber="20A-1-508(3)" start="0">(3)</xref>, the <ln numlevel="1" lineno="145" slineno="5-15"/>following shall temporarily discharge the duties of the county office as a temporary <ln numlevel="1" lineno="146" slineno="5-16"/>manager:<subsection ssid="24-24-8" dnum="i-o" numlevel="1" lineno="147" slineno="5-17" level="3" tab="1"><display>(i)</display>for a county office with one chief deputy, the chief deputy;</subsection><subsection ssid="24-24-9" dnum="ii-o" numlevel="1" lineno="148" slineno="5-18" level="3" tab="1"><display>(ii)</display>for a county office with more than one chief deputy:<subsection ssid="24-24-10" dnum="A-o" numlevel="1" lineno="149" slineno="5-19" level="4"><display>(A)</display>the chief deputy with the most cumulative time served as a chief deputy for <ln numlevel="1" lineno="150" slineno="5-20"/>the county office; or</subsection><subsection ssid="24-24-11" dnum="B-o" numlevel="1" lineno="151" slineno="5-21" level="4"><display>(B)</display>notwithstanding Subsection <xref depth="4" refnumber="20A-1-508(2)(a)(ii)(A)" start="0">(2)(a)(ii)(A)</xref>, if, before the vacating county officer <ln numlevel="1" lineno="152" slineno="5-22"/>vacates the office, the county officer files with the county clerk a written <ln numlevel="1" lineno="153" slineno="5-23"/>statement designating one of the county officer's chief deputies to discharge the <ln numlevel="1" lineno="154" slineno="5-24"/>duties of the county office in the event the county officer vacates the office, the <ln numlevel="1" lineno="155" slineno="5-25"/>designated chief deputy; or</subsection></subsection><subsection ssid="24-24-12" dnum="iii-o" numlevel="1" lineno="156" slineno="5-26" level="3" tab="1"><display>(iii)</display>for a county office without a chief deputy:<subsection ssid="24-24-13" dnum="A-o" numlevel="1" lineno="157" slineno="5-27" level="4"><display>(A)</display>if one management-level employee serving under the county office has a <ln numlevel="1" lineno="158" slineno="5-28"/>higher-seniority management level than any other employee serving under the <ln numlevel="1" lineno="159" slineno="5-29"/>county office, that management-level employee;</subsection><subsection ssid="24-24-14" dnum="B-o" numlevel="1" lineno="160" slineno="5-30" level="4"><display>(B)</display>if two or more management-level employees serving under the county office <ln numlevel="1" lineno="161" slineno="5-31"/>have the same and highest-seniority management level, the highest-seniority <ln numlevel="1" lineno="162" slineno="5-32"/>management-level employee with the most cumulative time served in the <ln numlevel="1" lineno="163" slineno="5-33"/>employee's current position; or</subsection><subsection ssid="24-24-15" dnum="C-o" numlevel="1" lineno="164" slineno="5-34" level="4"><display>(C)</display>notwithstanding Subsection <xref depth="4" refnumber="20A-1-508(2)(a)(iii)(A)" start="0">(2)(a)(iii)(A)</xref> or <xref depth="4" refnumber="20A-1-508(2)(a)(iii)(B)" start="0">(B)</xref>, if, before the vacating county <ln numlevel="1" lineno="165" slineno="5-35"/>officer vacates the office, the county officer files with the county clerk a <ln numlevel="1" lineno="166" slineno="5-36"/>written statement designating one of the county officer's employees to <ln numlevel="1" lineno="167" slineno="5-37"/>discharge the county officer's duties in the event the county officer vacates the <ln numlevel="1" lineno="168" slineno="5-38"/>office, the designated employee.</subsection></subsection></subsection><subsection ssid="24-24-16" dnum="b-o" numlevel="1" lineno="169" slineno="5-39" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="20A-1-508(2)(c)" start="0">(2)(c)</xref>, a temporary manager described in <ln numlevel="1" lineno="170" slineno="5-40"/>Subsection <xref depth="4" refnumber="20A-1-508(2)(a)" start="0">(2)(a)</xref> who temporarily discharges the duties of a county office holds the <ln numlevel="1" lineno="171" slineno="5-41"/>powers and duties of the county office until the county legislative body appoints an <ln numlevel="1" lineno="172" slineno="5-42"/>interim replacement under Subsection <xref depth="4" refnumber="20A-1-508(3)" start="0">(3)</xref>.</subsection><subsection ssid="24-24-17" dnum="c-o" numlevel="1" lineno="173" slineno="5-43" level="2"><display>(c)</display>The temporary manager described in Subsection <xref depth="4" refnumber="20A-1-508(2)(a)" start="0">(2)(a)</xref> who temporarily discharges <ln numlevel="1" lineno="174" slineno="5-44"/>the duties of a county office:<subsection ssid="24-24-18" dnum="i-o" numlevel="1" lineno="175" slineno="5-45" level="3"><display>(i)</display>may not take an oath of office for the county office as a temporary manager;</subsection><subsection ssid="24-24-19" dnum="ii-o" numlevel="1" lineno="176" slineno="5-46" level="3"><display>(ii)</display>shall comply with <xref depth="1" refnumber="17-36" start="0">Title 17, Chapter 36, Uniform