Harper</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill addresses enforcement steps with regard to raw milk, including when raw milk is <ln numlevel="1" lineno="6" slineno="0-6"/>suspected in a food borne illness outbreak.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">defines terms;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">directs the Department of Agriculture and Food (department) to make rules regarding raw <ln numlevel="1" lineno="11" slineno="0-11"/>milk testing at third-party laboratories;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">addresses epidemiological investigation;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">addresses when and how testing occurs;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">provides the standard for reissuing a suspended permit;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">addresses the issuance of a cease and desist order;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">provides the standard for removing a cease and desist order following a foodborne illness <ln numlevel="1" lineno="17" slineno="0-17"/>outbreak;</hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">addresses disclosure of persons subject to a cease and desist order;</hl><hl numlevel="1" lineno="19" slineno="0-19" level="1">requires the department to provide information to a producer under certain circumstances; </hl><hl numlevel="1" lineno="20" slineno="0-20" level="1">clarifies penalty provisions; and</hl><hl numlevel="1" lineno="21" slineno="0-21" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="22" slineno="0-22" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="23">None</moniNone><oc numlevel="1" lineno="24" slineno="0-24">Other Special Clauses:</oc><ocNone lineno="25">None</ocNone><sa numlevel="1" lineno="26" slineno="0-26">Utah Code Sections Affected:<saamd numlevel="1" lineno="27" slineno="0-27"><snhead>AMENDS:</snhead><sn num="4-3-503" src="code" uid="C4-3-S503_2025050720250507" buid="1" sort="04 03 05030020250507" numlevel="1" lineno="28" slineno="0-28"><bold>4-3-503</bold>, as last amended by Laws of Utah 2023, Chapter 78</sn></saamd></sa></lt><enacthead lineno="29"/><enact numlevel="1" lineno="30" slineno="0-30">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" type="amend" src="code" num="4-3-503" uid="C4-3-S503_2025050720250507" sort="04 03 05030020250507" numlevel="1" lineno="31" slineno="1-1" sn="1"><section number="4-3-503" numlevel="1" lineno="32" slineno="1-2" type="amend"><secline lineno="31">Section 1, Section <bold>4-3-503</bold> is amended to read:</secline><catline lineno="32"><bold>4-3-503<parens/>. Sale of raw milk products -- Suspension of producer's permit -- <ln numlevel="1" lineno="33" slineno="1-3"/>Severability not permitted.</bold></catline><subsection ssid="1-1" dnum="1-o" numlevel="1" lineno="34" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-2" dnum="a-o" numlevel="1" lineno="35" slineno="1-5" level="2"><display>(a)</display>"Batch" means all the milk emptied from one bulk tank and bottled in a single day.</subsection><subsection ssid="1-103" dnum="_-o:b-e" numlevel="1" lineno="36" slineno="1-6" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="admin" level="1" amendtag="end">"Foodborne illness outbreak" means the occurrence of two or more cases from <ln numlevel="1" lineno="37" slineno="1-7"/>different households of a similar illness resulting from the ingestion of a common <ln numlevel="1" lineno="38" slineno="1-8"/>food.</amend></subsection><subsection ssid="1-3" dnum="b-o:c-e" numlevel="1" lineno="39" slineno="1-9" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1003" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1004" style="1" owner="e" level="1" amendtag="both" space="true">(c)</amend></display>"Raw milk product" means any product produced from raw milk.</subsection><subsection ssid="1-4" dnum="c-o:d-e" numlevel="1" lineno="40" slineno="1-10" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1004" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1005" style="1" owner="e" level="1" amendtag="both" space="true">(d)</amend></display>"Self-owned retail store" means a retail store:<subsection ssid="1-5" dnum="i-o" numlevel="1" lineno="41" slineno="1-11" level="3"><display>(i)</display>of which the producer owns at least 51% of the value of the real property and <ln numlevel="1" lineno="42" slineno="1-12"/>tangible personal property used in the operations of the retail store; or</subsection><subsection ssid="1-6" dnum="ii-o" numlevel="1" lineno="43" slineno="1-13" level="3"><display>(ii)</display>for which the producer has the power to vote at least 51% of any class of voting <ln numlevel="1" lineno="44" slineno="1-14"/>shares or ownership interest in the business entity that operates the retail store.</subsection></subsection></subsection><subsection ssid="1-7" dnum="2-o" numlevel="1" lineno="45" slineno="1-15" level="1"><display>(2)</display>Except as provided in Subsection <xref depth="4" refnumber="4-3-503(5)" start="0">(5)</xref>, a raw milk product may be manufactured, <ln numlevel="1" lineno="46" slineno="1-16"/>distributed, sold, delivered, held, stored, or offered for sale if:<subsection ssid="1-8" dnum="a-o" numlevel="1" lineno="47" slineno="1-17" level="2"><display>(a)</display>the producer obtains a permit from the department to produce the raw milk product <ln numlevel="1" lineno="48" slineno="1-18"/>under Subsection <xref depth="4" refnumber="4-3-301(6)" start="0">4-3-301(6)</xref>;</subsection><subsection ssid="1-9" dnum="b-o" numlevel="1" lineno="49" slineno="1-19" level="2"><display>(b)</display>the sale and delivery of the raw milk product is made upon the premises where the <ln numlevel="1" lineno="50" slineno="1-20"/>raw milk product is produced, except as provided by Subsection <xref depth="4" refnumber="4-3-503(3)" start="0">(3)</xref>;</subsection><subsection ssid="1-10" dnum="c-o" numlevel="1" lineno="51" slineno="1-21" level="2"><display>(c)</display>the raw milk product is sold to consumers for household use and not for resale;</subsection><subsection ssid="1-11" dnum="d-o" numlevel="1" lineno="52" slineno="1-22" level="2"><display>(d)</display>the raw milk product is bottled or packaged under sanitary conditions and in sanitary <ln numlevel="1" lineno="53" slineno="1-23"/>containers on the premises where the raw milk product is produced;</subsection><subsection ssid="1-12" dnum="e-o" numlevel="1" lineno="54" slineno="1-24" level="2"><display>(e)</display>the raw milk product is labeled "raw milk product" and meets the labeling <ln numlevel="1" lineno="55" slineno="1-25"/>requirements