Fiscal Procedures Act for <ln numlevel="1" lineno="177" slineno="5-47"/>Counties</xref>, and the county's budget ordinances and policies;</subsection><subsection ssid="24-24-20" dnum="iii-o" numlevel="1" lineno="178" slineno="5-48" level="3"><display>(iii)</display>unless approved by the county legislative body, may not change the <ln numlevel="1" lineno="179" slineno="5-49"/>compensation of an employee;</subsection><subsection ssid="24-24-21" dnum="iv-o" numlevel="1" lineno="180" slineno="5-50" level="3"><display>(iv)</display>unless approved by the county legislative body, may not promote or demote an <ln numlevel="1" lineno="181" slineno="5-51"/>employee or change an employee's job title;</subsection><subsection ssid="24-24-22" dnum="v-o" numlevel="1" lineno="182" slineno="5-52" level="3"><display>(v)</display>may terminate an employee only if the termination is conducted in accordance <ln numlevel="1" lineno="183" slineno="5-53"/>with:<subsection ssid="24-24-23" dnum="A-o" numlevel="1" lineno="184" slineno="5-54" level="4"><display>(A)</display>personnel rules described in Subsection <xref depth="4" refnumber="17-33-5(4)" start="0">17-33-5(4)</xref> that are approved by the <ln numlevel="1" lineno="185" slineno="5-55"/>county legislative body; and</subsection><subsection ssid="24-24-24" dnum="B-o" numlevel="1" lineno="186" slineno="5-56" level="4"><display>(B)</display>applicable law;</subsection></subsection><subsection ssid="24-24-25" dnum="vi-o" numlevel="1" lineno="187" slineno="5-57" level="3"><display>(vi)</display>unless approved by the county legislative body, may not exceed by more than 5% <ln numlevel="1" lineno="188" slineno="5-58"/>an expenditure that was planned before the county office for which the temporary <ln numlevel="1" lineno="189" slineno="5-59"/>manager discharges duties was vacated;</subsection><subsection ssid="24-24-26" dnum="vii-o" numlevel="1" lineno="190" slineno="5-60" level="3"><display>(vii)</display>except as provided in Subsection <xref depth="4" refnumber="20A-1-508(2)(c)(viii)" start="0">(2)(c)(viii)</xref>, may not receive a change in title or <ln numlevel="1" lineno="191" slineno="5-61"/>compensation; and</subsection><subsection ssid="24-24-27" dnum="viii-o" numlevel="1" lineno="192" slineno="5-62" level="3"><display>(viii)</display>if approved by the county legislative body, may receive a performance award <ln numlevel="1" lineno="193" slineno="5-63"/>after:<subsection ssid="24-24-28" dnum="A-o" numlevel="1" lineno="194" slineno="5-64" level="4"><display>(A)</display>the county legislative body appoints an interim replacement under Subsection <xref depth="4" refnumber="20A-1-508(3)" start="0"><ln numlevel="1" lineno="195" slineno="5-65"/>(3)</xref>; and</subsection><subsection ssid="24-24-29" dnum="B-o" numlevel="1" lineno="196" slineno="5-66" level="4"><display>(B)</display>the interim replacement is sworn into office.</subsection></subsection></subsection><subsection ssid="24-24-30" dnum="d-o" numlevel="1" lineno="197" slineno="5-67" level="2"><display>(d)</display>This Subsection <xref depth="4" refnumber="20A-1-508(2)" start="0">(2)</xref> does not apply to a vacancy in the office of county legislative <ln numlevel="1" lineno="198" slineno="5-68"/>body member.</subsection></subsection><subsection ssid="24-24-31" dnum="3-o" numlevel="1" lineno="199" slineno="5-69" level="1" space="false"><display>(3)</display><subsection ssid="24-24-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Until a replacement is selected as provided in this section and has qualified, the <ln numlevel="1" lineno="200" slineno="5-70"/>county legislative body shall appoint an interim replacement to fill the vacant office <ln numlevel="1" lineno="201" slineno="5-71"/>by following the procedures and requirements of this Subsection <xref depth="4" refnumber="20A-1-508(3)" start="0">(3)</xref>.</subsection><subsection ssid="24-110" dnum="_-o:b-e" numlevel="1" lineno="202" slineno="5-72" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1091" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="end">In addition to this Subsection <xref refnumber="20A-1-508(3)" depth="4">(3)</xref>, an interim replacement appointed to the office of <ln numlevel="1" lineno="203" slineno="5-73"/>county auditor in a county of the first class is subject to the requirements described in <ln numlevel="1" lineno="204" slineno="5-74"/>Section <xref depth="3" refnumber="17-19a-201.5">17-19a-201.5</xref>.</amend></subsection><subsection ssid="24-24-33" dnum="b-o:c-e" numlevel="1" lineno="205" slineno="5-75" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1092" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1093" style="1" owner="e" level="1" amendtag="both" space="true">(c)</amend></display><subsection ssid="24-24-34" dnum="i-o" level="3" placement="sameline"><display>(i)</display>To appoint an interim replacement, the county legislative body shall, <ln numlevel="1" lineno="206" slineno="5-76"/>within 10 days after the day on which the vacancy occurs, give notice of the <ln numlevel="1" lineno="207" slineno="5-77"/>vacancy to the party liaison of the same political party of the prior office holder <ln numlevel="1" lineno="208" slineno="5-78"/>and invite that party liaison to submit the name of an individual to fill the vacancy.</subsection><subsection ssid="24-24-35" dnum="ii-o" numlevel="1" lineno="209" slineno="5-79" level="3"><display>(ii)</display>That party liaison shall, before 5 p.m. within 30 days after the day on which the <ln numlevel="1" lineno="210" slineno="5-80"/>liaison receives the notice described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="20A-1-508(3)(b)(i)" start="0">(3)(b)(i)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="admin" level="1" amendtag="both" space="true">(3)(c)(i)</amend>, or if the <ln numlevel="1" lineno="211" slineno="5-81"/>party liaison does not receive the notice, before 5 p.m. within 40 days after the day <ln numlevel="1" lineno="212" slineno="5-82"/>on which the vacancy occurs, submit to the county legislative body the name of an <ln numlevel="1" lineno="213" slineno="5-83"/>individual the party selects in accordance with the party's constitution or bylaws to <ln numlevel="1" lineno="214" slineno="5-84"/>serve as the interim replacement.</subsection><subsection ssid="24-24-36" dnum="iii-o" numlevel="1" lineno="215" slineno="5-85" level="3"><display>(iii)</display>The county legislative body shall, no later than five days after the day on which a <ln numlevel="1" lineno="216" slineno="5-86"/>party liaison submits the name of the individual to serve as the interim <ln numlevel="1" lineno="217" slineno="5-87"/>replacement, appoint the individual to serve out the unexpired term.</subsection></subsection><subsection ssid="24-24-37" dnum="c-o:d-e" numlevel="1" lineno="218" slineno="5-88" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1096" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1097" style="1" owner="e" level="1" amendtag="both" space="true">(d)</amend></display><subsection ssid="24-24-38" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the county legislative body fails to appoint an interim replacement to fill <ln numlevel="1" lineno="219" slineno="5-89"/>the vacancy in accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="13" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="20A-1-508(3)(b)(iii)" start="0">(3)(b)(iii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="admin" level="1" amendtag="both" space="true">(3)(c)(iii)</amend>, the county clerk <ln numlevel="1" lineno="220" slineno="5-90"/>shall, no later than five days after the day of the deadline described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="14" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="20A-1-508(3)(b)(iii)" start="0"><ln numlevel="1" lineno="221" slineno="5-91"/>(3)(b)(iii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="admin" level="1" amendtag="both" space="true">(3)(c)(iii)</amend>, send to the governor a letter that:<subsection ssid="24-24-39" dnum="A-o" numlevel="1" lineno="222" slineno="5-92" level="4" tab="1"><display>(A)</display>informs the governor that the county legislative body has failed to appoint a <ln numlevel="1" lineno="223" slineno="5-93"/>replacement within the statutory time period; and</subsection><subsection ssid="24-24-40" dnum="B-o" numlevel="1" lineno="224" slineno="5-94" level="4" tab="1"><display>(B)</display>contains the name of the individual submitted by the party liaison to fill the <ln numlevel="1" lineno="225" slineno="5-95"/>vacancy.</subsection></subsection><subsection ssid="24-24-41" dnum="ii-o" numlevel="1" lineno="226" slineno="5-96" level="3"><display>(ii)</display>The governor shall, within 10 days after the day on which the governor receives <ln numlevel="1" lineno="227" slineno="5-97"/>the letter described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="15" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="20A-1-508(3)(c)(i)" start="0">(3)(c)(i)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="admin" level="1" amendtag="both" space="true">(3)(d)(i)</amend>, appoint the individual named <ln numlevel="1" lineno="228" slineno="5-98"/>by the party liaison as an interim replacement to fill the vacancy.</subsection></subsection><subsection ssid="24-24-42" dnum="d-o:e-e" numlevel="1" lineno="229" slineno="5-99" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1101" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1102" style="1" owner="e" level="1" amendtag="both" space="true">(e)</amend></display>An individual appointed as interim replacement under this Subsection <xref depth="4" refnumber="20A-1-508(3)" start="0">(3)</xref> shall <ln numlevel="1" lineno="230" slineno="5-100"/>hold office until a successor is elected and has qualified.