under 21 C.F.R. <ext_ref depth="2" refnumber="4-3-101" start="2" type="Code of Federal Regulations">Parts 101</ext_ref> and <ext_ref depth="2" refnumber="4-3-131" start="2">131</ext_ref> and rules established by the <ln numlevel="1" lineno="56" slineno="1-26"/>department;</subsection><subsection ssid="1-13" dnum="f-o" numlevel="1" lineno="57" slineno="1-27" level="2"><display>(f)</display>the raw milk used to produce the raw milk product is:<subsection ssid="1-14" dnum="i-o" numlevel="1" lineno="58" slineno="1-28" level="3"><display>(i)</display>cooled to 50 degrees Fahrenheit or a lower temperature within one hour after <ln numlevel="1" lineno="59" slineno="1-29"/>being drawn from the animal;</subsection><subsection ssid="1-15" dnum="ii-o" numlevel="1" lineno="60" slineno="1-30" level="3"><display>(ii)</display>further cooled to 41 degrees Fahrenheit within two hours of being drawn from the <ln numlevel="1" lineno="61" slineno="1-31"/>animal; and</subsection><subsection ssid="1-16" dnum="iii-o" numlevel="1" lineno="62" slineno="1-32" level="3"><display>(iii)</display>maintained at 41 degrees Fahrenheit or a lower temperature until the raw milk is <ln numlevel="1" lineno="63" slineno="1-33"/>delivered to the consumer or used to produce the raw milk product;</subsection></subsection><subsection ssid="1-17" dnum="g-o" numlevel="1" lineno="64" slineno="1-34" level="2"><display>(g)</display>the bacterial count of the raw milk used to produce the raw milk product does not <ln numlevel="1" lineno="65" slineno="1-35"/>exceed 20,000 colony forming units per milliliter<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="498" groupid="359" style="2" owner="admin" level="1" deltag="both">;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="504" groupid="364" style="1" owner="admin" level="1" amendtag="both" space="true"> and, if the bacterial count of raw <ln numlevel="1" lineno="66" slineno="1-36"/>milk used to produce the raw milk product exceeds 40,000 colony forming units per <ln numlevel="1" lineno="67" slineno="1-37"/>milliliter or the producer is implicated in a foodborne illness outbreak, the raw milk <ln numlevel="1" lineno="68" slineno="1-38"/>shall be tested and may not contain the following pathogens:</amend><subsection ssid="1-183" dnum="_-o:i-e" numlevel="1" lineno="69" slineno="1-39" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="482" groupid="346" style="1" owner="admin" level="1" amendtag="end">shiga toxin-producing e. coli;</amend></subsection><subsection ssid="1-185" dnum="_-o:ii-e" numlevel="1" lineno="70" slineno="1-40" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="488" groupid="351" style="1" owner="admin" level="1" amendtag="end">listeria monocytogenes;</amend></subsection><subsection ssid="1-186" dnum="_-o:iii-e" numlevel="1" lineno="71" slineno="1-41" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="492" groupid="354" style="1" owner="admin" level="1" amendtag="end">salmonella; and</amend></subsection><subsection ssid="1-187" dnum="_-o:iv-e" numlevel="1" lineno="72" slineno="1-42" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="497" groupid="358" style="1" owner="admin" level="1" amendtag="end">campylobacter;</amend></subsection></subsection><subsection ssid="1-18" dnum="h-o" numlevel="1" lineno="73" slineno="1-43" level="2"><display>(h)</display>the coliform count of the raw milk used to produce the raw milk product does not <ln numlevel="1" lineno="74" slineno="1-44"/>exceed 10 colony forming units per milliliter<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="505" groupid="365" style="2" owner="admin" level="1" deltag="both">;</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="506" groupid="366" style="1" owner="admin" level="1" amendtag="both" space="true"> and, if the coliform count of the raw <ln numlevel="1" lineno="75" slineno="1-45"/>milk used to produce the raw milk product exceeds 20 colony forming units per <ln numlevel="1" lineno="76" slineno="1-46"/>milliliter or the producer is implicated in a foodborne illness outbreak, the raw milk <ln numlevel="1" lineno="77" slineno="1-47"/>shall be tested and may not contain the following pathogens:</amend><subsection ssid="1-190" dnum="_-o:i-e" numlevel="1" lineno="78" slineno="1-48" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="511" groupid="370" style="1" owner="admin" level="1" amendtag="end">shiga toxin-producing e. coli;</amend></subsection><subsection ssid="1-191" dnum="_-o:ii-e" numlevel="1" lineno="79" slineno="1-49" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="516" groupid="374" style="1" owner="admin" level="1" amendtag="end">listeria monocytogenes;</amend></subsection><subsection ssid="1-192" dnum="_-o:iii-e" numlevel="1" lineno="80" slineno="1-50" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="521" groupid="378" style="1" owner="admin" level="1" amendtag="end">salmonella; and</amend></subsection><subsection ssid="1-193" dnum="_-o:iv-e" numlevel="1" lineno="81" slineno="1-51" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="526" groupid="382" style="1" owner="admin" level="1" amendtag="end">campylobacter;</amend></subsection></subsection><subsection ssid="1-19" dnum="i-o" numlevel="1" lineno="82" slineno="1-52" level="2"><display>(i)</display>the production of the raw milk product conforms to departmental rules for the <ln numlevel="1" lineno="83" slineno="1-53"/>production of grade A milk products;</subsection><subsection ssid="1-20" dnum="j-o" numlevel="1" lineno="84" slineno="1-54" level="2"><display>(j)</display>the dairy animals on the premises are:<subsection ssid="1-21" dnum="i-o" numlevel="1" lineno="85" slineno="1-55" level="3"><display>(i)</display>permanently and individually identifiable; and</subsection><subsection ssid="1-22" dnum="ii-o" numlevel="1" lineno="86" slineno="1-56" level="3"><display>(ii)</display>free of tuberculosis, brucellosis, and other diseases carried through milk; and</subsection></subsection><subsection ssid="1-23" dnum="k-o" numlevel="1" lineno="87" slineno="1-57" level="2"><display>(k)</display>any <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="20" style="2" owner="admin" level="1" deltag="both">person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="17" style="1" owner="admin" level="1" amendtag="both" space="true">individual</amend> on the premises performing any work in connection with the <ln numlevel="1" lineno="88" slineno="1-58"/>production, bottling, packaging, handling, or sale of the raw milk product is free from <ln numlevel="1" lineno="89" slineno="1-59"/>communicable disease.