</subsection></subsection><subsection ssid="24-24-43" dnum="4-o" numlevel="1" lineno="231" slineno="5-101" level="1" space="false"><display>(4)</display><subsection ssid="24-24-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The requirements of this Subsection <xref depth="4" refnumber="20A-1-508(4)" start="0">(4)</xref> apply to all county offices that become <ln numlevel="1" lineno="232" slineno="5-102"/>vacant if:<subsection ssid="24-24-45" dnum="i-o" numlevel="1" lineno="233" slineno="5-103" level="3" tab="1"><display>(i)</display>the vacant office has an unexpired term of two years or more; and</subsection><subsection ssid="24-24-46" dnum="ii-o" numlevel="1" lineno="234" slineno="5-104" level="3" tab="1"><display>(ii)</display>the vacancy occurs after the election at which the officeholder was elected, but <ln numlevel="1" lineno="235" slineno="5-105"/>before the first day of the declaration of candidacy filing period described in <ln numlevel="1" lineno="236" slineno="5-106"/>Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>.</subsection></subsection><subsection ssid="24-24-47" dnum="b-o" numlevel="1" lineno="237" slineno="5-107" level="2" space="false"><display>(b)</display><subsection ssid="24-24-48" dnum="i-o" level="3" placement="sameline"><display>(i)</display>When the conditions described in Subsection <xref depth="4" refnumber="20A-1-508(4)(a)" start="0">(4)(a)</xref> are met, the county clerk <ln numlevel="1" lineno="238" slineno="5-108"/>shall as soon as practicable, but no later than 180 days before the next regular <ln numlevel="1" lineno="239" slineno="5-109"/>general election, notify the public and each registered political party that the <ln numlevel="1" lineno="240" slineno="5-110"/>vacancy exists.</subsection><subsection ssid="24-24-49" dnum="ii-o" numlevel="1" lineno="241" slineno="5-111" level="3"><display>(ii)</display>An individual intending to become a party candidate for the vacant office shall <ln numlevel="1" lineno="242" slineno="5-112"/>file a declaration of candidacy in accordance with:<subsection ssid="24-24-50" dnum="A-o" numlevel="1" lineno="243" slineno="5-113" level="4"><display>(A)</display><xref depth="2" refnumber="20A-9-2" start="1">Chapter 9, Part 2, Candidate Qualifications and Declarations of Candidacy</xref>; <ln numlevel="1" lineno="244" slineno="5-114"/>and</subsection><subsection ssid="24-24-51" dnum="B-o" numlevel="1" lineno="245" slineno="5-115" level="4"><display>(B)</display>for a county commission office, Subsection <xref depth="4" refnumber="17-52a-201(6)" start="0">17-52a-201(6)</xref> or <xref depth="4" refnumber="17-52a-202(6)" start="0">17-52a-202(6)</xref>, <ln numlevel="1" lineno="246" slineno="5-116"/>if applicable.</subsection></subsection><subsection ssid="24-24-52" dnum="iii-o" numlevel="1" lineno="247" slineno="5-117" level="3"><display>(iii)</display>An individual who is nominated as a party candidate, who qualifies as an <ln numlevel="1" lineno="248" slineno="5-118"/>unaffiliated candidate for the vacant office under <xref depth="2" refnumber="20A-9-5" start="1">Chapter 9, Part 5, Candidates not <ln numlevel="1" lineno="249" slineno="5-119"/>Affiliated with a Party</xref>, or who qualifies as a write-in candidate for the vacant <ln numlevel="1" lineno="250" slineno="5-120"/>office under <xref depth="2" refnumber="20A-9-6" start="1">Chapter 9, Part 6, Write-in Candidates</xref>, shall run in the regular <ln numlevel="1" lineno="251" slineno="5-121"/>general election.</subsection></subsection></subsection><subsection ssid="24-24-53" dnum="5-o" numlevel="1" lineno="252" slineno="5-122" level="1" space="false"><display>(5)</display><subsection ssid="24-24-54" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The requirements of this Subsection <xref depth="4" refnumber="20A-1-508(5)" start="0">(5)</xref> apply to all county offices that become <ln numlevel="1" lineno="253" slineno="5-123"/>vacant if:<subsection ssid="24-24-55" dnum="i-o" numlevel="1" lineno="254" slineno="5-124" level="3" tab="1"><display>(i)</display>the vacant office has an unexpired term of two years or more; and</subsection><subsection ssid="24-24-56" dnum="ii-o" numlevel="1" lineno="255" slineno="5-125" level="3" tab="1"><display>(ii)</display>the vacancy occurs on or after the first day of the declaration of candidacy filing <ln numlevel="1" lineno="256" slineno="5-126"/>period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>, but more than 75 days before the regular <ln numlevel="1" lineno="257" slineno="5-127"/>primary election.</subsection></subsection><subsection ssid="24-24-57" dnum="b-o" numlevel="1" lineno="258" slineno="5-128" level="2"><display>(b)</display>When the conditions described in Subsection <xref depth="4" refnumber="20A-1-508(5)(a)" start="0">(5)(a)</xref> are met, the county clerk shall as <ln numlevel="1" lineno="259" slineno="5-129"/>soon as practicable, but no later than 70 days before the next regular primary <ln numlevel="1" lineno="260" slineno="5-130"/>election, notify the public and each registered political party:<subsection ssid="24-24-58" dnum="i-o" numlevel="1" lineno="261" slineno="5-131" level="3"><display>(i)</display>that the vacancy exists; and</subsection><subsection ssid="24-24-59" dnum="ii-o" numlevel="1" lineno="262" slineno="5-132" level="3"><display>(ii)</display>of the deadlines described in Subsection <xref depth="4" refnumber="20A-1-508(5)(c)(i)" start="0">(5)(c)(i)</xref> and the deadlines established <ln numlevel="1" lineno="263" slineno="5-133"/>under Subsection <xref depth="4" refnumber="20A-1-508(5)(d)(ii)" start="0">(5)(d)(ii)</xref>.</subsection></subsection><subsection ssid="24-24-60" dnum="c-o" numlevel="1" lineno="264" slineno="5-134" level="2" space="false"><display>(c)</display><subsection ssid="24-24-61" dnum="i-o" level="3" placement="sameline"><display>(i)</display>An individual intending to become a party candidate for a vacant office shall, <ln numlevel="1" lineno="265" slineno="5-135"/>within five days after the day on which the notice is given, ending at the close of <ln numlevel="1" lineno="266" slineno="5-136"/>normal office hours on the fifth day, file a declaration of candidacy for the vacant <ln numlevel="1" lineno="267" slineno="5-137"/>office in accordance with:<subsection ssid="24-24-62" dnum="A-o" numlevel="1" lineno="268" slineno="5-138" level="4" tab="1"><display>(A)</display><xref depth="2" refnumber="20A-9-2" start="1">Chapter 9, Part 2, Candidate Qualifications and Declarations of Candidacy</xref>; <ln numlevel="1" lineno="269" slineno="5-139"/>and</subsection><subsection ssid="24-24-63" dnum="B-o" numlevel="1" lineno="270" slineno="5-140" level="4" tab="1"><display>(B)</display>for a county commission office, Subsection <xref depth="4" refnumber="17-52a-201(6)" start="0">17-52a-201(6)</xref> or <xref depth="4" refnumber="17-52a-202(6)" start="0">17-52a-202(6)</xref>, <ln numlevel="1" lineno="271" slineno="5-141"/>if applicable.</subsection></subsection><subsection ssid="24-24-64" dnum="ii-o" numlevel="1" lineno="272" slineno="5-142" level="3"><display>(ii)</display>The county central committee of each party shall:<subsection ssid="24-24-65" dnum="A-o" numlevel="1" lineno="273" slineno="5-143" level="4"><display>(A)</display>select a candidate or candidates from among those qualified candidates who <ln numlevel="1" lineno="274" slineno="5-144"/>have filed declarations of candidacy; and</subsection><subsection ssid="24-24-66" dnum="B-o" numlevel="1" lineno="275" slineno="5-145" level="4"><display>(B)</display>certify the name of the candidate or candidates to the county clerk as soon as <ln numlevel="1" lineno="276" slineno="5-146"/>practicable, but before 5 p.m. no later than 60 days before the day of the <ln numlevel="1" lineno="277" slineno="5-147"/>regular primary election.</subsection></subsection></subsection><subsection ssid="24-24-67" dnum="d-o" numlevel="1" lineno="278" slineno="5-148" level="2" space="false"><display>(d)</display><subsection ssid="24-24-68" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="20A-1-508(5)(d)(ii)" start="0">(5)(d)(ii)</xref>, an individual intending to become a <ln numlevel="1" lineno="279" slineno="5-149"/>candidate for a vacant office who does not wish to affiliate with a registered <ln numlevel="1" lineno="280" slineno="5-150"/>political party shall file a verified certificate of nomination described in Section <xref depth="3" refnumber="20A-9-502" start="0"><ln numlevel="1" lineno="281" slineno="5-151"/>20A-9-502</xref> with the county clerk in accordance with <xref depth="2" refnumber="20A-9-5" start="1">Chapter 9, Part 5, Candidates <ln numlevel="1" lineno="282" slineno="5-152"/>not Affiliated with a Party</xref>.</subsection><subsection ssid="24-24-69" dnum="ii-o" numlevel="1" lineno="283" slineno="5-153" level="3" space="false"><display>(ii)</display><subsection ssid="24-24-70" dnum="A-o" level="4" placement="sameline"><display>(A)</display>The county clerk shall establish, in the clerk's reasonable discretion, a <ln numlevel="1" lineno="284" slineno="5-154"/>deadline that is before 5 p.m. no later than 65 days before the day of the next <ln numlevel="1" lineno="285" slineno="5-155"/>regular general election by which an individual who is not affiliated with a <ln numlevel="1" lineno="286" slineno="5-156"/>registered political party is required to submit a certificate of nomination under <ln numlevel="1" lineno="287" slineno="5-157"/>Subsection <xref depth="4" refnumber="20A-1-508(5)(d)(i)" start="0">(5)(d)(i)</xref>.</subsection><subsection ssid="24-24-71" dnum="B-o" numlevel="1" lineno="288" slineno="5-158" level="4"><display>(B)</display>The county clerk shall establish the deadline described in Subsection <xref depth="4" refnumber="20A-1-508(5)(d)(ii)(A)" start="0"><ln numlevel="1" lineno="289" slineno="5-159"/>(5)(d)(ii)(A)</xref> in a manner that gives an unaffiliated candidate an equal <ln numlevel="1" lineno="290" slineno="5-160"/>opportunity to access the regular general election ballot.