</subsection></subsection><subsection ssid="1-24" dnum="3-o" numlevel="1" lineno="90" slineno="1-60" level="1"><display>(3)</display>A producer may distribute, sell, deliver, hold, store, or offer for sale a raw milk product <ln numlevel="1" lineno="91" slineno="1-61"/>at a self-owned retail store, that is properly staffed, or from a mobile unit where the raw <ln numlevel="1" lineno="92" slineno="1-62"/>milk product is maintained through mechanical refrigeration at 41 degrees Fahrenheit or <ln numlevel="1" lineno="93" slineno="1-63"/>a lower temperature, if, in addition to the requirements of Subsection <xref depth="4" refnumber="4-3-503(2)" start="0">(2)</xref>, the producer:<subsection ssid="1-25" dnum="a-o" numlevel="1" lineno="94" slineno="1-64" level="2"><display>(a)</display>transports the raw milk product from the premises where the raw milk product is <ln numlevel="1" lineno="95" slineno="1-65"/>produced to the self-owned retail store in a refrigerated truck where the raw milk <ln numlevel="1" lineno="96" slineno="1-66"/>product is maintained at 41 degrees Fahrenheit or a lower temperature;</subsection><subsection ssid="1-26" dnum="b-o" numlevel="1" lineno="97" slineno="1-67" level="2"><display>(b)</display>retains ownership of the raw milk product until it is sold to the final consumer, <ln numlevel="1" lineno="98" slineno="1-68"/>including transporting the raw milk product from the premises where the raw milk <ln numlevel="1" lineno="99" slineno="1-69"/>product is produced to the self-owned retail store without any:<subsection ssid="1-27" dnum="i-o" numlevel="1" lineno="100" slineno="1-70" level="3"><display>(i)</display>intervening storage;</subsection><subsection ssid="1-28" dnum="ii-o" numlevel="1" lineno="101" slineno="1-71" level="3"><display>(ii)</display>change of ownership; or</subsection><subsection ssid="1-29" dnum="iii-o" numlevel="1" lineno="102" slineno="1-72" level="3"><display>(iii)</display>loss of physical control;</subsection></subsection><subsection ssid="1-30" dnum="c-o" numlevel="1" lineno="103" slineno="1-73" level="2"><display>(c)</display>stores the raw milk product at 41 degrees Fahrenheit or a lower temperature in a <ln numlevel="1" lineno="104" slineno="1-74"/>display case equipped with a properly calibrated thermometer at the self-owned retail <ln numlevel="1" lineno="105" slineno="1-75"/>store;</subsection><subsection ssid="1-31" dnum="d-o" numlevel="1" lineno="106" slineno="1-76" level="2"><display>(d)</display>places a sign above each display case that contains a raw milk product at the <ln numlevel="1" lineno="107" slineno="1-77"/>self-owned retail store that:<subsection ssid="1-32" dnum="i-o" numlevel="1" lineno="108" slineno="1-78" level="3"><display>(i)</display>is prominent;</subsection><subsection ssid="1-33" dnum="ii-o" numlevel="1" lineno="109" slineno="1-79" level="3"><display>(ii)</display>is easily readable by a consumer;</subsection><subsection ssid="1-34" dnum="iii-o" numlevel="1" lineno="110" slineno="1-80" level="3"><display>(iii)</display>reads in print that is no smaller than .5 inch in bold type, "This milk product is <ln numlevel="1" lineno="111" slineno="1-81"/>raw and unpasteurized.  Please keep refrigerated."; and</subsection><subsection ssid="1-35" dnum="iv-o" numlevel="1" lineno="112" slineno="1-82" level="3"><display>(iv)</display>meets any other requirement established by the department by rule;</subsection></subsection><subsection ssid="1-36" dnum="e-o" numlevel="1" lineno="113" slineno="1-83" level="2"><display>(e)</display>labels the raw milk product with:<subsection ssid="1-37" dnum="i-o" numlevel="1" lineno="114" slineno="1-84" level="3"><display>(i)</display>a date, no more than nine days after the raw milk product is produced, by which <ln numlevel="1" lineno="115" slineno="1-85"/>the raw milk product should be sold;</subsection><subsection ssid="1-38" dnum="ii-o" numlevel="1" lineno="116" slineno="1-86" level="3"><display>(ii)</display>the statement "Raw milk products, no matter how carefully produced, may be <ln numlevel="1" lineno="117" slineno="1-87"/>unsafe.";</subsection><subsection ssid="1-39" dnum="iii-o" numlevel="1" lineno="118" slineno="1-88" level="3"><display>(iii)</display>handling instructions to preserve quality and avoid contamination or spoilage;</subsection><subsection ssid="1-40" dnum="iv-o" numlevel="1" lineno="119" slineno="1-89" level="3"><display>(iv)</display>a specific colored label as determined by the department by rule; and</subsection><subsection ssid="1-41" dnum="v-o" numlevel="1" lineno="120" slineno="1-90" level="3"><display>(v)</display>any other information required by rule;</subsection></subsection><subsection ssid="1-42" dnum="f-o" numlevel="1" lineno="121" slineno="1-91" level="2"><display>(f)</display>refrains from offering the raw milk product for sale until:<subsection ssid="1-43" dnum="i-o" numlevel="1" lineno="122" slineno="1-92" level="3"><display>(i)</display>the department or a third party certified by the department tests each batch of raw <ln numlevel="1" lineno="123" slineno="1-93"/>milk used to produce a raw milk product for standard plate count and coliform <ln numlevel="1" lineno="124" slineno="1-94"/>count; and</subsection><subsection ssid="1-44" dnum="ii-o" numlevel="1" lineno="125" slineno="1-95" level="3"><display>(ii)</display>the test results meet the minimum standards established for those tests;</subsection></subsection><subsection ssid="1-45" dnum="g-o" numlevel="1" lineno="126" slineno="1-96" level="2" space="false"><display>(g)</display><subsection ssid="1-46" dnum="i-o" level="3" placement="sameline"><display>(i)</display>maintains a database of the raw milk product sales; and</subsection><subsection ssid="1-47" dnum="ii-o" numlevel="1" lineno="127" slineno="1-97" level="3"><display>(ii)</display>makes the database available to the Department of Health and Human Services <ln numlevel="1" lineno="128" slineno="1-98"/>during the self-owned retail store's business hours for purposes of epidemiological <ln numlevel="1" lineno="129" slineno="1-99"/>investigation;</subsection></subsection><subsection ssid="1-48" dnum="h-o" numlevel="1" lineno="130" slineno="1-100" level="2"><display>(h)</display>ensures that the plant and retail store complies with <xref depth="1" refnumber="4-5" start="1">Chapter 5, Utah Wholesome <ln numlevel="1" lineno="131" slineno="1-101"/>Food Act</xref>, and the rules governing food establishments enacted under Section <xref depth="3" refnumber="4-5-301" start="0">4-5-301</xref>; <ln numlevel="1" lineno="132" slineno="1-102"/>and</subsection><subsection ssid="1-49" dnum="i-o" numlevel="1" lineno="133" slineno="1-103" level="2"><display>(i)</display>complies with the applicable rules adopted as authorized by this chapter.</subsection></subsection><subsection ssid="1-50" dnum="4-o" numlevel="1" lineno="134" slineno="1-104" level="1"><display>(4)</display>A producer may distribute, sell, deliver, hold, store, or offer for sale a raw milk product <ln numlevel="1" lineno="135" slineno="1-105"/>and pasteurized milk at the same self-owned retail store if:<subsection ssid="1-51" dnum="a-o" numlevel="1" lineno="136" slineno="1-106" level="2"><display>(a)</display>the self-owned retail store is properly staffed; and</subsection><subsection ssid="1-52" dnum="b-o" numlevel="1" lineno="137" slineno="1-107" level="2"><display>(b)</display>the producer:<subsection ssid="1-53" dnum="i-o" numlevel="1" lineno="138" slineno="1-108" level="3"><display>(i)</display>meets the requirements of Subsections <xref depth="4" refnumber="4-3-503(2)" start="0">(2)</xref> and <xref depth="4" refnumber="4-3-503(3)" start="0">(3)</xref>;</subsection><subsection ssid="1-54" dnum="ii-o" numlevel="1" lineno="139" slineno="1-109" level="3"><display>(ii)</display>operates the self-owned retail store on the same property where the raw milk <ln numlevel="1" lineno="140" slineno="1-110"/>product is produced; and</subsection><subsection ssid="1-55" dnum="iii-o" numlevel="1" lineno="141" slineno="1-111" level="3"><display>(iii)</display>maintains separate, labeled, refrigerated display cases for raw milk products and <ln numlevel="1" lineno="142" slineno="1-112"/>pasteurized milk.</subsection></subsection></subsection><subsection ssid="1-56" dnum="5-o" numlevel="1" lineno="143" slineno="1-113" level="1"><display>(5)</display>A producer may, without meeting the requirements of Subsection <xref depth="4" refnumber="4-3-503(2)" start="0">(2)</xref>, sell up to 120 <ln numlevel="1" lineno="144" slineno="1-114"/>gallons of raw milk per month if:<subsection ssid="1-57" dnum="a-o" numlevel="1" lineno="145" slineno="1-115" level="2"><display>(a)</display>the sale is directly to an end consumer, for household use and not for resale;</subsection><subsection ssid="1-58" dnum="b-o" numlevel="1" lineno="146" slineno="1-116" level="2"><display>(b)</display>the sale and delivery of the raw milk is made upon the premises where the raw milk <ln numlevel="1" lineno="147" slineno="1-117"/>is produced;</subsection><subsection ssid="1-59" dnum="c-o" numlevel="1" lineno="148" slineno="1-118" level="2"><display>(c)</display>the producer labels the raw milk with:<subsection ssid="1-60" dnum="i-o" numlevel="1" lineno="149" slineno="1-119" level="3"><display>(i)</display>the producer's name and address;</subsection><subsection ssid="1-61" dnum="ii-o" numlevel="1" lineno="150" slineno="1-120" level="3"><display>(ii)</display>a date, no more than nine days after the raw milk is produced, by which the raw <ln numlevel="1" lineno="151" slineno="1-121"/>milk should be sold;</subsection><subsection ssid="1-62" dnum="iii-o" numlevel="1" lineno="152" slineno="1-122" level="3"><display>(iii)</display>the statement "This raw milk has not been licensed or inspected by the state of <ln numlevel="1" lineno="153" slineno="1-123"/>Utah. Raw milk, no matter how carefully produced, may be unsafe."; and</subsection><subsection ssid="1-63" dnum="iv-o" numlevel="1" lineno="154" slineno="1-124" level="3"><display>(iv)</display>handling instructions to preserve quality and avoid contamination or spoilage;</subsection></subsection><subsection ssid="1-64" dnum="d-o" numlevel="1" lineno="155" slineno="1-125" level="2"><display>(d)</display>the raw milk is:<subsection ssid="1-65" dnum="i-o" numlevel="1" lineno="156" slineno="1-126" level="3"><display>(i)</display>cooled to 50 degrees Fahrenheit or a lower temperature within one hour after <ln numlevel="1" lineno="157" slineno="1-127"/>being drawn from the animal; and</subsection><subsection ssid="1-66" dnum="ii-o" numlevel="1" lineno="158" slineno="1-128" level="3"><display>(ii)</display>further cooled to 41 degrees Fahrenheit within two hours of being drawn from the <ln numlevel="1" lineno="159" slineno="1-129"/>animal;</subsection></subsection><subsection ssid="1-67" dnum="e-o" numlevel="1" lineno="160" slineno="1-130" level="2"><display>(e)</display>the producer conducts a monthly test ensuring the coliform count of the raw milk <ln numlevel="1" lineno="161" slineno="1-131"/>does not exceed 10 colony-forming units per milliliter;</subsection><subsection ssid="1-68" dnum="f-o" numlevel="1" lineno="162" slineno="1-132" level="2"><display>(f)</display>the dairy animals on the producer's premises are free of tuberculosis, brucellosis, and <ln numlevel="1" lineno="163" slineno="1-133"/>other diseases carried through milk;</subsection><subsection ssid="1-69" dnum="g-o" numlevel="1" lineno="164" slineno="1-134" level="2"><display>(g)</display>the producer maintains records of tests and sales for a minimum of two years; and</subsection><subsection ssid="1-70" dnum="h-o" numlevel="1" lineno="165" slineno="1-135" level="2"><display>(h)</display>the producer notifies the department of the producer's intent to sell raw milk pursuant <ln numlevel="1" lineno="166" slineno="1-136"/>to this Subsection <xref depth="4" refnumber="4-3-503(5)" start="0">(5)</xref> and includes in the notification the producer's name and address.</subsection></subsection><subsection ssid="1-71" dnum="6-o" numlevel="1" lineno="167" slineno="1-137" level="1"><display>(6)</display>A person who conducts a test required by Subsection <xref depth="4" refnumber="4-3-503(3)" start="0">(3)</xref> shall send a copy of the test <ln numlevel="1" lineno="168" slineno="1-138"/>results to the department as soon as the test results are available.</subsection><subsection ssid="1-72" dnum="7-o" numlevel="1" lineno="169" slineno="1-139" level="1" space="false"><display>(7)</display><subsection ssid="1-73" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department shall <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="22" style="2" owner="admin" level="1" deltag="both">adopt</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="20" groupid="18" style="1" owner="admin" level="1" amendtag="both" space="true">make</amend> rules, as authorized by Section <xref depth="3" refnumber="4-3-201" start="0">4-3-201</xref><amend anum="0" ea="amend" pairid="130" groupid="109" style="1" owner="admin" level="1" amendtag="both"> and in <ln numlevel="1" lineno="170" slineno="1-140"/>accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act</amend>, <ln numlevel="1" lineno="171" slineno="1-141"/>governing the sale of raw milk products at a self-owned retail store.