</subsection></subsection></subsection><subsection ssid="24-24-72" dnum="e-o" numlevel="1" lineno="291" slineno="5-161" level="2"><display>(e)</display>An individual who is nominated as a party candidate for the vacant office, who <ln numlevel="1" lineno="292" slineno="5-162"/>qualifies as an unaffiliated candidate for the vacant office under <xref depth="2" refnumber="20A-9-5" start="1">Chapter 9, Part 5, <ln numlevel="1" lineno="293" slineno="5-163"/>Candidates not Affiliated with a Party</xref>, or who qualifies as a write-in candidate for the <ln numlevel="1" lineno="294" slineno="5-164"/>vacant office under <xref depth="2" refnumber="20A-9-6" start="1">Chapter 9, Part 6, Write-in Candidates</xref>, shall run in the regular <ln numlevel="1" lineno="295" slineno="5-165"/>general election.</subsection></subsection><subsection ssid="24-24-73" dnum="6-o" numlevel="1" lineno="296" slineno="5-166" level="1" space="false"><display>(6)</display><subsection ssid="24-24-74" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The requirements of this Subsection <xref depth="4" refnumber="20A-1-508(6)" start="0">(6)</xref> apply to all county offices that become <ln numlevel="1" lineno="297" slineno="5-167"/>vacant:<subsection ssid="24-24-75" dnum="i-o" numlevel="1" lineno="298" slineno="5-168" level="3" tab="1"><display>(i)</display>if the vacant office has an unexpired term of two years or more; and</subsection><subsection ssid="24-24-76" dnum="ii-o" numlevel="1" lineno="299" slineno="5-169" level="3" tab="1"><display>(ii)</display>when 75 days or less remain before the day of the regular primary election but <ln numlevel="1" lineno="300" slineno="5-170"/>more than 65 days remain before the day of the regular general election.</subsection></subsection><subsection ssid="24-24-77" dnum="b-o" numlevel="1" lineno="301" slineno="5-171" level="2"><display>(b)</display>When the conditions described in Subsection <xref depth="4" refnumber="20A-1-508(6)(a)" start="0">(6)(a)</xref> are met, the county clerk shall, as <ln numlevel="1" lineno="302" slineno="5-172"/>soon as practicable, notify the public and each registered political party:<subsection ssid="24-24-78" dnum="i-o" numlevel="1" lineno="303" slineno="5-173" level="3"><display>(i)</display>that the vacancy exists; and</subsection><subsection ssid="24-24-79" dnum="ii-o" numlevel="1" lineno="304" slineno="5-174" level="3"><display>(ii)</display>of the deadlines established under Subsection <xref depth="4" refnumber="20A-1-508(6)(d)" start="0">(6)(d)</xref>.</subsection></subsection><subsection ssid="24-24-80" dnum="c-o" numlevel="1" lineno="305" slineno="5-175" level="2" space="false"><display>(c)</display><subsection ssid="24-24-81" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Before the deadline that the county clerk establishes under Subsection <xref depth="4" refnumber="20A-1-508(6)(d)(i)(A)" start="0"><ln numlevel="1" lineno="306" slineno="5-176"/>(6)(d)(i)(A)</xref>, the county central committee of each registered political party that <ln numlevel="1" lineno="307" slineno="5-177"/>wishes to submit a candidate for the office shall certify the name of one candidate <ln numlevel="1" lineno="308" slineno="5-178"/>to the county clerk for placement on the regular general election ballot.</subsection><subsection ssid="24-24-82" dnum="ii-o" numlevel="1" lineno="309" slineno="5-179" level="3"><display>(ii)</display>Before the deadline that the county clerk establishes under Subsection <xref depth="4" refnumber="20A-1-508(6)(d)(i)(B)" start="0">(6)(d)(i)(B)</xref>, <ln numlevel="1" lineno="310" slineno="5-180"/>a candidate who does not wish to affiliate with a registered political party shall file <ln numlevel="1" lineno="311" slineno="5-181"/>a verified certificate of nomination described in Section <xref depth="3" refnumber="20A-9-502" start="0">20A-9-502</xref> with the <ln numlevel="1" lineno="312" slineno="5-182"/>county clerk in accordance with <xref depth="2" refnumber="20A-9-5" start="1">Chapter 9, Part 5, Candidates not Affiliated with <ln numlevel="1" lineno="313" slineno="5-183"/>a Party</xref>.</subsection><subsection ssid="24-24-83" dnum="iii-o" numlevel="1" lineno="314" slineno="5-184" level="3"><display>(iii)</display>Before the deadline that the county clerk establishes under Subsection <xref depth="4" refnumber="20A-1-508(6)(d)(i)(C)" start="0"><ln numlevel="1" lineno="315" slineno="5-185"/>(6)(d)(i)(C)</xref>, a write-in candidate shall submit to the county clerk a declaration of <ln numlevel="1" lineno="316" slineno="5-186"/>candidacy described in Section <xref depth="3" refnumber="20A-9-601" start="0">20A-9-601</xref>.