</subsection><subsection ssid="1-74" dnum="b-o" numlevel="1" lineno="172" slineno="1-142" level="2"><display>(b)</display>The rules adopted by the department shall include rules regarding:<subsection ssid="1-75" dnum="i-o" numlevel="1" lineno="173" slineno="1-143" level="3"><display>(i)</display>permits;</subsection><subsection ssid="1-76" dnum="ii-o" numlevel="1" lineno="174" slineno="1-144" level="3"><display>(ii)</display>building and premises requirements;</subsection><subsection ssid="1-77" dnum="iii-o" numlevel="1" lineno="175" slineno="1-145" level="3"><display>(iii)</display>sanitation and operating requirements, including bulk milk tanks requirements;</subsection><subsection ssid="1-78" dnum="iv-o" numlevel="1" lineno="176" slineno="1-146" level="3"><display>(iv)</display>additional tests;</subsection><subsection ssid="1-104" dnum="_-o:v-e" numlevel="1" lineno="177" slineno="1-147" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="e" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="16" style="1" owner="admin" level="1" amendtag="end">use of a third-party testing laboratory within or outside of the state;</amend></subsection><subsection ssid="1-79" dnum="v-o:vi-e" numlevel="1" lineno="178" slineno="1-148" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1088" style="2" owner="o" level="1" deltag="both">(v)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1089" style="1" owner="e" level="1" amendtag="both" space="true">(vi)</amend></display>frequency of inspections, including random cooler checks;</subsection><subsection ssid="1-80" dnum="vi-o:vii-e" numlevel="1" lineno="179" slineno="1-149" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1089" style="2" owner="o" level="1" deltag="both">(vi)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1090" style="1" owner="e" level="1" amendtag="both" space="true">(vii)</amend></display>recordkeeping; and</subsection><subsection ssid="1-81" dnum="vii-o:viii-e" numlevel="1" lineno="180" slineno="1-150" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1090" style="2" owner="o" level="1" deltag="both">(vii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1091" style="1" owner="e" level="1" amendtag="both" space="true">(viii)</amend></display>packaging and labeling.</subsection></subsection><subsection ssid="1-82" dnum="c-o" numlevel="1" lineno="181" slineno="1-151" level="2"><display>(c)</display>The department may make rules, in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="182" slineno="1-152"/>Administrative Rulemaking Act</xref>, regarding the standards of identity for a raw milk <ln numlevel="1" lineno="183" slineno="1-153"/>product.</subsection><subsection ssid="1-83" dnum="d-o" numlevel="1" lineno="184" slineno="1-154" level="2" space="false"><display>(d)</display><subsection ssid="1-84" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The department shall establish and collect a fee for the tests and inspections <ln numlevel="1" lineno="185" slineno="1-155"/>required by this section and by rule in accordance with Section <xref depth="3" refnumber="63J-1-504" start="0">63J-1-504</xref>.</subsection><subsection ssid="1-85" dnum="ii-o" numlevel="1" lineno="186" slineno="1-156" level="3"><display>(ii)</display>Notwithstanding Section <xref depth="3" refnumber="63J-1-504" start="0">63J-1-504</xref>, the department shall retain the fees as <ln numlevel="1" lineno="187" slineno="1-157"/>dedicated credits and may only use the fees to administer and enforce this section.</subsection></subsection></subsection><subsection ssid="1-86" dnum="8-o" numlevel="1" lineno="188" slineno="1-158" level="1" space="false"><display>(8)</display><subsection ssid="1-87" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department shall suspend a permit issued under Section <xref depth="3" refnumber="4-3-301" start="0">4-3-301</xref> if:<subsection ssid="1-88" dnum="i-o" numlevel="1" lineno="189" slineno="1-159" level="3" tab="1"><display>(i)</display>two out of four consecutive samples or two samples in a 30-day period violate <ln numlevel="1" lineno="190" slineno="1-160"/>sample limits established under this section; or</subsection><subsection ssid="1-89" dnum="ii-o" numlevel="1" lineno="191" slineno="1-161" level="3" tab="1"><display>(ii)</display>a producer violates this section or a rule adopted as authorized by this section.</subsection></subsection><subsection ssid="1-90" dnum="b-o" numlevel="1" lineno="192" slineno="1-162" level="2"><display>(b)</display>The department may reissue a permit that has been suspended under Subsection <xref depth="4" refnumber="4-3-503(8)(a)" start="0">(8)(a)</xref> <ln numlevel="1" lineno="193" slineno="1-163"/>if the producer has<amend anum="0" ea="amend" pairid="31" groupid="27" style="1" owner="admin" level="1" amendtag="both">:</amend><subsection ssid="1-105" dnum="_-o:i-e" numlevel="1" lineno="194" slineno="1-164" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1100" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="26" style="1" owner="admin" level="1" amendtag="end">obtained a sample result that meets the standards described in Subsections <xref refnumber="4-3-503(2)(g)" depth="4">(2)(g)</xref> <ln numlevel="1" lineno="195" slineno="1-165"/>and (h); and</amend></subsection><subsection ssid="1-106" dnum="_-o:ii-e" numlevel="1" lineno="196" slineno="1-166" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1101" style="1" owner="e" level="1" amendtag="both">(ii)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="528" groupid="384" style="2" owner="admin" level="1" deltag="both"> </amend><amendoutend style="2"/>complied with all of the requirements of this section and rules <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="269" groupid="223" style="2" owner="admin" level="1" deltag="both">adopted</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="267" groupid="221" style="1" owner="admin" level="1" amendtag="both" space="true">made</amend> <ln numlevel="1" lineno="197" slineno="1-167"/>as authorized by this section.</subsection></subsection><subsection ssid="1-145" dnum="_-o:c-e" numlevel="1" lineno="198" slineno="1-168" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1102" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="242" groupid="200" style="1" owner="admin" level="1" amendtag="end">Upon written request by a producer with a suspended permit, the department shall <ln numlevel="1" lineno="199" slineno="1-169"/>provide the producer information on how to request a hearing regarding the <ln numlevel="1" lineno="200" slineno="1-170"/>department's decision to suspend the permit.</amend></subsection></subsection><subsection ssid="1-91" dnum="9-o" numlevel="1" lineno="201" slineno="1-171" level="1" space="false"><display>(9)</display><subsection ssid="1-92" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If any subsection of this section or the application of any subsection to any person <ln numlevel="1" lineno="202" slineno="1-172"/>or circumstance is held invalid by a final decision of a court of competent <ln numlevel="1" lineno="203" slineno="1-173"/>jurisdiction, the remainder of the section may not be given effect without the invalid <ln numlevel="1" lineno="204" slineno="1-174"/>subsection or application.</subsection><subsection ssid="1-93" dnum="b-o" numlevel="1" lineno="205" slineno="1-175" level="2"><display>(b)</display>The provisions of this section may not be severed.</subsection></subsection><subsection ssid="1-94" dnum="10-o" numlevel="1" lineno="206" slineno="1-176" level="1" space="false"><display>(10)</display><subsection ssid="1-142" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1107" style="1" owner="e" level="1" amendtag="both">(a)</amend></display>Nothing in this chapter shall <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="263" groupid="217" style="2" owner="admin" level="1" deltag="both">be construed to </amend><amendoutend style="2"/>impede the Department of Health <ln numlevel="1" lineno="207" slineno="1-177"/>and Human Services or the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="227" groupid="187" style="2" owner="admin" level="1" deltag="both">Department of Agriculture and Food</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="226" groupid="186" style="1" owner="admin" level="1" amendtag="both" space="true">department</amend> in <amend anum="0" ea="amend" pairid="421" groupid="342" style="1" owner="admin" level="1" amendtag="both">an </amend><ln numlevel="1" lineno="208" slineno="1-178"/>investigation of <amend anum="0" ea="amend" pairid="41" groupid="35" style="1" owner="admin" level="1" amendtag="both">a </amend>foodborne illness<amend anum="0" ea="amend" pairid="42" groupid="36" style="1" owner="admin" level="1" amendtag="both"> outbreak</amend>.</subsection><subsection ssid="1-143" dnum="_-o:b-e" numlevel="1" lineno="209" slineno="1-179" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1108" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="224" groupid="184" style="1" owner="admin" level="1" amendtag="end">Notwithstanding Subsection <xref refnumber="4-3-503(10)(a)" depth="4">(10)(a)</xref>, if the Department of Health and Human <ln numlevel="1" lineno="210" slineno="1-180"/>Services or the department uses a survey to determine whether there is a foodborne <ln numlevel="1" lineno="211" slineno="1-181"/>illness outbreak linked to a raw milk product, the survey shall include questions that <ln numlevel="1" lineno="212" slineno="1-182"/>probe the common sources of the implicated pathogen for the foodborne illness <ln numlevel="1" lineno="213" slineno="1-183"/>outbreak.</amend></subsection></subsection><subsection ssid="1-95" dnum="11-o" numlevel="1" lineno="214" slineno="1-184" level="1" space="false"><display>(11)</display><subsection ssid="1-108" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1110" style="1" owner="e" level="1" amendtag="both">(a)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="239" groupid="197" style="2" owner="admin" level="1" deltag="both">The </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="237" groupid="195" style="1" owner="admin" level="1" amendtag="both" space="true">If after the investigation of a foodborne illness outbreak the department <ln numlevel="1" lineno="215" slineno="1-185"/>links the foodborne illness outbreak to a producer, the </amend>department shall issue a cease <ln numlevel="1" lineno="216" slineno="1-186"/>and desist order to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="241" groupid="199" style="2" owner="admin" level="1" deltag="both">a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="238" groupid="196" style="1" owner="admin" level="1" amendtag="both" space="true">the</amend> producer linked to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="251" groupid="207" style="2" owner="admin" level="1" deltag="both">a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="250" groupid="206" style="1" owner="admin" level="1" amendtag="both" space="true">the</amend> foodborne illness <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="43" groupid="37" style="2" owner="admin" level="1" deltag="both">and shall stop <ln numlevel="1" lineno="217" slineno="1-187"/>sale of a raw milk product currently being sold.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="49" groupid="42" style="1" owner="admin" level="1" amendtag="both" space="true">outbreak prohibiting the sale of the <ln numlevel="1" lineno="218" slineno="1-188"/>raw milk product pending testing required by Subsection <xref tempid="198" depth="4" refnumber="4-3-503(11)(h)">(11)(h)</xref>(i).</amend></subsection><subsection ssid="1-126" dnum="_-o:b-e" numlevel="1" lineno="219" slineno="1-189" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="136" groupid="114" style="1" owner="admin" level="1" amendtag="end">For purposes of the cease and desist order, to positively link a producer to a <ln numlevel="1" lineno="220" slineno="1-190"/>foodborne illness outbreak, the department shall produce evidence from the <ln numlevel="1" lineno="221" slineno="1-191"/>investigation under Subsection <xref refnumber="4-3-503(10)" depth="4">(10)</xref> that the foodborne illness outbreak originated <ln numlevel="1" lineno="222" slineno="1-192"/>with the producer's raw milk product.</amend></subsection><subsection ssid="1-165" dnum="_-o:c-e" numlevel="1" lineno="223" slineno="1-193" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1112" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="373" groupid="305" style="1" owner="admin" level="1" amendtag="end">A producer who receives a cease and desist order from the department shall:</amend><subsection ssid="1-168" dnum="_-o:i-e" numlevel="1" lineno="224" slineno="1-194" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1113" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="391" groupid="319" style="1" owner="admin" level="1" amendtag="end">stop the sale of the raw milk product named in the cease and desist order; and</amend></subsection><subsection ssid="1-169" dnum="_-o:ii-e" numlevel="1" lineno="225" slineno="1-195" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1114" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="396" groupid="323" style="1" owner="admin" level="1" amendtag="end">notify persons who purchased raw milk products from the implicated <ln numlevel="1" lineno="226" slineno="1-196"/>contaminated batch of the cease and desist order.