</subsection></subsection><subsection ssid="24-24-84" dnum="d-o" numlevel="1" lineno="317" slineno="5-187" level="2" space="false"><display>(d)</display><subsection ssid="24-24-85" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The county clerk shall establish, in the clerk's reasonable discretion, deadlines <ln numlevel="1" lineno="318" slineno="5-188"/>that are before 5 p.m. no later than 65 days before the day of the next regular <ln numlevel="1" lineno="319" slineno="5-189"/>general election by which:<subsection ssid="24-24-86" dnum="A-o" numlevel="1" lineno="320" slineno="5-190" level="4" tab="1"><display>(A)</display>a registered political party is required to certify a name under Subsection <xref depth="4" refnumber="20A-1-508(6)(c)(i)" start="0"><ln numlevel="1" lineno="321" slineno="5-191"/>(6)(c)(i)</xref>;</subsection><subsection ssid="24-24-87" dnum="B-o" numlevel="1" lineno="322" slineno="5-192" level="4" tab="1"><display>(B)</display>an individual who does not wish to affiliate with a registered political party is <ln numlevel="1" lineno="323" slineno="5-193"/>required to submit a certificate of nomination under Subsection <xref depth="4" refnumber="20A-1-508(6)(c)(ii)" start="0">(6)(c)(ii)</xref>; and</subsection><subsection ssid="24-24-88" dnum="C-o" numlevel="1" lineno="324" slineno="5-194" level="4" tab="1"><display>(C)</display>a write-in candidate is required to submit a declaration of candidacy under <ln numlevel="1" lineno="325" slineno="5-195"/>Subsection <xref depth="4" refnumber="20A-1-508(6)(c)(iii)" start="0">(6)(c)(iii)</xref>.</subsection></subsection><subsection ssid="24-24-89" dnum="ii-o" numlevel="1" lineno="326" slineno="5-196" level="3"><display>(ii)</display>The county clerk shall establish deadlines under Subsection <xref depth="4" refnumber="20A-1-508(6)(d)(i)" start="0">(6)(d)(i)</xref> in a manner <ln numlevel="1" lineno="327" slineno="5-197"/>that gives an unaffiliated candidate or a write-in candidate an equal opportunity to <ln numlevel="1" lineno="328" slineno="5-198"/>access the regular general election ballot.</subsection></subsection><subsection ssid="24-24-90" dnum="e-o" numlevel="1" lineno="329" slineno="5-199" level="2"><display>(e)</display>An individual who is certified as a party candidate for the vacant office, who <ln numlevel="1" lineno="330" slineno="5-200"/>qualifies as an unaffiliated candidate for the vacant office under <xref depth="2" refnumber="20A-9-5" start="1">Chapter 9, Part 5, <ln numlevel="1" lineno="331" slineno="5-201"/>Candidates not Affiliated with a Party</xref>, or who qualifies as a write-in candidate for the <ln numlevel="1" lineno="332" slineno="5-202"/>vacant office under <xref depth="2" refnumber="20A-9-6" start="1">Chapter 9, Part 6, Write-in Candidates</xref>, shall run in the regular <ln numlevel="1" lineno="333" slineno="5-203"/>general election.</subsection></subsection><subsection ssid="24-24-91" dnum="7-o" numlevel="1" lineno="334" slineno="5-204" level="1" space="false"><display>(7)</display><subsection ssid="24-24-92" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The requirements of this Subsection <xref depth="4" refnumber="20A-1-508(7)" start="0">(7)</xref> apply to all county offices that become <ln numlevel="1" lineno="335" slineno="5-205"/>vacant:<subsection ssid="24-24-93" dnum="i-o" numlevel="1" lineno="336" slineno="5-206" level="3" tab="1"><display>(i)</display>if the vacant office has an unexpired term of less than two years; or</subsection><subsection ssid="24-24-94" dnum="ii-o" numlevel="1" lineno="337" slineno="5-207" level="3" tab="1"><display>(ii)</display>if the vacant office has an unexpired term of two years or more but 65 days or <ln numlevel="1" lineno="338" slineno="5-208"/>less remain before the day of the next regular general election.</subsection></subsection><subsection ssid="24-24-95" dnum="b-o" numlevel="1" lineno="339" slineno="5-209" level="2" space="false"><display>(b)</display><subsection ssid="24-24-96" dnum="i-o" level="3" placement="sameline"><display>(i)</display>When the conditions described in Subsection <xref depth="4" refnumber="20A-1-508(7)(a)" start="0">(7)(a)</xref> are met, the county <ln numlevel="1" lineno="340" slineno="5-210"/>legislative body shall as soon as practicable, but no later than 10 days after the day <ln numlevel="1" lineno="341" slineno="5-211"/>on which the vacancy occurs, give notice of the vacancy to the party liaison of the <ln numlevel="1" lineno="342" slineno="5-212"/>same political party as the prior office holder and invite that party liaison to <ln numlevel="1" lineno="343" slineno="5-213"/>submit the name of an individual to fill the vacancy.