</amend></subsection></subsection><subsection ssid="1-127" dnum="_-o:d-e" numlevel="1" lineno="227" slineno="1-197" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1115" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="141" groupid="118" style="1" owner="admin" level="1" amendtag="end">The department shall collect a sample within two working days of issuing a cease <ln numlevel="1" lineno="228" slineno="1-198"/>and desist order for the purpose of submitting the sample to a laboratory for:</amend><subsection ssid="1-170" dnum="_-o:i-e" numlevel="1" lineno="229" slineno="1-199" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1116" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="401" groupid="327" style="1" owner="admin" level="1" amendtag="end">testing for pathogens; and</amend></subsection><subsection ssid="1-171" dnum="_-o:ii-e" numlevel="1" lineno="230" slineno="1-200" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1117" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="406" groupid="331" style="1" owner="admin" level="1" amendtag="end">if the department wants to publicly disclose a producer's name or identifying <ln numlevel="1" lineno="231" slineno="1-201"/>information under Subsection <xref refnumber="4-3-503(11)(g)" depth="4">(11)(g)</xref>, whole genome sequencing testing.</amend></subsection></subsection><subsection ssid="1-128" dnum="_-o:e-e" numlevel="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="146" groupid="122" style="1" owner="admin" level="1" amendtag="end">The time between the department collecting the sample under Subsection <xref refnumber="4-3-503(11)(d)" depth="4">(11)(d)</xref> and <ln numlevel="1" lineno="233" slineno="1-203"/>the department notifying the producer of whole genome sequencing test results may <ln numlevel="1" lineno="234" slineno="1-204"/>not exceed 15 working days unless before the 15-working day period expires the <ln numlevel="1" lineno="235" slineno="1-205"/>department notifies the producer in writing that the department requires additional <ln numlevel="1" lineno="236" slineno="1-206"/>time to notify the producer of the whole genome sequencing test results.</amend></subsection><subsection ssid="1-129" dnum="_-o:f-e" numlevel="1" lineno="237" slineno="1-207" ea="amend" anum="0" owner="admin" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1119" style="1" owner="e" level="1" amendtag="start">(f)</amend></display><subsection ssid="1-166" dnum="_-o:i-e" ea="amend" anum="0" owner="admin" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1120" style="1" owner="e" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="382" groupid="312" style="1" owner="admin" level="1" amendtag="end">Upon the producer's request and the producer being liable for the costs of the <ln numlevel="1" lineno="238" slineno="1-208"/>second laboratory, the department shall have the sample collected under <ln numlevel="1" lineno="239" slineno="1-209"/>Subsection (11)(d) analyzed by two laboratories.</amend></subsection><subsection ssid="1-167" dnum="_-o:ii-e" numlevel="1" lineno="240" slineno="1-210" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1121" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="386" groupid="315" style="1" owner="admin" level="1" amendtag="end">The producer shall select the second laboratory from a list of laboratories <ln numlevel="1" lineno="241" slineno="1-211"/>approved by the department.</amend></subsection></subsection><subsection ssid="1-130" dnum="_-o:g-e" numlevel="1" lineno="242" slineno="1-212" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1122" style="1" owner="e" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="156" groupid="130" style="1" owner="admin" level="1" amendtag="end">Before publicly disclosing a producer's name or identifying information, the <ln numlevel="1" lineno="243" slineno="1-213"/>department shall notify the producer that the department has linked the producer to a <ln numlevel="1" lineno="244" slineno="1-214"/>foodborne illness outbreak with a positive whole genome sequencing test.</amend><subsection ssid="1-96" dnum="12-o:_-e" numlevel="1" lineno="245" slineno="1-215" ea="erase" anum="0" owner="admin" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1123" style="2" owner="o" level="1" deltag="start">(12)</amend></display><amend anum="0" ea="erase" pairid="270" groupid="224" style="2" owner="admin" level="1" deltag="end">The </amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-161" dnum="_-o:h-e" numlevel="1" lineno="246" slineno="1-216" ea="amend" anum="0" owner="admin" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="e" level="1" amendtag="start">(h)</amend></display><subsection ssid="1-162" dnum="_-o:i-e" ea="amend" anum="0" owner="admin" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="e" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="349" groupid="286" style="1" owner="admin" level="1" amendtag="end">A cease and desist </amend>order shall remain in effect until the department<amend anum="0" ea="amend" pairid="326" groupid="269" style="1" owner="admin" level="1" amendtag="both">:</amend><subsection ssid="1-157" dnum="_-o:A-e" numlevel="1" lineno="247" slineno="1-217" ea="amend" anum="0" owner="admin" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="e" level="1" amendtag="both">(A)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="407" groupid="332" style="2" owner="admin" level="1" deltag="both"> </amend><amendoutend style="2"/>verifies that the producer<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="354" groupid="290" style="2" owner="admin" level="1" deltag="both">:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="527" groupid="383" style="1" owner="admin" level="1" amendtag="both" space="true"> who is subject to the cease and desist order</amend><subsection ssid="1-97" dnum="a-o:_-e" numlevel="1" lineno="248" slineno="1-218" ea="erase" anum="0" owner="admin" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1127" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/></display><amend anum="0" ea="amend" pairid="531" groupid="387" style="1" owner="admin" level="1" amendtag="both" space="true"> </amend>adheres to this section<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="359" groupid="293" style="2" owner="admin" level="1" deltag="both">;</amend><amendoutend style="2"/> and</subsection><subsection ssid="1-98" dnum="b-o:_-e" numlevel="1" lineno="249" slineno="1-219" ea="erase" anum="0" owner="admin" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1128" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/></display><amend anum="0" ea="amend" pairid="532" groupid="388" style="1" owner="admin" level="1" amendtag="both" space="true"> </amend>has three consecutive <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="408" groupid="333" style="2" owner="admin" level="1" deltag="both">clean </amend><amendoutend style="2"/>tests of the raw milk product<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="367" groupid="300" style="2" owner="admin" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="377" groupid="308" style="1" owner="admin" level="1" amendtag="both" space="true"> that show that <ln numlevel="1" lineno="250" slineno="1-220"/>the raw milk product meets the standards described in Subsections <xref refnumber="4-3-503(2)(g)" depth="4">(2)(g)</xref> and <ln numlevel="1" lineno="251" slineno="1-221"/>(h) and is free of the pathogens listed in Subsections (2)(g) and (h); or</amend></subsection></subsection><subsection ssid="1-154" dnum="_-o:B-e" numlevel="1" lineno="252" slineno="1-222" ea="amend" anum="0" owner="admin" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1129" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="317" groupid="261" style="1" owner="admin" level="1" amendtag="end">receives a genome sequencing test result that demonstrates that the producer's <ln numlevel="1" lineno="253" slineno="1-223"/>raw milk product is not linked to the foodborne illness outbreak that is the <ln numlevel="1" lineno="254" slineno="1-224"/>subject of the cease and desist order.</amend></subsection></subsection><subsection ssid="1-163" dnum="_-o:ii-e" numlevel="1" lineno="255" slineno="1-225" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1130" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="365" groupid="298" style="1" owner="admin" level="1" amendtag="end">The department shall notify a producer who is subject to a cease and desist order <ln numlevel="1" lineno="256" slineno="1-226"/>that the cease and desist order is not in effect within one working day of the <ln numlevel="1" lineno="257" slineno="1-227"/>conditions of Subsection <xref refnumber="4-3-503(11)(h)" depth="4">(11)(h)</xref>(i) being met.</amend></subsection><subsection ssid="1-141" dnum="_-o:iii-e" numlevel="1" lineno="258" slineno="1-228" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1131" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="215" groupid="177" style="1" owner="admin" level="1" amendtag="end">For purposes of a test described in Subsection (11)(h)(i)(A), the department shall <ln numlevel="1" lineno="259" slineno="1-229"/>collect a sample for each test within two working days of the producer requesting <ln numlevel="1" lineno="260" slineno="1-230"/>that a sample be collected.</amend><subsection ssid="1-99" dnum="13-o:_-e" numlevel="1" lineno="261" slineno="1-231" ea="erase" anum="0" owner="admin" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1132" style="2" owner="o" level="1" deltag="start">(13)</amend></display><amend anum="0" ea="erase" pairid="117" groupid="97" style="2" owner="admin" level="1" deltag="end">In addition to Subsections <xref depth="4" refnumber="4-3-503(11)" start="0">(11)</xref> and <xref depth="4" refnumber="4-3-503(12)" start="0">(12)</xref>, if a producer's raw milk product has been <ln numlevel="1" lineno="262" slineno="1-232"/>linked to a foodborne illness outbreak,</amend><amendoutend style="2"/></subsection></subsection></subsection></subsection><subsection ssid="1-121" dnum="_-o:12-e" numlevel="1" lineno="263" slineno="1-233" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1133" style="1" owner="e" level="1" amendtag="start">(12)</amend></display><subsection ssid="1-172" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1134" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="116" groupid="96" style="1" owner="admin" level="1" amendtag="end">If the Department of Health and Human Services or the department links a <ln numlevel="1" lineno="264" slineno="1-234"/>producer's raw milk product to a foodborne illness outbreak</amend> and the department finds <ln numlevel="1" lineno="265" slineno="1-235"/>that the producer has violated <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="264" groupid="218" style="2" owner="admin" level="1" deltag="both">the applicable provisions of </amend><amendoutend style="2"/>this section, the <ln numlevel="1" lineno="266" slineno="1-236"/>department may impose upon the producer the following administrative penalties:<subsection ssid="1-100" dnum="a-o:i-e" numlevel="1" lineno="267" slineno="1-237" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1135" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1136" style="1" owner="e" level="1" amendtag="both" space="true">(i)</amend></display>upon the first violation, a penalty of no more than $300;</subsection><subsection ssid="1-101" dnum="b-o:ii-e" numlevel="1" lineno="268" slineno="1-238" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1136" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1137" style="1" owner="e" level="1" amendtag="both" space="true">(ii)</amend></display>upon a second violation, a penalty of no more than $750; and</subsection><subsection ssid="1-102" dnum="c-o:iii-e" numlevel="1" lineno="269" slineno="1-239" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1137" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1138" style="1" owner="e" level="1" amendtag="both" space="true">(iii)</amend></display>upon a third or subsequent violation a penalty of no more than $1,500.</subsection></subsection><subsection ssid="1-122" dnum="_-o:b-e" numlevel="1" lineno="270" slineno="1-240" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="128" groupid="107" style="1" owner="admin" level="1" amendtag="end">The department may impose the penalties described in Subsection (12)(a) in addition <ln numlevel="1" lineno="271" slineno="1-241"/>to:</amend><subsection ssid="1-148" dnum="_-o:i-e" numlevel="1" lineno="272" slineno="1-242" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="257" groupid="212" style="1" owner="admin" level="1" amendtag="end">issuing a cease and desist order under Subsection <xref refnumber="4-3-503(11)" depth="4">(11)</xref>; or</amend></subsection><subsection ssid="1-149" dnum="_-o:ii-e" numlevel="1" lineno="273" slineno="1-243" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="262" groupid="216" style="1" owner="admin" level="1" amendtag="end">suspending a permit under Subsection (8).</amend></subsection></subsection></subsection></section></bsec><bsec buid="2" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="274"