</subsection><subsection ssid="24-24-97" dnum="ii-o" numlevel="1" lineno="344" slineno="5-214" level="3"><display>(ii)</display>That party liaison shall, before 5 p.m. within 30 days after the day on which the <ln numlevel="1" lineno="345" slineno="5-215"/>party liaison receives the notice described in Subsection <xref depth="4" refnumber="20A-1-508(7)(b)(i)" start="0">(7)(b)(i)</xref>, or if the party <ln numlevel="1" lineno="346" slineno="5-216"/>liaison does not receive the notice, before 5 p.m. no later than 40 days after the <ln numlevel="1" lineno="347" slineno="5-217"/>day on which the vacancy occurs, submit to the county legislative body the name <ln numlevel="1" lineno="348" slineno="5-218"/>of an individual to fill the vacancy.</subsection><subsection ssid="24-24-98" dnum="iii-o" numlevel="1" lineno="349" slineno="5-219" level="3"><display>(iii)</display>The county legislative body shall, no later than five days after the day on which a <ln numlevel="1" lineno="350" slineno="5-220"/>party liaison submits the name of the individual to fill the vacancy, appoint the <ln numlevel="1" lineno="351" slineno="5-221"/>individual to serve out the unexpired term.</subsection></subsection><subsection ssid="24-24-99" dnum="c-o" numlevel="1" lineno="352" slineno="5-222" level="2" space="false"><display>(c)</display><subsection ssid="24-24-100" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the county legislative body fails to appoint an individual to fill the vacancy in <ln numlevel="1" lineno="353" slineno="5-223"/>accordance with Subsection <xref depth="4" refnumber="20A-1-508(7)(b)(iii)" start="0">(7)(b)(iii)</xref>, the county clerk shall send to the governor <ln numlevel="1" lineno="354" slineno="5-224"/>a letter that:<subsection ssid="24-24-101" dnum="A-o" numlevel="1" lineno="355" slineno="5-225" level="4" tab="1"><display>(A)</display>informs the governor that the county legislative body has failed to appoint an <ln numlevel="1" lineno="356" slineno="5-226"/>individual to fill the vacancy within the statutory time period; and</subsection><subsection ssid="24-24-102" dnum="B-o" numlevel="1" lineno="357" slineno="5-227" level="4" tab="1"><display>(B)</display>contains the name of the individual submitted by the party liaison to fill the <ln numlevel="1" lineno="358" slineno="5-228"/>vacancy.</subsection></subsection><subsection ssid="24-24-103" dnum="ii-o" numlevel="1" lineno="359" slineno="5-229" level="3"><display>(ii)</display>The governor shall, within 10 days after the day on which the governor receives <ln numlevel="1" lineno="360" slineno="5-230"/>the letter described in Subsection <xref depth="4" refnumber="20A-1-508(7)(c)(i)" start="0">(7)(c)(i)</xref>, appoint the individual named by the <ln numlevel="1" lineno="361" slineno="5-231"/>party liaison to fill the vacancy.</subsection></subsection><subsection ssid="24-24-104" dnum="d-o" numlevel="1" lineno="362" slineno="5-232" level="2"><display>(d)</display>An individual appointed to fill the vacancy under this Subsection <xref depth="4" refnumber="20A-1-508(7)" start="0">(7)</xref> shall hold office <ln numlevel="1" lineno="363" slineno="5-233"/>until a successor is elected and has qualified.</subsection></subsection><subsection ssid="24-24-105" dnum="8-o" numlevel="1" lineno="364" slineno="5-234" level="1"><display>(8)</display>Except as otherwise provided by law, the county legislative body may appoint <ln numlevel="1" lineno="365" slineno="5-235"/>replacements to fill all vacancies that occur in those offices filled by appointment of the <ln numlevel="1" lineno="366" slineno="5-236"/>county legislative body.</subsection><subsection ssid="24-24-106" dnum="9-o" numlevel="1" lineno="367" slineno="5-237" level="1"><display>(9)</display>Nothing in this section prohibits a candidate that does not wish to affiliate with a <ln numlevel="1" lineno="368" slineno="5-238"/>political party from filing a certificate of nomination for a vacant office within the same <ln numlevel="1" lineno="369" slineno="5-239"/>time limits as a candidate that is affiliated with a political party.</subsection><subsection ssid="24-24-107" dnum="10-o" numlevel="1" lineno="370" slineno="5-240" level="1" space="false"><display>(10)</display><subsection ssid="24-24-108" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each individual elected under Subsection <xref depth="4" refnumber="20A-1-508(4)" start="0">(4)</xref>, <xref depth="4" refnumber="20A-1-508(5)" start="0">(5)</xref>, or <xref depth="4" refnumber="20A-1-508(6)" start="0">(6)</xref> to fill a vacancy in a <ln numlevel="1" lineno="371" slineno="5-241"/>county office shall serve for the remainder of the unexpired term of the individual <ln numlevel="1" lineno="372" slineno="5-242"/>who created the vacancy and until a successor is elected and qualified.</subsection><subsection ssid="24-24-109" dnum="b-o" numlevel="1" lineno="373" slineno="5-243" level="2"><display>(b)</display>Nothing in this section may be construed to contradict or alter the provisions of <ln numlevel="1" lineno="374" slineno="5-244"/>Section <xref depth="3" refnumber="17-16-6" start="0">17-16-6</xref>.</subsection></subsection></section></bsec><bsec buid="25" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="375"
